Michael Jackson's Dad Wants Medical Records

Michael Jackson's father, Joe Jackson, has subpoenaed medical and other records from the UCLA Medical Center because he believes the records could reveal evidence of foul play in Jackson's death -- and the subpoena has outraged MJ estate lawyers ... TMZ has learned.

Joe's lawyer, Brian Oxman, sent 2 subpoenas to the UCLA Medical Center -- the hospital where Michael Jackson was pronounced dead on June 25. Oxman is asking for a number of documents, including medical records, autopsy reports, autopsy photos, medications and prognosis assessments.

Joe Jackson tells TMZ his entire family is behind the subpoenas -- Katherine, the brothers and sisters, along with him. He says they all believe the medical records will show what was in Jackson's body when he passed and they believe the information will expose foul play.

We've obtained a letter sent to Oxman by estate lawyer Howard Weitzman, in which Weitzman calls the subpoenas "clearly improper." Weitzman claims the subpoenas violate Jackson's right of privacy and the physician/patient privilege. Weitzman also says the subpoenas are irrelevant to Joe Jackson's only legal claim -- a financial allowance.

So let me get this straight - some of you would not want to know what others found to be the cause of death of one of your loved ones? Whatever. Stop trying to make his request seem unreasonable. Whatever his relationship was with his son, he was his son, and he has a right to know what was written in those records.

I agree with you completely, Arlis! Joe Jackson is not going to win father or husband of the year, and I don't think anyone would argue with that. But he was Michael FATHER and Michael was his SON. Katherine was Michael's MOTHER and the rest were his BROTHERS and SISTERS. Every last one of them as well as Michael's children and the nieces and nephews he adored have a right to know how he died.

They also have a right to file a WRONGFUL DEATH SUIT if one is warrented and if those responsible for Michael's death are not punished any other way. Yes, Michael was responsible for his own well being and did have a hand in his own demise, but Michael already paid the price. What about the others who were involved? Joe's methods are questionable, but he is looking out for his children like he always has. The man was apparently not very capable of expressing love and emotion, but he did always have his children's best interests at heart.

Additionally, I have no problem with Joe receiving a stipend from Michael's estate. I don't think Michael would object to it. He loved his father. Up until the night before he died, he never stopped talking about him.

This is an interesting and important question.

Michael Jackson, sadly, is dead. If there was foul play, it's for the police to find out and the DA to prosecute. But what if they don't?

I fully understand the concern for MJ's privacy. But he is gone, he cannot say himself (it it were the case): "Listen, there was foul play here, go get them!" MJ needs a personal lawyer to look after his interests, which may not be the same as the lawyer for his estate.

Who have the right to look into this? His heirs (his father is not one of them)? I suppose the heirs may at some point, maybe after the investigation is complete, have the right to look at all the medical records. The hospital and law enforcement can't very well reign supreme here.

If MJ wanted Joe to have money from his estate, he would have left it to him in his will. He was his business manager. Never his father. They had to call him Joe. Stop inventing fiction.

Email response I just received from MJ's estate attorney below:

We released no confidential information to TMZ. They had my letter and the subpoena (obviously from Mr. Jackson or his attorney) when they called. Your assumptions are wrong - period. We continue to protect Michael's rights and his legacy.

I hope Joe and the family is reading all of these comments. I DO NOT BELIEVE the famiy back's Joe on this. They will be filing next to stop it. HE WILL SELL THE PHOTO'S FOR MILLIONS. Actually doesn't the police have to use the info first before releasing any thing that could be released to defense beforeit is suppose dto?

A.B. - I am now curious about something you brought up above. If Michael's legally named heirs are the only ones who have a right to look into his medical records etc., how would that work in this case in terms of investigating foul play? If we assume that the police are either not going to investigate or not going to investigate properly and it only leaves MJ's legally named heirs, then you are talking about his three children -- all minors. How could any of them possibly look into his manner of death even if they wanted to? Then you have his mother -- another legally named heir and almost 80 years old. Could she take on something like this without the help of others who have a vested interest (namely other family members)?

Katherine and the 3 kids are the only heirs named legally in the will as far as is known. Would Tito's sons be considered legal heirs since they are also named but probably won't get any inheritance unless Michael's kids pass away and cannot claim theirs? Tito's "kids" are all in their 30s and might be the perfect people to take on this case from the family's perspective. Otherwise, who is left if you're talking about only those named in the will?

He is a selfish SOB who treated his boys like slaves, whored around with groupies, sadistically beat the hell out of Michael and is alleged to have sexually abused his children. All of you who think Joe is entitled to anything as MJ's father are kidding yourselves. He never wanted to be MJ's father. He refused to allow him to call him dad. He only wanted to be MJ's manager. That is all he should be now, too. A former manager. MJ would NEVER let his dad see his medical records. Joe Jackson only cares about Joe Jackson. He proved it beyond a shadow of a doubt at the BET awards when all he cared about was promoting his new blu ray dvd company and forgot to pretend to be sad about his son dying and then taking that singer to the VMA awards for MJ's tribute. Isn't it alleged that he sexually abused his kids? He was an ex boxer who beat the hell out of his kids and treated them like slaves and while whoring around with every groupie he could find. He treated his boys like a pimp. Stop confusing him with your own dad. He is only after MONEY. That is all he has ever cared about.

Stop thinking Joe Jackson is the devil incarnate and didn't care about Michael and is not affected by his death. Stop assuming the family is in no emotional pain over what happened to their son, brother, father, uncle. Stop thinking we (the public) are privy to everything that has gone on since June 25. Stop thinking that every move the family makes is a move to profit instead of a move to find out what happened to their loved one. Stop assuming MJ hated his family, particularly his father. The opposite of love isn't hate, it's indifference. As is evident from his interviews and public comments, Michael was anything but indifferent about his father. Stop thinking you know it all and acknowledge that members of this family knew Michael in ways that you and I could NEVER presume to know him. And that Michael knew all of them the same way.

I still cannot get over him wanting an allowance. He has to understand it is no longer Michael's money he is is his grandchildren's money. He is taking money meant for them. Pretty low if you ask me..
