'Pants on the Ground'

The Seeds of Conflict

2/1/2010 2:10 PM PST BY TMZ STAFF

Good news for Gen. Larry Platt -- "Pants on the Ground" has finally been recorded in a studio. The bad news -- the General has no idea it's been released ... and a conflict is brewing.

0201_general_audio_launch_ex-1
Larry's former manager Jason Mills -- who's releasing the song to radio stations -- tells us he doesn't need Larry's approval because Mills says it's "promotional" and not for profit ... at least for now.

idol auditionsMills says he now represents the producer, Carlos Thornton (aka Los Vegas) and Mills claims the producer has the right to release the tune, without the General's approval.

We're thinkin' .... the General might have issues with this.

The man who wrote this song will be able to sue and get money for this. This is not only a rotten version, but just plain stealing someone else's song.

It really amazes me, being an artist, that people just take and do what they want with what doesn't belong to them. The Copyright laws need to be brought up to date of the digital age. I am sure that Mr. Mills will have some kind of attorneys papers setting on his desk with in no time.

I guess it's all up to lawyers now. Thing is, if the General didn't have the foresight to copyright his own work, then there might be some difficulty for him in proving that it was his original work. That could be especially challenging if he stepped into a studio with these guys and went on American Idol with it. These guys, who have the recording, could claim ownership if General didn't copyright it as his own original work. At the same time, Idol's producers could want a piece of the pie because it was on their show first, and it wasn't copyrighted.

That makes it hard for independent artists who come up with something fun but don't really understand about protecting their work from opportunists like those producers and the fat cats on Idol. If you do original work, copyright it before doing anything that could push it into the mainstream. Chances are you won't need it, but better to be safe than sorry.
