Custody Move in 'Survivor' Murder Case

0409_survivorA family member of the former "Survivor" producer suspected of killing his wife in Mexico has made a legal move to gain temporary guardianship of the couple's two children.

In documents filed today in L.A. Superior Court and obtained by TMZ, Carla Burgos Van Bastelaar, claims she is the sister of the murdered woman, Monica Burgos Beresford-Redman.

In the documents, Carla states, "The mother of the children, Monica Burgos Beresford-Redman, was found murdered in Cancun, Mexico ... Their father, Bruce Beresford-Redman, has been arrested on suspicion of murdering her."

Carla also states, "I am the nearest blood relative of their mother, as I am her sister."

Beresford-Redman was released from custody early Friday morning because investigators didn't have enough evidence to hold him.

UPDATE 9:02 PM ET -- Looks like the sister was too late. A judge has granted temporary custody to the children's grandparents. It is believed it was Bruce Beresford-Redman's parents who were given custody.

This should be an easy case. He claims he was in the resort with the kids while she was out shopping. There will be security footage of comings and goings, the kids can be asked if Daddy left for a long time (how old are they?), etc.



I find it hard to believe that he would leave the kids alone in a Mexican resort so he could go out, FIND his wife (who could have been shopping ANYWHERE), murder her and then return as though nothing happened.



It can be verified with security footage. Most hotels have cameras in the hallways, at the entrance/exits, common areas, etc. Just find her leaving without him, NOT find him leaving and he's off the hook.

It is an insult and a total lack of respect towards the Burgos family to award temporary custody of Monica's children to the parents of a suspected murderer. After all, it is Monica's husband, Bruce, the only person suspected of her murder. According to the "Procurador"-District Attorney in Mexico the only reason this monster was released from custody is because authorities are still gathering enough evidence to put a case together and charge him with her murder. Many of us knew Monica from the early days of Zabumba. She was an innovator and an icon to the Brazilian community in Culver City. Not only did she bring "a taste of Brasil" to her restaurant with typical Brazilian cuisine but, she brought a piece of our culture too, with our samba, pagode and bossa nova. It was Monica that brought many different cultures together as one to Zabumba with the creativity that only an entrepreneur like herself could bring. Let us not forget also, that when she met her husband he didn't have a dime to his name. It was Monica that helped him out and guide him towards success. Monica didn't deserve this. She didn't died as a result of an accident......SHE WAS MURDERED. Shame on you people for attempting to portray her in a derogatory manner. Much to the contrary, Monica Burgos was an asset as a business owner and as a friend. She always had a smile, something nice to say to her customers. Looking back now, I believe TOM had Monica in mind when he wrote "Garota de Ipanema," cause Monica was very special. She'll be greatly missed. God be with you, Monica, rest in peace......fique com Deus!

They give the kids to the people who raised a murderer? They need to give the aunt the kids, I'm certain the mother would agree. They shouldn't grow up in the same enviroment that their father (the murderer)did, you know, considering how he turned out to be a murderer and all. Kudos to the grandparents for rushing in and grabbing some new victims.

I think it is really important for people to know that death is nothing new to The Moon Palace in Cancun. Check out the “victim link” at http://www.mexicovacationawareness.com You will see that on June 19, 2009 Julia Howard vanished from the Moon Palace and was found dead several days later. Also on May 12, 2007 Jeff Toews was found dead inside the resort, the victim of a brutal beating. I certainly don’t know all of the details surrounding the tragic death of Bruce’s wife Monica but I have a very bad feeling that he may be getting set up.Read these stories and spread the word. Mexico will do whatever they can to protect their precious tourist industry.

There has to be a serial killer at the Moon Palace, last year a 77 year old Scottish woman disappeared, they found her skeleton 3 miles from the resort 6 months later. The Mexican authorities accused her children of killing her, for the inheritance, then found out there was none and let them go. They want to blame family because murders in Cancun are way up and they need to cover it lest the loose their main industry tourism.

Not saying he did or didn't kill her, I'm not investigating this case so I have no idea. As for custody, are his parents under suspicion in her death? If not then hate to tell all the folk here that think they have no rights to th kids but usually according to law grand parents are the second in line after a biological parent when it comes to custody matters. Even if he did kill her you can't blame his parents for that. He's an adult man with many life experiences past his upbringing. Or does everyone get to hold their parents accountable for their actions till the day they die?

Murders in Cancun are way up? No they're not.



I live here, and I'm pretty sure I'd have noticed the sensation of impending doom by now.



Just because the American media likes to play everything up when it comes to Mexico, doesn't make Cancun an evil place.



Last month, a drunk spring breaker busted his head open at a hotel (drunk fight? accident?) and there's been pretty rough media coverage declaring Cancun as "horrific"... as if this didn't happen in every city in America every weekend.



I'm not sure what happened to the Scottish woman, but I remember there being no evidence of foul play involved, so let's not jump to conclusions.

Aaaaaaah! Peace has returned to Venice and Overland Boulevards. Zabumba has been closed since the tragic death of the owner. Dan, John Smith, and the rest of the regulars .... the seedy, the ho (s), and the illegal farmacists are moaning that their gathering-hole is dark for the time being. Dan stated, "Not only did she bring "a taste of Brasil" to her restaurant with typical Brazilian cuisine but, she brought a piece of our culture too, with our samba, pagode and bossa nova. It was Monica that brought many different cultures together as one to Zabumba with the creativity that only an entrepreneur like herself could bring." That is so ridiculous. Zabumba is a public nuisance in our neighborhood because of the unsavory customers it attracted. With the loud music gone, this neighborhood has been able to enjoy a good night's sleep this weekend. As for the "typical Brazilian cuisine" part - the food was nothing to boast about. Just down the street at Venice and Motor, there is a Cuban-style restaurant that attracts hundreds of hispanics weekly for their similar spicy food.



Personally-speaking, I prefer the Indian cuisine at Barwachi across the street because their owner/chef really knows how to do cuisine right. If Zabumba closes it's doors permanently, it certainly won't be missed.



In fact, some of the previous posts read like they have been created by the Burgos team to villify the Beresford-Redman grandparents who were successful in their petition for custody of the children. Read (24. They give the kids to the people who raised a murderer? They need to give the aunt the kids, I'm certain the mother would agree. They shouldn't grow up in the same enviroment that their father (the murderer)did, you know, considering how he turned out to be a murderer and all. You people need to face the reality that this couple had a long term stormy marriage. Both were having affairs with others. There was a lethal combination of nasty temper and ego involved. I am not a friend of Bruce's. I was acquainted with Monica but not a friend of hers. While I sympathize over the tragedy of this woman being murdered, in fairness to the man - it appears that his buttons were pushed to the maximum. If he finally flipped out and committed a heiness act while in a state of deep emotion or temporary insanity, it is just plain wrong for you people to go defaming the grandparents who have custody of the children that they somehow deliberately set into motion a scheme to raise their son Bruce to be a murderer. The children's lives will never be the same again. Monica has paid the ultimate price for what she did or did not do. Bruce is not free to walk away from this incident without the memories of what led up to the death that ended his marriage with his spouse. And, by the way, you are just plain malicious to keep repeating how Bruce didn't have a dime to his name until he hooked up with the bar owner of Zabumba.



Let the authorities do their job. By clue or crook, they will sift through the evidence and let us know the outcome of their investigation. For the time being, I am just grateful for the quiet I am enjoying. That awful loud music has been silenced. The too-short-skirted, tattooed ho (s) with sharpie eyebrows aren't parading on down to Zabumba the past three nights!
