Custody Move in 'Survivor' Murder Case

4/9/2010 9:08 PM PDT BY TMZ STAFF

0409_survivorA family member of the former "Survivor" producer suspected of killing his wife in Mexico has made a legal move to gain temporary guardianship of the couple's two children.

In documents filed today in L.A. Superior Court and obtained by TMZ, Carla Burgos Van Bastelaar, claims she is the sister of the murdered woman, Monica Burgos Beresford-Redman.

In the documents, Carla states, "The mother of the children, Monica Burgos Beresford-Redman, was found murdered in Cancun, Mexico ... Their father, Bruce Beresford-Redman, has been arrested on suspicion of murdering her."

Carla also states, "I am the nearest blood relative of their mother, as I am her sister."

Beresford-Redman was released from custody early Friday morning because investigators didn't have enough evidence to hold him.

UPDATE 9:02 PM ET -- Looks like the sister was too late. A judge has granted temporary custody to the children's grandparents. It is believed it was Bruce Beresford-Redman's parents who were given custody.

/22. It is an insult and a total lack of respect towards the Burgos family to award temporary custody of Monica's children to the parents of a suspected murderer. After all, it is Monica's husband, Bruce, the only person suspected of her murder. According to the "Procurador"-District Attorney in Mexico the only reason this monster was released from custody is because authorities are still gathering enough evidence to put a case together and charge him with her murder. Many of us knew Monica from the early days of Zabumba. She was an innovator and an icon to the Brazilian community in Culver City. Not only did she bring "a taste of Brasil" to her restaurant with typical Brazilian cuisine but, she brought a piece of our culture too, with our samba, pagode and bossa nova. It was Monica that brought many different cultures together as one to Zabumba with the creativity that only an entrepreneur like herself could bring. Let us not forget also, that when she met her husband he didn't have a dime to his name. It was Monica that helped him out and guide him towards success. Monica didn't deserve this. She didn't died as a result of an accident......SHE WAS MURDERED. Shame on you people for attempting to portray her in a derogatory manner. Much to the contrary, Monica Burgos was an asset as a business owner and as a friend. She always had a smile, something nice to say to her customers. Looking back now, I believe TOM had Monica in mind when he wrote "Garota de Ipanema," cause Monica was very special. She'll be greatly missed. God be with you, Monica, rest in peace......fique com Deus!

Aaaaaaah! Peace has returned to Venice and Overland Boulevards. Zabumba has been closed since the tragic death of the owner. Dan, John Smith, and the rest of the regulars .... the seedy, the ho (s), and the illegal farmacists are moaning that their gathering-hole is dark for the time being. Dan stated, "Not only did she bring "a taste of Brasil" to her restaurant with typical Brazilian cuisine but, she brought a piece of our culture too, with our samba, pagode and bossa nova. Zabumba is a public nuisance in our neighborhood because of the unsavory customers it attracted. With the loud music gone, this neighborhood has been able to enjoy a good night's sleep this weekend. As for the "typical Brazilian cuisine" part - the food was nothing to boast about. Just down the street at Venice and Motor, there is a Cuban-style restaurant that attracts hundreds of hispanics weekly for their similar spicy food.

Personally-speaking, I prefer the Indian cuisine at Barwachi across the street because their owner/chef really knows how to do cuisine right. If Zabumba closes it's doors permanently, it certainly won't be missed.

In fact, some of the previous posts read like they have been created by the Burgos team to villify the Beresford-Redman grandparents who were successful in their petition for custody of the children. Read (24. They give the kids to the people who raised a murderer? They need to give the aunt the kids, I'm certain the mother would agree. They shouldn't grow up in the same enviroment that their father (the murderer)did, you know, considering how he turned out to be a murderer and all. Kudos to the grandparents for rushing in and grabbing some new victims.

You people need to face the reality that this couple had a long term stormy marriage. Both were having affairs with others. There was a lethal combination of nasty temper and ego involved. I am not a friend of Bruce's. I was acquainted with Monica but not a friend of hers. While I sympathize over the tragedy of this woman being murdered, in fairness to the man - it appears that his buttons were pushed to the maximum. If he finally flipped out and committed a heiness act while in a state of deep emotion or temporary insanity, it is just plain wrong for you people to go defaming the grandparents who have custody of the children that they somehow deliberately set into motion a scheme to raise their son Bruce to be a murderer. The children's lives will never be the same again. Monica has paid the ultimate price for what she did or did not do. Bruce is not free to walk away from this incident without the memories of what led up to the death that ended his marriage with his spouse. And, by the way, you are just plain malicious to keep repeating how Bruce didn't have a dime to his name until he hooked up with the bar owner of Zabumba.

Let the authorities do their job. By clue or crook, they will sift through the evidence and let us know the outcome of their investigation. For the time being, I am just grateful for the quiet I am enjoying. That awful loud music has been silenced. The too-short-skirted, tattooed ho (s) with sharpie eyebrows aren't parading on down to Zabumba the past three nights!
The illegal farmacists wearing their pants half-way down their poo-crack are no where in sight.

Really, you think Cancun, who is a haven for the drug trade and is overrun...or rather run by organized crime is safe...you're kidding yourself, there was an Israeli woman at the Moon Palace in 2007, a man after her, who knows how many others because it's a BIG cover up, 2 million tourists go every year, can't loose that and Americans help perpetrate the fairy tale because they don't want to loose the value in their timeshare or real estate

read this:

and this:

and this:

there are hundreds more (I can only add 3)in the Mexican media that they have kept from us, and yes I go there but it has changed and I have sold my time share and will go no more, stop lying about Cancun's safety, this is a thing of the past! It is at the cross roads of drug and human trade. There is a different sinister feeling there now. People are less friendly and much more secretive.

I am truly disturbed by some of the messages displayed here. I am not sure to what extend the crime committed against this woman can possibly be justified on basis of her business, or country of origin. I am further disturbed by the way in which our media perceives Brazilian women. When the " Goldman" was fighting the court system of Brazil for his son, our media here in the States were al over Brazil and they trashed the diseased boy's mother like nothing that i never heard before. Bruna's culture, personal needs and reasons to leave the country with her son was undermined. Now , here we have a case of an American who kills his wife Brazilian wife in Mexico, in the meantime pursues the court system in the United States to give custody of his children to his parents; go back to Mexico in an attempt to further manipulate the system there, no one is talking about it. If Monica had left the US in search of safety for herself and children, she would be trashed as hell. The media would be referring to her as a kidnapper, Brazilian whore, among other things. But when we have an american women who is being abused overseas in similar situation , seeking for refugee back to the United States, we call her a HERO! What's up with that?

If you don't choose where you are born, anyone should have the right to choose where to go and stay, as long as the respect local laws and culture and have a legal work. Remember USA is a country built by foreigners who "possessed" AMERICA with violence.
Hispanics were here before the saxons and indians were the landowners victim of genocide... Pepople is all the same race no matter the shade of skin. The gangbangers are a product of the society. Please, Mr. Westside, try to go to eastside sometimes. There is good and bad people everywhere... sometimes inside our own families... Regarding the tattooed hooker type chicks: It is California, the show-off state.

I cannot believe the comments I am seeing here. Especially hateful and judgemental WESTSIDE!! Clearly a fan of the Murderer. The comments you wrote here are sick and disgusting, and I hope you dont think you are any better than anyone who Goes to Zabumba, because after I read your comments, YOU sounded like the lowest form of pond s*** I have ever come across. RIP Monica. Justice will be done. To Monica's sister, dont give up on those babies, his parents are too old to raise them.

I agree with comment no. 15 that grandparents are the ones who may take care of any children when both parents are unable to do that, in NORMAL cases. But in this case, when the father are the main suspect to kill the children's mother, I think it's a really absurd!! So, the judge did not the best decision and the children probably will suffer latter with it. I am a Professor at a Federal University here in Brazil and I knew Mônica at school; I saw her for the last time when we were 15 years old and I say she did not deserved that. I hope justice for this case!
