And it wasn't so, that the police couldn't do anything against illegals WITHOUT THIS BILL!! Beforehand they were still illegals under the law, and so police could also check ID's, but they needed probable causes and not just someone's skin color!!!

I'm done with TMZ. Harvey, you are turning TMZ into a rightwing extravaganza. I am so disappointed in your arguments and views over the past several days with regards to afirmative action and now the arizona law. it's like you refuse to accept that there are inequities in this world. YES, the police will use the fact that you have dark skin as probable cause to pull you happens. all. the. time. and, the number of racist commentors has sky-rocketed in recent months...when you want to come home after work and just have a "mindless gossip-break", but are greeted with conservative propoganda and racist comments it's just no longer fun.

Loved the debate this afternoon regarding the Arizona law. But Harvey I think you are wrong. Your example of someone weaving down the sidewalk doesn't work when talking about someone standing on the sidewalk. Weaving on the sidewalk could suggest someone was drunk. Standing on the sidewalk would suggest what exactly? You can't tell that someone is an illegal alien by the way they stand. Arizona law enforcement is going to have to ask everyone they see for their ID or no one.

As someone from Canada, I think the person from Canada who didn't see anything racist in the term "coloured people" is out to lunch.

And lastly, keep Jason, smart men are so attractive.

Harvey, you can be such a pompous blow-hard of a windbag. Whether you know it or not, you are a bit of a 'conversation bully', but I'm sure you think you're entitled because "you're a lawyer". It is actually painful sometimes to sit and watch you constantly talk over and rudely interrupt Jason (and everyone for that matter) with your arrogance and "I'm right about everything" attitude. It is even more painful watching them STRUGGLE to get a word in edgewise and be able to form a complete sentence or finish a thought without you pouncing on them and their knowledge.

Why do you even HAVE Jason (and any others with a legal background) there if you already know everything?

Directly from the language of the law:

" For any lawful contact made by a law enforcement official or a law enforcement agency of this state or a law enforcement official or a law enforcement agency of a county, city, town or other political subdivision of this state where reasonable suspicion exists that the person is an alien who is unlawfully present in the United States, a reasonable attempt shall be made, when practicable, to determine the immigration status of the person, except if the determination may hinder or obstruct an investigation. Any person who is arrested shall have the person’s immigration status determined before the person is released. The person’s immigration status shall be verified with the federal government pursuant to 8 United States code section 1373(c). A law enforcement official or agency of this state or a county, city, town or other political subdivision of this state may not solely consider race, color or national origin in implementing the requirements of this subsection except to the extent permitted by the United States or Arizona Constitution."

Here are some problems:

-Lawful contact: This means simply walking down the street. Hell, it can mean knocking on your door. This isn't too broad?

-Reasonable suspicion: I'll grant that my read-through of the law wasn't letter perfect, but I didn't see one definition of this phrase anywhere.

-Person's immigration status determined before the person is released: So if the Fed's computers go down, or it takes you three days to contact your friend so that he can bring by your wallet that you forgot on the dresser, you stay in jail.

-Solely consider race, color, or national origin: However, if you're of a darker skin hue with a HIspanic accent, the two in conjunction is now enough.
