Would Involve Jail Time

Charlie Sheen is worried about doing 30 days in jail for his Aspen criminal case ... and with good reason, because we've learned there are active plea bargain negotiations underway that would land Sheen in the pokey.

TMZ first reported ... the Aspen D.A. was originally willing to allow Sheen to plead guilty to a felony with no jail time.  Sources say under the D.A.'s old proposal, Charlie would be placed on probation for 2 years and at the end of the period his conviction would be expunged -- erased.

But sources say Sheen's people had a practical problem with the plea proposal -- As one source said, "There are a lot of ways to violate probation, and we don't want Charlie doing something that in the next two years could land him in prison for a probation violation."  Translation -- Charlie would probably do something to cross the legal line in the next 2 years. 

Sources also say, Charlie was also worried someone would try to extort him -- i.e., some woman would demand money, or else she'd go to the D.A. with a bogus story.  As one source says, "Charlie has a giant bull's eye on him."

So our sources say there's a new proposal on the table -- Charlie would plead either guilty or no contest to a misdemeanor and get jail time.  We're told right now Charlie is willing to accept 10 days in jail but the D.A. wants at least 30 days.

The reason Charlie's people want jail time -- once he serves his sentence he would either not be placed on probation or he'd get probation for a very short period of time -- so if he screws up later, the Aspen case won't come back to bite him.

We're told there are active negotiations underway between Charlie's lawyers and the D.A., but so far no deal has been reached.

Charlie has already been "rooked" by a woman. His wife!! She should be the one in Jail.She was so drunk she started the whole affair. Cut Charlie some slack.......he was trying to do the right thing till his wife yelled abuse!! What a mess she has caused.

This guy is a OJ just waiting to go off. He never has to pay for his actions. Network TV pays him $825,000 an episode. Why should he change his behavior? Mark my words, he's going to really hurt someone. There will be another crack addict that he can control completely, and the world goes on.

Who gives a f_ ck whether Sheen goes to jail or not, enough already of us regular people who have to get up every single freakin' morning, to go to a job that pays us nothing close to what any of these spoiled asses called celebrities. Sheen and Lohan, just to name a couple are always in the news and are oblivious to the great life they have been blessed with. I love TMZ, but just stop showcasing these two losers (Sheen & Lohan), for starters Paris Hilton is another that comes to mind, loser is her middle name. The day we stop caring about what some of these idiot celebrities do or say, that's when the world will get back to being a little more sane.

He has done nothing to earn my respect. He is obviously guilty of some part of this fiasco or he would just fight it in court, he has great lawyers after all. The mere fact that he is willing to settle but won't take a plea that mandates probation is very suspect. He knows that he has a problem and beleives he will probably do something to violate his probation. Is this the profile of a good citizen that deserves your trust? Sadly He doesn't even trust HIMSELF!!

As a former state prosecutor (not in Colorado or California and not tied to this case at all) and now a defense attorney - this is a common concern for defendants who have competent counsel and who aren't so scared that you are fairly certain this was a sobering lesson. For clients like Mr. Sheen - who a) have been down the rehab stint and the counseling and b) have a lot of money which keeps them out of jail when originally arrested - I would trying to convince the prosecutor to give me a misdemeanor. A felony is a whole different problem. With a felony, he could never possess or own a firearm - even for hunting. Granted, he has bodyguards for his personal safety but it can be a problem for recreation and maybe even film work.



This is a sign he actually has competent counsel. He knows he would have a huge hill to climb if he had a trial. If the prosecutor won't come down off of 30 days and the reports don't look good for trial (in some cases the State can make the case even if Brooke is a no - show - they have to show that she made statements against Mr. Sheen in the heat of the moment coupled with injuries, etc.). I do want to clarify that the ability to make the case if Brooke doesn't testify (she can either show and plead the 5th or be a no show because she wasn't served in Colorado) is murky. Mr. Sheen has a right to confront his accusers under the law and he has to be able to cross-examine Brooke. If her statments that night come in but she isn't available to cross, then the whole case may be thrown out. The state prosecutors know that - but they have a message to send to their non-celebrity defendants facing similar charges.



I suggest that Charlie do 10 days with a 2 years probation with the sole conditions that he a) attend counseling as ordered by the Court and b) perform for free in a PSA for battered spouses urging to seek treatment, etc. If the Court does not order the standard conditions like "obey all laws" you take the power out of the extortionist hands. Mr. Sheen either does the counseling or doesn't. I like the idea of a PSA to use his celebrity status as a positive here. He can reassure the public that Brooke was right in calling the police because it resulted in his family getting the help they needed before things hit so high of a crisis point that no one was safe.

I think that both Him & Brooke should prove RESPONSIBILITY for both their actions on that day in Dec., By BOTH of them doing independant commercial spots on each of their addictions,(as in Anne's Remark above) to benefit those who have 'similar' problems to theirs, hence HELPING OTHERS< and facing their own reality, after BOTH going to separate REHABS>>>>IF ONLY FOR>>>the Benefit of their Children!!

Nobody really knows Charlie on a personal basis enough to be making comments about his relationship with Brooke. Some women want to call him a loser and a womenizer because he plays that role on TV. How can you comment on someone you dont even personally know?

I THINK THAT HE DOES NEED TO ANSWER TO HIS PROBLEM THAT HES FACES . HE ONLY HUMAN AND MAKES MISTAKES LIKE THE REST OF US . I KNOW THAT HE WANTS MORE MONEY FOR HIS WORK THAT SHOULD BE BETWEEN HIM AND THE COMPANY THAT HE WORK FOR . IF HE WASN'T RICH THE NEWS WOULDN'T HAVE ANYTHING TO DO WITH HIM AT ALL . I KNOW HE HAS A FAMILY SHOW BUT HE'S NO DIFFERENT THAN ANY OTHER MAN OR WOMAN IN THE WORLD . I THINK ALL THE NEWS MATTER WITH HIM IS REALLY BLOWED OUT OF THE WATER ON THE MATTER HE ASKED NOT TO BE BOTHERED WITH THE THINGS THAT DONT EVEN CONCERNED WITH HIS PRIVATE LIFE AS LONG AS HE DON'T DO IT ON SCREEN ?
