Charlie Sheen

May Serve Jail Time

in Plea Deal

5/28/2010 2:30 PM PDT BY TMZ STAFF

TMZ has learned Charlie Sheen's lawyers and prosecutors have reached an agreement on four different options for resolving his domestic violence case ... and one involves serious jail time -- and now it's all up to Charlie to choose one.

Multiple sources connected with the case tell us ... these are the options the D.A. in Aspen and Charlie's lawyers have hammered out.

OPTION 1:  Charlie will plead guilty to a misdemeanor and serve 30 days in Aspen jail.  Charlie could enter the plea as early as June 7 in Aspen and would then immediately begin serving his time.  With good behavior, that time could be whittled down to 17 days.  After he serves his sentence, the case would be over.  Charlie would not be placed on probation.

OPTION 2:  Charlie would plead guilty to a misdemeanor and receive no jail time, but would be placed on 2 years probation.  We're told Charlie's people worry that the actor might slip up and the judge could then throw the book at him and Charlie would end up in jail for a much longer period than 30 days.

OPTION 3:  Charlie would receive a "deferred prosecution" -- meaning the case would not go forward but Charlie would agree to various conditions -- including not breaking the law.  After a certain period of time -- if Charlie complies with the conditions -- the matter would be expunged from his record.

OPTION 4:  Go to trial and fight it.  Charlie, we're told, is upset at the Tito Ortiz case ... where the UFC star did not even get prosecuted for allegedly doing a lot worse than Charlie allegedly did.

We're told Charlie has not decided which option he will take.  It's all in his hands.

I can't help but echo what others have said thus far, take option #1, be done with it after a few weeks in jail. It's truly a no brainer.

I used to like CS, but his violence toward women has really turned me off. What a shame someone in his position can't take a probation plea deal because he doesn't think he can stay out of trouble. He's lucky he's in Aspen. Jails are like Country Clubs there...and the food is pretty good too. Too bad he couldn't be put in a jail somewhere more North Korea!

Agreed - I thought Tito's ass was cooked. Jenna's daily media inviews, playing the victim card, claiming Tito hurt her on video tape, Jenna's fakey arm sling & drug test would have been a DA's Slam Dunk in Colorado.

Charlie - Take option #1 & get it over with. You DON'T want the Pitkin County DA's office controlling your life by holding their "conditions" over you head - unless you can live your life squeeky clean - Pitkin County DA's office does have access to computers/magazines to monitor your activities. Celebs need to leave their bad behavior & their friends w/bad behavior at home when they fly into Aspen.

P.S. it didn't help pissing off Brooke by screwing around - she was you "credibility" ticket on this one.

P.S.S. Jenna looses Tito - that her sole meal ticket. Brooke looses you & gains a $3.5M divorce settlement before child support.

L is for LOSER!

With his track record, #1 is the option. I don't think he'll get busted for beating his wife again, but you know he'll break one law or another. 17 days with the treatment all celebrities get is a piece of cake.

His dad must be proud of the little guy.

He has a long history, that is why they are making him be a little accountable and not let him buy himself out of trouble.
He has already gotten away with so much it's crazy.

This country truly sucks! He gets choices because he is a rich Hollywood star. ANYONE else would be in jail. Something has to change man... people are fed up with this double standard and they're going to start showing their feelings.

This whole thing is BS! They should arrest the drunk who calls herself a mother. How could anyone with babies be legally drunk on Christmas morning? She should have been arrested. What kind of law enforcement do they have in Colorado? They arrest someone on the word of another person who is legally drunk and then leave the babies with the drunk while they take the sober one to jail. DA stands for dumb a$$ in Colorado.

#3 sounds like bullsh_t. If they want him to do 2 years probation with a guilty plea for #2 I can't imagine the "conditions" for #3 are any better then #2. If he eventually screws up on the "conditions" they'll still prosecute him and he'll end up taking a plea and going to jail or starting probation anyway. It's a trap! Waste of time...

Charlie Just take #1 and do the time. When you get out and the paps start shouting stupid questions at you about how was it just quip "it was nothin', they call that punishment in Aspen? Please, i've been in worse motels".

Oh, one more thing. Divorce that alcoholic gold digging wife of yours and stop getting married, dumbass.

It's Aspen. How bad can the jail be?

There are fewer than 20 inmates at the moment.
