Lindsay Lohan: I'm NOT Going to Jail!

Sources tell TMZ ... Lindsay Lohan vows to appeal Judge Marsha Revel's 90-day jail sentence.

One source who was with Lindsay last night says LiLo proclaimed, "I'm not going to jail!" Lindsay was talking with people in her apartment about appealing the case.

As for how Lindsay could appeal ... the only real basis is arguing that Judge Revel abused her discretion in nailing LiLo with a 90-day sentence.  The chances of winning such an appeal are extremely remote under the best of circumstances, and given Lindsay's performance on probation ... snowballs and hell come to mind.

Lindsay's vow to appeal could explain why Shawn Chapman Holley just threw in the towel and resigned.

We're told Lohan's new attorney, Tiffany Feder-Cohen, has already been in touch with the Sheriff's Department.

Good move on Ms. Chapman-Holly's resigning. Lilo is in major denial. I question Dina's motives- where was she during court???? Making deals for money??????? I think Lilo got what she deserves but I pray she will come through this a better person and not the train wreck she is and has been for quite some time. Lilo, go to jail already and get it over with. you won't be there 90 days. If you turned yourself in now, you could be out by July 20th. I also question the strong meds she got from an oral surgeon. Geezzz, so many enablers! I have been one of those rallying for Lilo but now, I could care less what happens to her. She's an adult and needs to start taking responsibility.

If she got even one full night in jail, she would not have gotten the 2nd DUI. One night in jail for that cures all. One night in jail sucks more than anything else I have ever done (I refused the breath and blood test). Just a few days in the clink will wake her up. I can't stand her, and glad she got the 90 days.

Lindsay is just doing what she needs to do, stand up for herself and her rights. Everyone else, the media, the judge, and joe public are crucifying her and making her a scapegoat for their own frustrations in life.

Lindsay is not a criminal, she may be an addict...but addicts don't need bars, they need treatment.

Kudos to Judge Marsha Revel for finally drawing the line in the sand which is what Lindsey's mother should have done a long time ago. Unfortunately this brat is a drain on the Los Angeles county taxpayers.

As a taxpayer, this is what I suggest: Give Lindsey Lohan an old-fashioned option. Either stop your immature antics and do the jail time, or, join the military so you will finally grow up. Take your choice: Army, Navy, Marines, or Coast Guard.

I wonder if her attorney left cause she knew her client was out of touch with reality? She could well anger the judge enough that the judge would order more jail time or order to the sheriff to hold her the full 90 days.

Judge was perhaps a bit too lenient; she should have just tossed her into jail that day.
