Wesley Snipes'

Appeal Denied

Must Serve 3 Years

7/16/2010 5:40 PM PDT BY TMZ STAFF

Wesley Snipes just got his ass kicked by a federal appeals court -- which denied the actor's claim that his 3 year prison sentence for tax evasion was "unreasonable."

Translation -- dude will definitely serve hard time.

Back in 2008, Snipes was found guilty of not filing tax returns from 1999 to 2001 ... and consequently failing to pay the government nearly $12,000,000.

Snipes was sentenced to 36 months in prison -- but appealed the case claiming, among other things,  that his sentence was "unreasonable."

But today, the appeals court backed the original ruling -- shooting down Snipes' claims that his punishment was way too severe.

No word on when Snipes will officially check in to the big house.

And upon hearing his appeal failed, Lindsay Lohan reaches for a 5 pound bag of cocaine and a case of vodka.

People do not do "hard time" for tax evasion--if you rocket scientists were as connected as you claim to be, you would know this. He will go to minimum security, perhaps the drug program at Lexington, where he will have a comfortable room with a door instead of bars. He will have free run of the prison, perhaps golf if he goes to Eglin AFB (where there are no walls, only a painted line on the ground that cannot be crossed without penalty), and a generally very easy time of things. It's about as "hard time" as being in rehab. Get a clue, morons.

Lindsay Lohan, Welsey Snipes and Mel Gibson booked a flight to France following the advice of well-known fugitive/attorney Roman Polanski.

UPDATE: Apparently, Mel Gibson asked for a refund.

He seems to have a kind of skin problem. May it explains why they hit acts of his behalf which should be considered a duty and community service.

I think spousal abuse (Charlie Sheen) is a worse crime. And yet, compare the (pending) sentences. . . .

For those being hard on him remember Ken star was doing his taxes. The same Ken Starr who also ran a 50 million dollar ponzi. Wesley is most likely a victim and had no idea his taxes were not filled.

It's GREAT to see that no special conditions handed out... "Do the Crime - Pay the time".. just like the rest of us mortals. Seriously though, no one, including me likes to see our friends getting jailed. :( But - That's Life.. and if you do it right .... LIFE IS BEAUTIFUL
