Lindsay Lohan

Thinks Jail

Isn't a Done Deal

7/19/2010 9:00 AM PDT BY TMZ STAFF

Robert Shapiro can work wonders -- he was part of the team that got O.J. Simpson off -- but sources in the crazy world of Lindsay Lohan say he has not convinced her that she must surrender to a jail sentence.

0905_Lindsay_Lohan_TMZ_ex_07
People who are interacting with Lindsay tell TMZ she has been in obsessive denial over her surrender Tuesday, when she must begin serving a 90-day jail sentence -- which will be whittled down to 22 days behind bars.

Lindsay is convinced there is still a way she can avoid jail, even though Shapiro made it clear he would only rep her if she went to the pokey.

Here's the irony -- Lindsay expects Shapiro to pull a Shawn Chapman Holley ... code for getting the judge to overlook her past screwups and keep her a free woman.  Holley eventually quit when Judge Marsha Revel made it clear ... there were no more cards to play.

And, we're told, the reason it took so long to find a new lawyer is because Lindsay only wanted someone who could keep her out of jail but no credible lawyer would make that promise.

And here's the thing. From what we're hearing, there is no way in hell Judge Revel is going to back down.

Lindsey can indeed live a happy, healthy, positive future if she admits to her disease and goes from there. It is all up to her. It may be a family disease but that doesn't mean she can't live a sober life. She will ALWAYS have others out in the world, in a hundred ways, to remind her of her former life. This is the spirituality that she will have to find. She will have to find the strength to avoid it. If it were you or I, our every move wouldn't be in front of millions. That makes it that much harder for her. I think she will prevail and get through this.

The only reason this is so entertaining is because she is in denial as is her creepy family, thinking that she is above, not only GETTING 2 DUI's, but not comprehending exactly what PROBATION is. If you fail it, you get sentenced for the original charges. DUH!!

And if she's just going to jail, why does she need a lawyer??????
People are so stupid about what lawyers actually do, which is basically nothing but take your money.

I know she violated her probation by not attending every week that is in black and white but she did finish the program. I think the 3 30 day sentences were really harsh just for failing to attend a program every 7 days if she drove again or failed a drug test then there would have been no argument.

I am glad the judge is doing the decent thing and not allowing her to be filmed or photographed after she is told that she will be remanded.

I think she was borderline 'in compliance' with the alcohol education classes, but put the judge in a position of having to judge harshly because of the lost passport saga back in May. The 90 days is a compound figure from separate convictions. Not a single sentence. The lost passport saga was thumbing her nose at court. The justice system doesn't like that. Unlike ordinary people she had backers to pay her bail, when the scram was set off, when she didn't turn up on time etc. etc.

Had an ordinary person done that, they would not be able to afford bail. They would not have a lawyer like Chapman Holley. That is a massive double standard and people hate double standards.

I don't think prison is the place for ANY non-violent offenders. Prison recidivism rates are mostly awful. The drugs of choice in prisons are strong opiates because they clear they system faster than less addictive drugs (random drug testing). Many non-violent prisoners mix with violent prisoners and have to learn to survive, turning passive people into violent people. Prison staff are paid awful wages for the amount of stress they have to undergo. Prison staff should be paid more. They won't be because people won't pay for prisons. It's a brutal, desperately underfunded system. So, I really don't agree with prison for non-violent offenders.

What she did wasn't violent, it was stupid, and she was lucky nobody was hurt.

However, I don't see the judge was given a choice but to send her to prison because of the repeated violations, public statements professing unfair treatment, and the completely idiotic incident with the passport.

Nicole etc. don't seem to get this and seem to be painting Lindsay Lohan as some kind of Nelson Mandela at Robben Island.

She got the sentence down from 90 days to 22 days. Just do the time. It's only 3 weeks. Come on it can't be that bad. I'm sure she wont be in with the general population anyway. I do feel bad for her in the fact obviously she is a very messed up person. However if that were me there would be no way I would get special treatment cause I'm not a celebrity. So it's hard for me to feel too bad for her.

Nicole, are you stoned or just STUPID? She DOES NOT HAVE THE RIGHT TO CHANGE A JUDGES ORDERS. Get it yet? She was not in compliance with her sentence. DO YOU OR ANY OF LL's FANS UNDERSTAND "ONCE PER WEEK" YET? I think, maybe, you have ADD just like LL. Or you have no understanding of what it means to comprehend anything. Who, exactly, do you think she is to be able offer such a stupid defense? Does anyone, who knows you, ever buy into that type of reasoning? Did you pull that crap on your parents while growing up? If so, did they buy it? My guess is yes, and that's why you still use that type of reasoning. If this is what is acceptable with the younger generation these days, we as a country, have no hope at all.

LINDSEY PRAYER IS MUCH, MUCH MORE POWERFUL THAN ANY AMOUNT OF JUDGES OR JUDGERS. AS LONG AS YOU REMEMBER THAT YOU WILL BE FINE. I PROMISE!

24 hours from now Lindsey will be eating bologna sandwiches for lunch and humble pie for dessert. I hope it does her well. And please... if it's only 3 weeks and not 3 months... in the timeline of your life... give me a break!

@116: I THINK the jail will inventory the meds she is on, and adjust as necessary. For instance, she PROBABLY won't be allowed to take Dilaudid (which she NEVER should've been on for "oral surgery" in the first place). As for the Adderall and other stuff: I'd really like to see a REPUTABLE doctor review those meds, I'm not buying the ADHD excuse... Especially with as much as she drinks, the Adderall is doing no good... It's prob giving her a helluva buzz though LOL
Hopefully they can get her off some unnecessary meds. They are JUST as much a problem as alcohol...

jack,
I agree with almost everything in your post except one thing. She may be considered a "non violent" offender, but she has, not one bu TWO DUI convictions. Let's not forget that she stole a occupied vehicle in drunken/drug induced rampage and proceeded to chase a woman with intention of harming that woman. She just wasn't able to get to her because the woman drove to the police station. That, in my opinion, is a girl who has no respect for others as well as no respect for the law. How would you feel if, in one of her hazes, she drove her car over your child or rammed into your car and paralyzed you for life? She had no regard for the passengers of the car she stole either. Her stupid ass probably thought they would be happy to just be in a car with Lindsay Lohan even if she's a crazed drugged out lunatic on a rampage. Like I said before, I agree with most of your post, but anyone that thinks this girl is not a threat to society, might need to walk down memory lane before making those statements.
