Will Dodge Jail Bullet

Lindsay Lohan will not have to spend the next 30 days in jail ... sources connected with the case tell TMZ.

There was a buzz in the case that Judge Elden Fox would have Lindsay jailed tomorrow -- without giving her bail -- and make her sit behind bars for 30 days until the next hearing. The danger for Lindsay -- she would have to serve the full 30 days and would not be released early because of jail overcrowding.

But insiders tell TMZ ... if Judge Fox remands Lindsay into custody he must set bail, because the underlying offenses are all misdemeanors.

So here's the way it will go down ...  Our sources say tomorrow's hearing will be extremely short.  There won't be any arguments over the case.  Judge Fox will schedule the formal probation violation hearing, and almost certainly remand Lindsay into custody and then set bail. But you can bet a bail bondsman will be right there in the courtroom to take care of business on the spot.  So Lindsay will walk out a free woman tomorrow.

When the probation violation hearing is held next month, it's likely Judge Fox will sentence Lindsay to 30 days in jail based on the failed drug test for cocaine.  As we first reported, the Probation Department will not recommend jail time for the second failed drug test because of an ambiguity in the paperwork.

But this 30-day sentence would be subject to the realities of jail overcrowding, which means Lindsay would go to jail for booking and probably be released an hour or two later.

The upshot -- looks like Lindsay will dodge another bullet.

WOW, thats just amazing! Who gives a **** if the jail is "overcrowded"? I don't believe that for one second! That sounds like a nice cover up to make people think that they aren't trying to do her any favors you know? Well, all I know is if the bitch is driving a car under the influence and she crashes into my car and kills my family, better be known that I will murder her immediately after that.

If she's not going to jail he should send her back to rehab, a mandatory 90 days this time - no exceptions. She and Paris make me sick - both of them are going to overdose and everyone will wonder why. Someone is enabling them to the max and they aren't long for this world.

Its Los Angeles, our jails are filled with real criminals that rape, rob, beat people, murder... who cares about a violation of probation crime. Look Lindsey's long term justice will come in her looks, she already looks like a hasbeen. She looks like she is in her late 30's.

Getting no real consequences from all her actions will eventually catch up to her. Just not tomorrow. However, it's just a matter of time. Like any crime, if you do it enough...you will go down.

If it were any other non-famous person, we would have been thrown in jail already and even if we were ordered to do time, we would end up being in there for several days- it doesn't matter that the jail is overcrowded, the person is still supposed to serve a certain % of the sentence as a minimum

If she does not care enough about herself, her family and her career-then why should anyone else?

If the judge is more worried about "overcrowding" than her safety and the law, then just let her go, let her off all of the offenses and cut their losses. This is a waste of time and a mockery of the legal/justice system.

She is not exactly getting off with no punishment, she is going to lose a lot of money tomorrow! The judge will probably set bail at 200 thousand so she will have to come up with 20 thousand and she will not get much or any of it back.
I know the lawyers will not agree but basically she is going to be "fined" 20 thousand dollars for her dirty drug test, or more.
The judge could set the bail higher or even demand cash bail but she will be able to appeal this and only spend a few days in jail waiting for that hearing. Judges don't like putting themselves in a position to be over ruled so this is not likely.

If I was in that county jail on nonviolant charges or Drugs I would file the biggest Descrimination Lawsuit the State of California and the city has ever seen. This celebrity justice has got to stop. A Probation violation is not subjet or eligable for any type of Bond.
