Meg Whitman's Housekeeper: Undocumented

Meg Whitman's former housekeeper was an undocumented worker and claims working for the Republican candidate for Governor was a "nightmare."

Nicky Diaz Santillan, Whitman's housekeeper of 9 years, held a news conference with her lawyer, Gloria Allred, and claims Whitman had all the clues she was an undocumented worker but closed her eyes to it because she was cheap help ... $23 an hour.

Allred claims the housekeeper was "exploited, disrespected, humiliated and emotionally and financially abused" by Whitman.

Allred claims when the housekeeper was hired 9 years ago through an agency, Whitman never asked if she was in the U.S. legally.  And, during her employment, Santillan told Whitman she couldn't travel to Mexico.  And, Allred said, Whitman found out Santillan's Social Security number didn't match her name, but Whitman did nothing.  Allred said it's the classic case of "don't ask, don't tell."

0929_whitman_debate_videoThat all changed, Allred says, when Whitman launched her campaign for Governor, realizing having an illegal alien on board was a liability ... and fired her.

Santillan says Whitman treated her "like a piece of garbage" by letting her go.

Allred says Santillan is filing a claim with the Labor Commission for back wages and mileage.

Yesterday, Whitman said in the debate with Jerry Brown that employers should be held accountable for hiring undocumented workers.

I work for an employment agency similar to the one that Nicky used to get her job.

Instead of all you people guessing how this works let me explain!

The employment agency was paid $35.00 per hour for Nicky's employ with the Whitmans. She is required to turn in a time card that represents the time that she spent working in her capacity for them, and in turn she was paid $23.00 per hour for the job/work she performed.

We at the agency, are responsible for determining the legal status of our hires, and in this case, not Whitman, but the employment agency carries the responsibility of determining her/his eligibility.

In Nicky's case (as all of you liberals are quick to point out) the agency did take a portion of her earnings, as Meg Whitman was under contract to pay them directly. Therefore she was in theory working for the employment agency, and they are at fault for aiding and abetting asylum of an illegal immigrant.

We (at my agency) have often noticed that we get put under immense pressure to avoid what unions call "profiling" in ascertaining one's legal status, and generally, when provided with any sort of do***entation,are discouraged from questioning its validity.

Its kind of an understood when someone provides you their CA Driver's Lic and a SSN# that you don't go around playing "private investigator" to see if in fact they are legitimate. Even though it is our job to ensure that we provide a legitimate work force to our clientèle, we frequently get heat from leftist groups about complaints coming from do***ented workers that they feel we are too "hard on them" and are "profiling them". This tends to water down our attempts at verifying at great length, whether or not one is eligible.

In a nutshell, blaming Meg Whitman for this incident is basically as equivalent to this: If "I"(Nicky) were to create a fake $20 bill and pass it to a McDonalds clerk (Whitman), and he or she took it as payment... In this case "I" (Nicky) am the poor, abused, and crying, fraudster who forged and passed the $20 bill, and Allred is suing on my behalf that the McDonalds clerk (Whitman) had the audacity to take my bill in trust,and at face value of my intentions, without checking to see if it was real. How cruel could the McDonalds clerk be for accepting my bill without checking it! I am so hurt by this clerk believing me that I will sue them for not picking up on the clue that the bill was fake due to missing security features!

This case is cut and dry. If you have a problem with the employment (which is secondary to the bigger issue of crimes and identity theft being committed by Nicky) then go after the real culprit. The employment agency is next in the line of fire, not 3rd party Whitman!

In closing, I don't like Meg Whitman. I dislike her immensely. But I dislike the law being trampled on even more! Jerry Brown, Gloria Allred...there is a special spot reserved for you in the after life. (Hint: its not a nice place either)

Wittmen should be given a prize for keeping a dishonest person who had forged do***ents.

I just want to know the placement agency that hired Nicky, reviewed her do***ents and then placed her in employement. And, once I find out the name of the agency, I will never call them for domestic help. EVER! they can't do their job.
$23.00 is a reasonable wage for someone in that position in Calif. In fact it's more money then a step up to Educational Aide which is making $16.00/hour.

I am wondering why Meg isn't being invesigated by ICE? I know a few small businesses in the Northern Santa Clara County have been raided by ICE for the very same thing. All of them, like Whitman "ignored the letter" issued by Social Security informing them that the social security number didn't match the name. The only differences is the other business owners were prosecuted and lost their businesses. Why isn't Meg next? Didn't Meg's husband state he did "ignore the ltter"? Why isn't Meg and her husband next? Isn't that part of being an accessory to identity fraud? Forge that the worker was not legal. The bigger picture is the identify fraud that Meg and her husband helped carry out.

Read the press release. She only made $345 a week whether she worked 15 hours or 40 plus hours and she ran errands and became a nanny to her kids. So yes she was exploited.

What I see as interesting is that those on the left are making accusations against Meg Whitman based on their own grossly slanted speculations as to her character and motives, whereas those on the right use known facts as to what transpired. The left loves to think they know the "real" story based on their own biases and assumptions rather than actual facts. They want to assign evil motives whether there is any truth to them or not. They defend an illegal alien who was making very good wages by deceit rather than looking at the facts of how that woman got to this country by sneaking in illegally and buying a false identity (possibly using someone else's SS and ID...don't liberals care about identity theft?) and committing actual crimes while she cries about how she was supposedly "mistreated" because she got fired? Sheesh...give me a break! And why did she get fired? Because she finally came clean and admitted that she was an illegal and was shocked to find that instead of "helping" her become legal, Meg fired her! Oh how "unjust"...(note the sarcasm). What arrogance for this illegal to think that after breaking the law for 9 years and lying to the person who hired her and paid her well above normal maid's wages, Meg Whitman was supposed to reward this woman by helping her become legal?!!! I really hope this liar and criminal gets exactly what she deserves (but of course you can only guess what sort of promises have been made by our current Attorney General who is hoping to get elected as our Governor by "exposing" the supposed "hypocrisy" and "abuse" Meg committed against this poor downtrodden woman and he is using his mouthpiece Gloria Allred to accomplish this). Ms. Allred lives up to her name and reputation yet again and Jerry Brown shows that he has no regard for the law he is supposed to be enforcing. The fact that he isn't pressing charges against Ms. Santillan (if that's even her real name) shows he's not taking his role as the Attornery General of California very seriously...and we should "reward" him by hiring him to be our Governor? Yeah, that will make our great state of California even better...NOT!!!

Mo, just because something is in a press release doesn't make it true. What is the source of the press release? Is it from Gloria Allred? Then what is her source? If it is her client, Ms. Santillan, then we already know she is a confirmed liar and law breaker on several levels, so the veracity of those figures would be highly suspect, along with anything else coming out of her mouth.

Mo, you and all the other Meg Whitman haters forget how you forgave and embraced Barbara Boxer for the very same offense that you are leveling against Meg Whitman. It's pretty hypocritical to forgive one because if her political affiliation to the party you agree with and vilify another because of her belonging to one you disagree with.

Why does the left feel they have to demonize those on the right and especially those who are well to do or successful? The truth is that Meg Whitman was duped by the woman she hired who was checked out and given the stamp of approval as far as legal issues go by the agency that recommended her. Maybe it was a "don't ask, don't tell" situation, we can't know for certain, but having a suspicion versus relying on the truthfulness of two sources (her employee and the agency that provided her) does not a villain (of Meg Whitman) make.

Why do the illegal's have more rights than the US citizens

If I defrauded the IRS there would be HELL to pay, but Megs ex housekeeper is being MARKETED as poor little Mexican.
She is not being arrested or punished for her illegal acts
The woman admits she committed crimes and no one seems to care
Why wouldn't she want to live here as she doesn't have to by the rules.
