Meg Whitman's Housekeeper: Undocumented

9/29/2010 3:30 PM PDT BY TMZ STAFF

Meg Whitman's former housekeeper was an undocumented worker and claims working for the Republican candidate for Governor was a "nightmare."

Nicky Diaz Santillan, Whitman's housekeeper of 9 years, held a news conference with her lawyer, Gloria Allred, and claims Whitman had all the clues she was an undocumented worker but closed her eyes to it because she was cheap help ... $23 an hour.

Allred claims the housekeeper was "exploited, disrespected, humiliated and emotionally and financially abused" by Whitman.

Allred claims when the housekeeper was hired 9 years ago through an agency, Whitman never asked if she was in the U.S. legally.  And, during her employment, Santillan told Whitman she couldn't travel to Mexico.  And, Allred said, Whitman found out Santillan's Social Security number didn't match her name, but Whitman did nothing.  Allred said it's the classic case of "don't ask, don't tell."

0929_whitman_debate_videoThat all changed, Allred says, when Whitman launched her campaign for Governor, realizing having an illegal alien on board was a liability ... and fired her.

Santillan says Whitman treated her "like a piece of garbage" by letting her go.

Allred says Santillan is filing a claim with the Labor Commission for back wages and mileage.

Yesterday, Whitman said in the debate with Jerry Brown that employers should be held accountable for hiring undocumented workers.

"Allred claims when the housekeeper was hired 9 years ago through an agency, Whitman never asked if she was in the U.S. legally." Wouldn't one think that THE AGENCY would have done the background check to make sure she was here legally? That should not be on Whitman's shoulders.

Since when is $23.00 an hour cheap. How much would she make back in her own country. And why the hell does she not go back or get deported if she is illegal. I would be a house keeper for $23.00 an hour and so would a hell of alot of American.

Stupid People Hater

I didn't realize ~$48000 per year is what illegals are making these days. Not too shabby. My guess is she claimed about 10 exemptions on her taxes as well so she wasn't paying anything in each week.

If she was hired thru an agency, wouldn't the agency (not Whitman) be responsible for know whether or not she was illegal?

Yes, the agency has the responsibility to check the status of the employees. Also, agencies require that you walk with your do***ents on the initial interview with them so it can be verified before placing them on a job site.

So a law office isn't allow to ask a violator about immigration status, but an ordinary citizen is supposed to be responsible for it? Talking about hypocrite, it exists every where.

It is the agency who represented her that bears the responsibilty to check her do***ents. $23.00 an hour is an excellent wage and she was so mistreated she stayed for 9 years???? Getting fired is no reason to sue anyone. Thank Allred for pointing out an illegal alien and deport her back to Mexico where she belongs. She can be fired for any reason, California is an "at-will" State. Tell Ms. Santillan and Gloria to go pound sand.

So she was mistreated, but stayed employed there for 9 years? Must have been an awful job!

As someone who works for a staffing firm I can tell you that it is the temp agencies duty to confirm the immigration status of temp employees, not the company/person who hires the agency. This is in no way the fault of Meg Whitman. Also, $23hr is by far a more than fair wage. A market analysis on Janitorial/Housekeeping in that area shows fair and average wage to be between $9.00-14.00hr, WAYYYY below what this money grubber was making. Meg Whitman should be praised for FOLLOWING THE LAW by terminating an illegal resident. Hello does the word ILLEGAL mean nothing to people anymore?

How did housekeeper have a driver's license IF she had no right to be in U.S. legally? IF she has no driver's license, WHY would Meg demand her children be driven around by her? I don't get it. For sure though, Meg should have hired someone who was in U.S. legally. THAT is wrong.

Most illegal aliens from Latin American countries come here to work because US supported regimes made it too dangerous to live in their own countries in safety. Who profited from this? The Military Industrial Complex and Big Business. Most of the $23/hour the maid was paid was probably taken by the Agency and Meg in the form or making her do way more than what is normally expected from a domestic worker. I've never seen American born white women lining up for jobs as domestics. You want proof? When the last time you've seen an American born white woman working as a cleaning maid at any hotel? You see them all the time, Yeah right.

Wouldn't it have been racial profiling to ask if she was in the country illegally?

No it is not racial profiling to ask that question. It's a question that is asked on all job applications regardless of the job applied for.

Wow, I love this liberal rag & the progressive(communist) Allred who has the timing so great to manipulate the elections. Why didn't anyone report the entire story on Chuckie Rangle/democrat senator who is on the tax committee. How he scammed taxes everywhere and he just won by a landslide. Media didn't do anything to report the scam because he is a liberal dem and the media is changing the course of our history by lack of of info. Most media are liberal socialist with their agenda that has made California a socialist state with 13% unemployment. Go ahead and vote for Brown and make this state a bigger ghetto than it is. Blame only yourselves for voting liberal and for not having a job or sharing your wealth to make the state of California looking more like Tijuana.

I don't believe a word of it. Couldn't have been too bad of work! $23.00 an hour for 9 years? It wasn't Ms. Whitman's responsibility to verify Santillan's worker status, it was the responsibility of the agency she worked for. Smells like political tactics to me!

I cant believe how people are so ignorant, housekeepers work only about two or three hours in each house, so making $23.00 per hour means you have your house clean for less than $70 dollars, is unfair.
When most housekeepers charge about $100.00 or $125 for a big house.
Cmon racist people stop making opinions with no fundament.
