Sheriff Gets Legal Eagles In Oksana Extortion Probe

10/7/2010 6:15 PM PDT BY TMZ STAFF

The L.A. County Sheriff's Department is consulting law professors and attorneys to determine if Oksana Grigorieva was trying to extort Mel Gibson, or if it was just good, old-fashioned negotiating.

Oksana extortion.
We're told Sheriff's investigators want experts to weigh in on Oksana's role in the mediation -- specifically, whether she was a participant in a legal negotiation with Mel, or whether she crossed the line and simply demanded money in return for not ruining the actor with the inflammatory tapes.

Investigators are still conducting forensic tests on certain evidence, including Oksana's iPhone, which she used to secretly record Mel.

And Sheriff's investigators are approximately two weeks away from turning the extortion case over to the L.A. County District Attorney ... this according to Sheriff's spokesperson Steve Whitmore.

Whitmore tells TMZ ... Oksana is the sole focus of the extortion investigation.

Who'sThat

The L.A Sheriff's wouldn't spend 5 minutes looking for Mitrice Richards but they'll spend all this time trying to get an extortion charge on someone? Corruption at it's best - anything to save their racist pal Mel Gibson.

@middleagedcrazy I've not heard the term Cindarella schools before but someone in real life yesterday was telling me about schools in Russia where some women go to learn how to "hook" a western man - is this what you mean?

I know EVERY lawyer in the world is going to stand up and hold a definition of extortion for us all to read but this instance, this case and this illegal act is extraordinary.

Extort: to wrest or wring (money, information, etc.) from a person by violence, intimidation, or abuse of authority; obtain by force, torture, threat, or the like

Extort: to secure (money, favours, etc) by intimidation, violence, or the misuse of influence or authority.

Oksana is indeed recieving money from Mel Gibson.
Oksana threatened, provoked and intimidated Mel Gibson.

Oksana and her law team state various reasons for her making recordings of Mel Gibson but that does not change the fact that she threatened to make these recordings public and made them public when her demands were not met.

She signed an agreement stating she would destroy the tapes for the millions of dollars she was going to recieve, there is little evidence that any of the lawyers helping to mediate that agreement were aware of Oksanas true intent.

As right now her intent is in question and as right now the entire world is baffled to find reason for what she did.

Even if it is discovered that a burglar broke into her house and stole the tapes from Oksana and then released them to the world that does not change her intention to extort. It is the state of california that must proof Oksana extorted Mel Gibson.
When Mel Gibson was screaming in agony at the thought of losing his daughter he was not aware he was supplying the recorded evidence that would convict Oksana of extortion but we all heard it and we are all suspicious.

Oksana knew that the public had a well defined bias against Mel Gibson for previous public outbursts. Oksana knew Mel Gibson was attacked for movies that he made. Oksana knew Mel Gibson was extremely vulnerable to being extorted and deliberately planned to gain money from that vulnerability.

Oksana targeted Mel Gibson knowing he would pay any amount to prevent further scrutiny from the public. Oksana provoked, threatened, intimidated and tortured Mel Gibson until there was nothing left resembling the Mel Gibson we know.

As a victim to extortion Mel Gibson made the most foul shrieks and torturous vile statements a man could make at the thought of losing his child. Mel Gibson was pained into imagining the outcome of the extortion and felt complete despair for losing his child.

To me, the extortion didn't happen during the negotiation of the settlement agreement, but rather after she signed it. Once she signed and realized she wanted more then $15M, she then said she wanted more or would release the tapes. When he said no to more $, then she arranged to give the tapes to Radar.

You could be right because there was a dispute over father's day and Ox filed a restraining order and mel filed a restraint prohibiting her from releasing the tapes which makes me think there was a threat to do so....then boom the tapes were public.

wondering

the simple fact that oksana did not use the recordings to turn over to the authorities, but instead used them in a way to gain monies, and other financial securities is by most standards looked upon as extortion or blackmail.
and since no authorities were notified until after she reneged on the mediation agreement that she signed, and sending an e-mail to mel gibson claiming there was nothing for her, further proves her motives.

I believe the same decision will be made on BOTH cases because prosecuting only one is a recipe for disaster.

There's quite a discrepancy between falsifying evidence to authorities and attempting extortion vs having a private argument with absolutely no proof of DV

The Feds don't play games, nor do they appreciate having their resources squandered, if there is evidence, she will be prosecuted...
if the Feds can put Martha Stewart in prison, you can bet they won't have any problems with an extortionist...

The differences in the two are that in the first, there was nothing but accusations without any evidence nor valid proof whatsoever...
if the Feds find legitimate proof of extortion, and Blair Berk is no slouch, I'm sure she knows the difference....she will be charged.

The fact that it's taken this time and they(Feds) are still involved shows that they found something and investigated thoroughly, which takes time, especially if there is forensic evidence from the iphone.

I can't be convinced that a Russian female knows the difference between a legal negotiation and extortion. All she understands is leverage.

Besides, the chronology is that the negotiations failed, Oksana fired her lawyers, there was an interlude of silence, she obtained a restraining order, and then the tapes surfaced on the Internet. That means activity took place between the mediation and the tapes surfacing, and that's when Oksana likely overstepped her role and attempt to extort.

Aussie...It certainly will be a travesty but the way things look...she will be getting BIG CASH. Afterall, how is it she can ignore the legal system and get away with everything. I thought there were rules that apply to everyone. Something is not right.

That is what I have also thought, BReasonable. Mr. Horowitz threw out the idea that Mr. Gibson actually extorted Miss Grigorieva during the mediation. Remember the comments about "evidence" and his declaration that that indicated a crime? That was the beginning of the assault on her attorneys at the time. Since the get go, it has appeared Mr. Horowitz was throwing his ideas out just to see what might stick.

The sheriff's office had been waiting to meet with Mr. George. They held that meeting and now things are moving along again.

I can not imagine anyone not being concerned about an extortion investigation. That is a serious charge.
