Sheriff Gets Legal Eagles In Oksana Extortion Probe

The L.A. County Sheriff's Department is consulting law professors and attorneys to determine if Oksana Grigorieva was trying to extort Mel Gibson, or if it was just good, old-fashioned negotiating.

Oksana extortion.
We're told Sheriff's investigators want experts to weigh in on Oksana's role in the mediation -- specifically, whether she was a participant in a legal negotiation with Mel, or whether she crossed the line and simply demanded money in return for not ruining the actor with the inflammatory tapes.

Investigators are still conducting forensic tests on certain evidence, including Oksana's iPhone, which she used to secretly record Mel.

And Sheriff's investigators are approximately two weeks away from turning the extortion case over to the L.A. County District Attorney ... this according to Sheriff's spokesperson Steve Whitmore.

Whitmore tells TMZ ... Oksana is the sole focus of the extortion investigation.

yes, Genna and imo, it was useless...Harvey was not there but 2 other guys...they really didn't answer much about Oxana jsut that she is manipulative.

The fact that it's taken this time and they(Feds) are still involved shows that they found something and investigated thoroughly, which takes time, especially if there is forensic evidence from the iphone.

initially perhaps it was a negotiation ie the May mediation, then once she reneged on it and released the tapes then continue to bombard with this media frenzy, somewhere along the way, it has become an EXTORTION!

The general rule is that the California anti-SLAPP statute is to be construed broadly in favor of the protection of speech and petitioning activity. But this does not mean that all "speech or petition activity is protected by section 425.16." Flatley v. Mauro (2003) 39 Cal.4th 299, (referring to)(Lam v. Ngo (2001) 91 Cal.App.4th 832, 851. The First Amendment does not protect violence or other criminal acts.
In the Flatley case, Michael Flatley (of Riverdance fame) sued an Illinois attorney in Los Angeles, California for civil extortion and defamation, among other claims. The attorney had made certain prelitigation demands directed to Flatley arising out of an alleged rape by Flatley of the attorneys' client. The attorney filed an anti-SLAPP motion claiming that his prelitigation demands were protected under section 425.15. The trial court concluded that the anti-SLAPP statute did not apply because it determined that the attorney's conduct amounted to extortion. The attorney appealed the decision and the appellate court affirmed. The California Supreme Court also affirmed.
The attorney, in his various demand communications, among other statements, threatened to "go public" with the allegations of rape and disseminate press releases to numerous news organizations. He stated that, “[a]ny and all information, including Immigration, Social Security Issuances and Use, and IRS and various State Tax Levies and information [would] be exposed. We are positive the media worldwide will enjoy what they find.”
The high court held that the anti-SLAPP statute does not apply to speech and petitioning activity that is illegal as a matter of law. Interestingly enough, it does not appear that the supreme court intended this decision to have broad application since it also included the following in the majority opinion: "Applying this principle in the specific cir***stances of the case before us, we agree with the Court of Appeal's conclusion.
I suspect the Court wanted to limit its holding so as not to erode the clear legislative intent to read section 425.16 broadly.

Oksana has used the media daily to cause emotional pain and suffering to Mel Gibson.
Oksana is using internet websites, magazines and television talk shows to cause emtional and financial damage to Mel Gibson.

Oksana, for more than a year, has manipulated Mel Gibson using his child and children as devices to gain money from Mel Gibson.

Oksana has stated several times that Mel Gibson should give her more money than he does to others in his life because she is worth more. Oksana has placed a monetary value on Mel Gibsons child with her and Mel Gibsons children with his wife.

Oksana views people as commodities that can be traded for money and that is the tendency an extortionist would exhibit. Oksana uses human beings to gain money.

LOL yes, me too...my hubby comes around me occasionally and just tsk tsk shaking his head..and i am not on here as much as all you ladies & gents,

he did however comment "what did i tell you? as soon as we heard about this girl long time ago, i knew she was no good. she just wanted his money! she looks like a gold-digger! i knew it!"

Even my hubby knew from the mention of her name and her photo 2 years ago~! wish Mel got that ESP my hubby does!

The piano player's sister, a dancer and 'high concept' model has an apartment in Moscow -- one of the most expensive cities in the world. The piano player goes to Moscow for her 'charity' concerts -- which are closed and only by invitation of her mother and sister -- and somehow manages to stay at the most expensive hotel in the world. Still skips out on paying her tab.

The piano player's mother gave interviews boasting of the silver Mercedes they gave to Svetlana Belyaeva 'our savior,' again on that 'charity tour.'

These people are so slimy. I hope the Feds and MCB are doing their best to call a halt to some of this fraud.

Eric George would not and will not admit to any knowledge of extortion by Ox. If he knew about it and went ahead with the settlement, he would have aided and abetted her in her extortion plot. He would lose his license. He can, however, give evidence of her having knowledge of the money in the settlement and all the rest of that. George cannot ever admit to having been a part of something illegal.
