Lindsay -- Probation Dept. Unswayed By Rehab Stint

10/22/2010 9:00 AM PDT BY TMZ STAFF

Lindsay Lohan's voluntary stay at the Betty Ford Center isn't impressing everybody -- TMZ has learned the L.A. County Probation Dept. still wants LiLo to serve at least 30 days behind bars for her failed drug test.

Law enforcement sources tell TMZ the Probation Dept does not want Judge Elden Fox to cut LiLo a break during her probation violation hearing today ... and will recommend that she serve at least 30 days in jail for testing positive for cocaine after she left her court-ordered rehab stint at UCLA.

The Probation Dept. carries some pretty powerful influence -- but in the end, the decision will be up to Judge Fox.

The hearing is set to begin today at 8:30 AM PST -- and we'll be streaming the whole thing live.

The Belvedere truck is backing up behind Bar Marmont at this very moment. The construction crew is finalizing the installation of a hair-extension station in the area between the restaurant and the vestibule. In just a few short hours, the economy of West Hollywood will again be flush. Thank you, Lindsay....

She is still wearing the SCRAM but it is only supposed to be part of her bail conditions.

Send Lindsay to jail for the FULL amount of her sentence. No early release for 'good' behavior. She is a TRAIN WRECK, and she needs long-term help and sobriety. In addition to jail, she should also be sentenced to MANDATORY rehab for a minimum of a couple months so she can clean up and get the real help she needs.

Regardless of whether she went to REAL rehab in order to stay out of jail the important thing is that she's IN REHAB now. Any professional will tell you it can take up to "X" number of tries to effectively kick an addiction without real danger of relapse. Hopefully this is the time for Lilo.

She's an addict so of course she was out of control and behaving badly. I think she needs a break at this point. She's not out on the street endangering herself or others right now so I hope the judge gives her the benefit of the doubt and lets her go back to Betty Ford - make her stay there for as long as she'd be required to go to jail, or even longer.

The girl REALLY needs help.

OK those of who are saying jail is more effective then rehab are DEAD f*cking wrong! Jail dosen't do jack sh*t to cure addicts, all it does is temporarily remove them from the general public, but more thne likely they'll still have a problem when they get out, so I pray that judge Fox at least sentences Lindsay to rehab BEFORE she does time in jail.

Dont worry Lindsay. If they say you get 30 days in jail, you know for YOU it means about 30 minutes or less. YOU are special. Not.

I don't know, Nicole.... maybe the Court should just get rid of the SCRAM, give her the stupid 30 days, lose any further probation and put an end to this drama once and for all.

In my experience growing up as a child of the 70's in L.A., I believe that there's too much fuss being made about someone doing cocaine. It happens everywhere (especially there), and no Judge's actions are going to change that fact. Folks are going to do drugs if they want to, but most would appreciate it if those who do so do not drive on a public road.

Meanwhile, I'll go ahead and continue to write ridiculous quips about this situation.... entertainment - kind of why we come to this site in the first place.

Your Honor,
I found this brick shaped package unaware of the contents.
When I opened it a gush of wind came along and blew all this white powder up my nose.

I think she needs to go to jail for at least a year. No easy outs for any reason. She only went to rehab because she knew it would look good to the judge. She is wasted space breathing my precious air and I personally am sick of her getting away with everything she does. Its past time for her to do some hard time and have time to think about her actions. Maybe then and only then will she change her ways and become someone who can function as a normal person. I seriously doubt it though. There is too many people stepping in and getting her out of the trouble she causes.

Its her constant disrepect to the judical system.
She basically told the judge to take his orders and shove them up his azz.
