David Cassidy -- I Did NOT Drive Drunk!

11/4/2010 11:55 AM PDT BY TMZ STAFF

David Cassidy is adamant that he was NOT hammered on booze when he got behind the wheel in Florida last night ... and says he plans to fight the DUI charges.

David's rep, Jo-Ann Geffen, tells TMZ ... the former teen idol admits he did take a pain pill for his back earlier in the day -- and may have been tired from an early morning funeral he had to attend -- but he definitely wasn't drunk.

Cassidy is also disputing the results of the two breathalyzer tests he took at the time of arrest -- in which he blew a 0.139 and 0.141 -- insisting his true blood alcohol content was not properly measured.

Cassidy's rep tells us the actor is already on the hunt for a lawyer and plans to fight the charges adding, "He would never jeopardize anyone on the road and he would not have been driving had he not had to go to a funeral ... he's never been arrested in his life before for anything."

So, you were high on a pain pill then. What's the difference? You still shouldn't have been driving on a narcotic pain killer.

He'll change his tune after he gets an attorney who tells him he doesn't have a leg to stand on and short of proving the machine was malfunctioning, he's screwed. PLUS, you don't have to have an alcohol result as evidence. You can be convicted based on OTHER evidence such as bad driving, smell of alcohol, swaying, slurred speech, etc.

David is in denial. It's very sad. but he needs a serious scare to get him straight.

David if you want to risk your own life that's one thing, but you don't have the right to drive drunk with booze or pills. IMPAIRED is IMPAIRED. Stop it.

"He would never jeopardize anyone on the road and he would not have been driving had he not had to go to a funeral ... "

That sounds like he would drive while hammered, but only to funerals.

Why the half empty bottle of booze?

Because of screwed up laws this is the best defense to go with. He would be an idiot to not follow whatever his lawyer is telling him to do. He should have pulled a Rolloff.

Cannot wait for the cops to show the judge the dashcam video. The Florida standard is .08 ( I was a bartender) What he blew was almost twice the legal limit. Good luck beating that!

This guy is must be all wet because he is living in De Nile.
He gets pulled over by police for impaired driving, (strike 1), fails a breathalyzer test (strike 2), admits to driving while taking "pain pills" (strike 3) and then fails a second breathalyzer test(strike 4?). Someone call Dr. Drew. The first part of getting better David is admitting you have a problem.

All you sanctimonious people on your high horse, stop with the judgment. You are all liars if you contend you have never driven a car while impaired.

Stop snacking on the paint chips, please.

It's called D.U.I. = "Driving Under the Influence". He was "under the influence" of drugs AND alcohol...PERIOD.

I remember looking at the death details of Jack Cassidy, his father.
Jack's alcohol level was .12 when the legal limit was .10.
Jack also left his car with someone else and walked home.
David's alchohal level was .14 and David was driving.

LoL. Nice of this clown to pretend he doesn't know the alcohol limit and claim the test was wrong. I just want to know how he knows the test was not properly measured. He apparently has done this before with a comment like that.

What a JACKASS! Even though we can assume he'll be treated like a king because he's a celebrity he needs to be prosecuted to the fullest. This could explain what is wrong with his daughter.
