Oksana's Former Lawyer -- Unmuzzled

11/23/2010 8:15 PM PST BY TMZ STAFF

The one man who can blow the lid off the Mel Gibson/Oksana Grigorieva case may now be unmuzzled ... TMZ has learned.

Oksana Grigorieva Lawyer

Eric George -- the lawyer who represented Oksana in her mediation with Mel -- is now unchained because Oksana has waived the attorney-client privilege ... TMZ has learned.  It's significant because sources tell us ... Oksana's lawyers have gone to great lengths to keep George quiet.

Oksana submitted a signed declaration to Judge Scott Gordon on November 3, which reads in part, "I have waived attorney-client privilege repeatedly in this declaration."

Here are just some of the issues Sheriff's investigators in the extortion investigation could ask George:

-- How much was Oksana involved in the discussion about money during the mediation
-- Did Oksana try to leverage the tapes in order to secure the $15 million package
-- Why did Oksana say she secretly recorded Mel
-- Did Oksana understand the custody arrangement before she signed the mediation agreement
-- Did anyone ever threaten Oksana with prosecution or deportation if she didn't sign

And there are issues related to the domestic violence investigation as well:

-- Did Oksana ever show George a photo of her with a black eye (i.e., did Oksana Photoshop the picture that is circulating)
-- Did Oksana ever show George a photo of the baby with a bruise, or claim the baby had been injured during the January 6 argument
-- Did Oksana ever tell George that Mel threatened to kill himself, her and the baby
-- Did Oksana tell George who had copies of the tapes during the mediation, which could be a clue in determining who leaked the tapes.

Sources tell us Oksana's team is doing whatever it can to keep George quiet, but if Judge Gordon gives George the all clear to speak to authorities .... it could have a significant impact on the custody case and the investigations.

This is only one smoking gun in the case. The other is Oksana's son who was interviewed
a couple of months ago, and the Child Protective Services found nothing in his statement that
would alarm them to Mel's 'violent' behavior.

Two smoking guns. At least. The case is as good as over. Oksana is what we suspected all
along,- a groupie that sought out Mel , made sure she got pregnant and thought she hit
the jackpot. In a way she did, but her greed got the better of her, and she's unravelling.

She didn't count on 'falling' for Mel, and when getting rejected, turning into just another
'Glen Close' fatal attraction caricature.

@ fuddyduddy: Don't be confused. Just don't believe what TMZ writes about what "sources" told them.
The only sentence in the whole article that matters is:
Oksana submitted a signed declaration to Judge Scott Gordon on November 3, which reads in part, "I have waived attorney-client privilege repeatedly in this declaration."

All the other stuff is typical Team Mel crap.

Hey there--the declaration part I can see as being true, but the questions that may want to be asked of Eric seem like reasonable questions.

Is it possible that she needed to sign the declaration to allow her lawyers to subpoena him? Fud? Shyone?

When she makes "declarations" that suggest that her previous legal Representatives have acted in a manner that "make her seem guilty" she has the right to waive any agreed silence in statements against them.

Sam she is accusing her lawyer EG of breaking the law in her "declarations". This is what the tmz article is suggesting.

Didn't Geroge comae out and say she was never threatened by Mel's Lawyers, SAYING SHE NEVER MENTIONED ANYTHING ABOUT ABUSE AND THE OTHER STUFF!

TOLD YOU GUYS SHE IS UP **** CREEK WITH OUT A PADDLE

TEAM MEL
I also read were she was the stumbling block at the original mediation, she wanted everything And I do not buy the bull **** on her not understanding in what was said or what she was signing.

She thought Mel would just roll over give her what she wanted and that was that.

Did not expect him to fight her

I would be very surpried if Eric George copped to being a part of any extortion attempt. If he did, he would be in danger of losing his licence, so I doubt he'll say anything too detrimental against her. As to the DV claim, if she mentioned it to him, I'm pretty sure he advised her to file a report. If she didn't, it's on her.

Her statements in family court probably pin the whole thing on Eric George. She probably is telling the Judge it was all his idea.

Hi there Sam! I feel like I am chasing my tail on this one! LOL
You have a good point that OG probably did have to submit a declaration to the court that she waived the attorney-client privilege in order to get Eric George subpeonaed. So--they subpeonaed him and we haven't heard anything about him since. We haven't heard anything about Blair Berk being subpeonaed either. Anyway, what are they doing? Just trying to make OG LOOK GOOD by getting a declaration from her, but running scared now because they have figured that some of this information will affect the DV and extortion cases? I'm really confused.

JustSaying has 32 years of experience as an attorney in CA, so that's why I directed a post to them. I hope we hear back.

They subpoenaed Mr. Gibsons lawyer also. We don't know how many lawyers that in the very beginnings of this case, were subpoenaed. I think she is trying to prove this case was corrupt from the get go so she can break the contract.
