Gets New Lawyer

... and the Flu

Oksana Grigorieva has a new lawyer -- #42 by our count -- but she also has a sick feeling in her stomach.

New York attorney Marty Garbus just got approval by an L.A. County Superior Court judge to appear on Oksana's behalf.  He joins attorney Dan Horowitz.

Now for the sick feeling ... Oksana is on her way to a law office for part 4 of her ongoing deposition in the Mel Gibson custody war.  But we're told she feels like crap and may have to pull the plug on the depo.

If she goes home sick, she can get a few pointers from "The People's Court."

Frustrating as it is, LASD has had a long fight against Miss Oksana and her lawyers. Attorney Horowitz has been filing all sorts of otions to restrict access to her computer and phone, he's been throwing about subpeonas and in general, doing everything he can to slow down or disrupt the investigation. Then, too, as more information is uncovered, more questions need to be asked. Plus we have to wait for some of players - like Dr. Shelden and Attorney George - to be cleared to speak. It all takes time. But better to be thorough than have her walk on a technicality.

I can't imagine a criminal attorney allowing his client to give a deposition when possible criminal charges are pending. One would assume the parameters of the deposition would be limited; however since she was giving interviews maybe they aren't allowed to limit it. I guess she is stuck with her version of the incident now......oh wait .....which version is she going to go with?
The attorneys must have been arguing amongst themselves this past weekend over which version would be the final version. Kind of like writing a screenplay and having different endings played for the audience to see which one they liked better.

They seem so tight, Oksana, Garbagus, and Horrowitz probably will infect each other and get sick.
When Oksana gets to hell, she'll be setting up a room her Lower Chamber - for her lowers.

I’m wondering if the media blitz will resume now. Garbus was all for it since the beginning and was by her side at LKL interview. That interview may have caused her to lose some time in the last custody hearing. Do you think that Garbus will challenge Judge Gordon in something about freedom of speech? Oksana and Garbus in that interview were taking an awful lot of shots at the judge(s) and the courts.

I'm sure the crazy Mel had her injected with some drug to make her sick,this is all his fault....He is sooo going to lose everything he owns and he knows it.He is totally out of control and will do anything to keep from losing it all.

I'm thinking you're right about "version". Which then raises the issue about hearsay and Judge Gordon's discretion about what constitutes hearsay.

Full credit to shyone for the following copied from a long ago post -

--The purpose of the hearsay rule is to exclude evidence of statements that are unreliable for any number of reasons, including but not limited to

1- not being made under oath,
2- coming from a source that cannot be subjected to cross-examination,
3- where no person with knowledge can explain the statement,
4- where there are no "indicia" of reliability.

Remember that judges rule on whether or not evidence challenged as hearsay will be admitted in evidence or rejected/excluded from evidence that goes to the jury.

It is true that multiple statements made by OG not under oath may constitute inadmissible hearsay in many situations.

However, if OG testifies or if the statements are either excluded from the hearsay definition or fall within an exception to the hearsay rule of general inadmissibility, OG's out of court statements will be admissible if they relate to any issues of importance in the case.--
