Lindsay Lohan -- Ready to Fight Charges

Lindsay Lohan's lawyer swears LiLo is innocent -- and is ready to do battle in court if it comes to that.

TMZ obtained a statement from Shawn Chapman Holley that reads, "We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press."

As we first reported, Lindsay will be charged with felony grand theft as early as Monday for allegedly stealing a $2,500 necklace from a Venice, CA jewelry store.

She faces a maximum of three years in prison if convicted.

FYI:

Folsom and San Quentin are men's prisons. The only female prisons are the California Institution for Women, Central Valley Women's Facility, Valley State Prison for Women and possible a couple of minimum custody camps (fire).can come up with a receipt for her "loaned" jewelry. Chances are she'll do a "Wynona", if she is charged and found guilty.

It will be interesting if Lindsay can produce a receipt for the loaned jewelry, regardless of who allegedly signed for it. It wouldn't surprise me if she lifted it. She's the type. Money to pay for it but loves danger and living on the edge...

I'm shocked! Some lawyer vehemently denies their guilty client is innocent! Lawyers suck! They do not give a damn about the truth, all they care about is minipulating the system to get their clients off. It costs the taxpayers billions to put up with the BS. Maybe if the lawyers client is found guilty then the lawyers should face penalties for trying to lie for their clients.

First off, 'one' false accusation? .. this makes the second if not the third .. they aren't all 'false'. Secondly you 'borrow' from a friend, you 'borrow' from family.. you do NOT 'borrow' from a store.. go to Walmart and try to 'borrow' something... see how far you get. She should be worried and I hope the store sticks to it's guns and presses charges on this 'thief'.. not borrower.

Regardless, it appears she is wearing stolen property of enough value to be a problem. I don't care as to why the jewelry store has chosen to press charges. If the police feel they have enough evidence to charge her, then my guess would be that neither Lindsay nor her stylist can come up with the receipt to prove the jewelry was a loan and the store is reporting it as stolen.

One thing is for sure, even "Daddy" wouldn't know if she shoplifted it. It's certainly not something she'd ever admit to her family. A friend...maybe...but its about getting away with it, not getting yourself in trouble. I know because I had a friend who shoplifted and I caught her after we left the store. She had plenty of money in her purse. I was really ticked she did it while in a store with me. She couldn't explain "why" she did it.

Los Angeles Criminal Defense Attorney, Steve Cron, told us she may very well be prosecuted over the incident - although it is hardly likely she would be sentenced to a full three years.
"There is a likelihood. It seems to me that she got caught stealing that necklace and it appears that somebody talked her into returning it a week later and had someone drop it off but it was too little too late. She had already stolen it, so I think she will get prosecuted," Cron surmised. "It's unlikely that she is going to get 3 years in state prison because although she's screwed up repeatedly on probation, but she certainly can get a lot more time in county jail. Judge Fox could give her 6 months for violating probation in Beverly Hills and another judge who hears the case on grand theft could decide to send her for more time in county jail or he could send her to state prison. It's more likely that she is going to go to an extended period in county jail. It wouldn't be 30 or 60 days, it's going to be a substantially longer sentence than that."

It appears the necklace in question is a small one that is high on her neck as that is the one in the TMZ close up. It looks like it may have diamonds one it, hence the price tag. Doesn't take much these days to reach $2500 when gold and diamonds are involved, these days.

Don't forget that the "Dawn" incident may not yet be over. In order for Dawn to get her benefits for being injured, a judge (?) had to rule that she was injured in the course of her work. It also appears that decision ruled that she was injured by another in the course of employment and the injuries were substantial enough for her to her granted time off and receive benefits.

I stated a couple of weeks ago that this was going to be the stumbling block for Dawn and Lindsay's "agreement". I think there is a good chance charges will be brought against Lindsay on Dawn's original assualt charge and that Dawn will eventually cooperate in order to maintain her benefits. As for the alleged HIPPA violation, that's another matter.

4 car accidents. 2 DUI's (with possession of cocaine). 3 rehab stints (at least, right?). Several theft accusations. When she works, she's late or a no-show. Judge tried to get her mental help, but UCLA let her out early because she is not mentally ill. She's just an addict. And addicts are very good at blaming others, making excuses, and telling you what you want to hear, "working the steps" to sobriety. In my experience, very few addicts ever get better. Unfortunately, she has been shown so much leniency. She has no incentive to get better.
