Lindsay Lohan -- Ready to Fight Charges

Lindsay Lohan's lawyer swears LiLo is innocent -- and is ready to do battle in court if it comes to that.

TMZ obtained a statement from Shawn Chapman Holley that reads, "We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press."

As we first reported, Lindsay will be charged with felony grand theft as early as Monday for allegedly stealing a $2,500 necklace from a Venice, CA jewelry store.

She faces a maximum of three years in prison if convicted.

Jeeez ... Lindsay is in trouble with the law AGAIN !! You'd THINK that after the last couple of years of Lindsay being caught up in the criminal justice system, she'd avoid even SLIGHTLY breaking the law. If I were her, I'd be paranoid about spitting on the sidewalk or jaywalking.

I used to like Lindsay. Now I'm thinking she's just too clueless as a person to make it in Hollywood. The girl doesn't seem to have basic "horse sense". She must really feel like the laws of the state of California don't REALLY apply to her or something.

Wake up Lindsay! The laws in California DO apply to you. You are NOT "special" when it comes to the law. Even if Lindsay was a huge celebrity, they'd still enforce the laws if she broke them.

Look, this poor kid is an easy marked target. No wonder she has had such a rough time recovering & trying to get her life back on track. Instead of "Lindsey Bashing" perhaps a little support in her corner would be called for. Seems to me everyone forgets that Lindsey hasn't exactly had the proper guidance, family or the TRUE support. She's never going to find the help she needs if she is constantly Front Page News in the Scandal Rags !!!
Give the kid a break & let the court hear the case first. This IS just TOO Outragous to beleive !!! :)

The video from the store and no written "loan" agreement will mean that LL is heading to San Quentin Prison for a few years.
Shoplifting is shoplifting and Lohan is heading for more time behind bars.

San Quentin is not a Woman's Prison. I don't think even Scott Peterson would touch a “Lickalotofpus” Dinosaur like her. Scott's on Death Row there, you know.

I don't understand why there are a handful of people still trying to defend her, or make it that everyone is out to get her. Lindsay had her time in Hollywood she was a child actress that is it nothing more. She doesn't have the talen to ever win any type of award for her performances, she isn't even in the same hemisphere, let alone the same category as let's say Meryl Streep, Katherine Hepburn, Bette Davis, Ingrid Bergman, Audrey Hepburn, or Sophia Lauren just to name a few. She was child actress that is washed up and trying to stay important..FAIL!

Police report?

Store owner must be nuts. Why in the heck did she let Lindsay walk out with the necklace in the first place? The story is so fishy. When did she notice the necklace missing? Why did someone allow it to be taken out of the case and then not put back in? I think the store owner set this all up for publicity.

TMZ probably has special department just for covering what crazy stuff that Lindsay is up to ... TMZ: Lohan division.

Hollywood life might get too boring if Lindsay wasn't getting into SOME sort of trouble. She's like a wreck on the side of the highway. People just can't help slowing down a bit to look at the damage to the car.

Lindsay is crashed up on the side of the road pretty frequently. TMZ will be there to give the public what they want ... all the gory details ... in high definition 3D in the future maybe. :)

If charges are filed Lindsay will have a different Judge not Fox or the recused Judge as it will place at Airport court.

BEVERLY HILLS, Calif. — The judge who sent Lindsay Lohan to jail has removed herself from the case after a prosecutor complained she improperly contacted experts or participants in the case privately, including a rehabilitation facility, officials said Wednesday.

Superior Court Judge Marsha Revel recused herself Friday, court spokesman Allan Parachini and district attorney's office spokeswoman Jane Robison said.

Beverly Hills Superior Court Judge Elden Fox is now handling the Lohan case.

Revel's clerk said there would be no comment, and she referred callers to Parachini.

Deputy District Attorney Danette Meyers was in court and unavailable for comment.

Robison said there were several instances when the judge had communications and the prosecutor was not present or told afterward.

In one instance, the judge contacted the Morningside Recovery rehab facility, which was not on a list provided by her court-appointed experts. She then selected Morningside as a place to send Lohan.

Lohan attorney Shawn Chapman Holley eventually persuaded the judge to send Lohan to Ronald Reagan UCLA Medical Center.

An e-mail request to Chapman seeking comment wasn't immediately returned. Court officials declined further comment.

The actress was released Aug. 2 from the women's jail in Lynwood, where she served 14 days of a 90-day sentence for violating her probation in a 2007 drug case.

She immediately went to the UCLA drug rehabilitation facility for a court-ordered three-month stint.

the judge basically was caught and got out before she could get herself in any more trouble trying to help self entitled stars!

On December 12, 2001, Ryder was arrested on shoplifting charges in Beverly Hills, California. She was accused of stealing $5,500 worth of designer clothes and accessories at a Saks Fifth Avenue department store.[4][78][79] Los Angeles District Attorney Stephen Cooley produced a team of eight prosecutors. Cooley filed four felony charges against her in what was described by British newspaper The Guardian as a "show-trial."[80] Ryder hired noted celebrity defense attorney Mark Geragos. Negotiations for a plea bargain failed at the end of summer 2002.[81] As noted by Joel Mowbray from the National Review, the prosecution was not ready to offer the actress what was given to 5,000 other defendants in similar cases, an open door to a no-contest plea on misdemeanor charges.[82] Ryder agreed under signature to pay two Civil Demands, as permitted under California's Statute for Civil Recovery for Shoplifting, from Saks Fifth Avenue that completely reimbursed Saks Fifth Avenue for the stolen and surrendered merchandise while detained in the Security Offices of the Saks Fifth Avenue store, and before she was read her Miranda rights and arrested by the Los Angeles Police Department.[83]

During the trial, she was accused of using drugs without valid prescriptions. Ryder was convicted of grand theft,[84] shoplifting and vandalism, but was acquitted on the third felony charge, burglary.[85] In December 2002, she was sentenced to three years' probation, 480 hours of community service, $3,700 in fines, $6,355 in restitution to the Saks Fifth Avenue store, and ordered to attend psychological and drug counseling.[86] After reviewing Ryder's probation report, Superior Court Judge Elden Fox noted that Ryder served 480 hours of community service and on June 18, 2004, the felonies were reduced to misdemeanors. Ryder remained on probation until December 2005.[87][88]
