Dr. Murray's Defense: MJ Was In Failing Health

Michael Jackson was in such a weakened state before he died ... it's unfair to blame his death on Propofol ...and we've learned this is precisely what lawyers for Dr. Conrad Murray will argue to a jury.


Sources familiar with the case tell TMZ ... Dr. Murray's team will argue that at the time of his death, Jackson's body was failing him ... partly because he  was "driven over the edge" by AEG to rehearse for his upcoming tour.

We're told Murray's lawyers will call witnesses to testify that Jackson was not showing up for rehearsals -- and when he did show, he was exhibiting "clear signs" of failing health.

The upshot of the defense ... even if jurors believe Dr. Murray administered the fatal dose of Propofol, Jackson was already in failing health.

But as TMZ has already reported ... Dr. Murray's lawyers will argue Jackson himself administered the fatal dose of Propofol to himself when Murray was out of the room.

The trial begins in April.

Please read up on :" "This Is It " producer starwitness in MJ Preliminary", on TMZ 6/20 2009. Murray said "horrible" things to Michael ,was rude and disrespectful. This was 6 days before he died.AEG bigwigs were also at this "meeting".Why did murray not speak up for Michael then? K.O. was present at that meeting.
As Michaels private physician it was murray´s primary duty to look after his health and above all his life.With his MD he should have spoken up if he thought Michael could not keep up with all that was planned.MURRAY is a LIAR and a big COWARD.
For whose use were the gallons of propofol intended?There was a
shipment even in June.I will add MURDERER.

"MJ Was In Failing Health"... Well that'll be stating the obvious to the jury. For the last 5~10 years of his life he looked like one of zombies in Thriller.

Fans should start a new tradition. Dressing up as zombified fans, MJ etc. and descending on the cemetery each year on the anniversary of his death. lol

The issues Jackson had might stem back to how she was treated by her brothers, including Michael, who had nicknames for her like "Horse, pig, cow, slaughter-hog," she said."

What does this have to do with selective reading? It supports exactly what many posters here are saying: IF Michael didn't really take care for himself, IF he wasn't well – then Murray as his responsible personal physician should have backed Kenny Ortega up instead of arrogantly ranting and raving when he dared to send Michael home from rehearsals.

I'm VERY curious whether any witness will tell that Murray stormed the stage at the Staples Center to heroically save Michael from the bad tour staff.

It was first and foremost this 150000-Dollar-doc's job to have an eye on his patient's well-being. If Michael was in a weak state, then it was Murray's failure. Actually AEG should insult him – and not the other way round.

Do you think Micheal is a fool that will administer drug for himself, or was he under the influence of something? I don't know. But what ever the case may be, whether this Murray guy is guilty of the offense or not, what does it profit a man to gain this whole world and loose his soul? Think about it.

This argument will only convict Murray faster. He admits to knowing that Jackson was in failing health, and that he left the drug that Jackson was addicted to, alone in the room with him. If he is in failing health, then you don't leave him during a dangerous procedure, and you don't leave the drug the man is addicted to, right next to him. Just plead guilty and do the 4 years.

About the PR firm (as one here said, they are probably reading here), I would like to hear your spin on how the supposedly broke and indebted Murray can afford your services, the defense team, vacation, fancy clothing, big cars, air fares, his large home, an apartment and other living expenses for Nicole Alvarez, child support for his numerous children, body-guards?
That is a mystery to me and I am very puzzled that he can afford all of this. I don´t care about his ugly tie and who gave it to him as an X-mas present, I don´t care about little girls and balloons.

One scenario is that they do it for serious face time/advertising/pro bono?
This is going to be high profile case followed by all major media outlets all over the world. If they get quackster off the hook, they will flooded by other defence cases, but the downsize (for them) of this scenario is that it ain't going to happen, evidence too damning against him.

I have other ideas but I leave it for now:-)

If this article is true and this is their defence, it actually works against quackster not for him.
How on earth they are going to get any medical experts to testify for defence that it is ok for physician to load up his patience (with failing health according to them, and doc knows about health) with all sort of meds and then start yapping away on the phone and other things (the list is too long to type here)? To me this article just doesn't make any sense.

Ok if I may I am going to call bull. Murray was the one if you recall that said there was nothing wrong with Michael's health. When Murray was asked about Michael's health by the docotors at UCLA he told them blankly that Michael was not suffering from any health problems. Now he is changing his story??? 2 years later what b.s. I hope the jury is smart enough to see this game the defense is trying to pull out of their behinds!!
