Lindsay Lohan Wants Plea Deal

Lindsay Lohan insists she's innocent but still desperately wants to plea bargain her felony grand theft case because she's terrified of being locked up ... sources connected with the case tell TMZ.

Judge Keith Schwartz set a court hearing for February 23, so the lawyers can talk plea bargain.  We've learned Lindsay is willing to plead guilty to make the case go away, provided she doesn't get any jail or prison time.

Sources say the prosecutor wants jail time so there's an impasse.

But there's another way Lindsay can make this case go away.  When there is only one charge on the table -- as there is here -- the defendant can essentially cut a deal with the judge, cutting the D.A. out of the picture.  If Shawn Chapman Holley offers to plead guilty to felony grand theft, with the judge's assurance he won't put her behind bars, the case could go away.

And, it's common in cases like this for the judge to reduce the offense to a misdemeanor if Lindsay stays out of trouble for 12 months.

I doubt that it would be that easy. Not only does she have the new charge of grand theft, but she also has to answer to the violation of probation. If she is found guilty of the grand theft, she will be in violation of her DUI probation.

We all know the only way she will ever get healthy is leave LA, leave the public eye but publicity is what she lives for. For her, there is no such thing as bad publicity. She's never heard of self-respect, personal responsibility.

I want to see some stats as to how "common' it is for a judge to throw out a case, with a person with prior offenses, when the individual has stolen merchandise valued at $2500 and a history probation violations.

Show me some stats... Now if TMZ had said that it's not UNUSUAL for a judge to pull a stunt like that, I'd believe that, that's why they like their job-to wield there POWER, and attorneys can earn their money [if they're connected with the court], barring having those ducks in a row or not a celebratory in California... you're fu0ked

WTF, This is not common. She was on Fricken probabtion. Lets not forget the incident at the hospital. This judge better step up, and grow a pair.

Why didn't Lindsey or her "Assistant", clear this up with the jeweler upon learning they filed a police report, since it was on loan. Why return it to the police, instead of the jeweler. This only after a warrant was being issued. The bitch stole it, end of story.

If she's really not guilty then she should NOT plead guilty. A guilty or no contest plea will severely affect her current probation for the DUIs. In other words, she will be screwed and end up in jail for the probation violation anyway.

If she is trying to negotiate a "deal," then you know she was guilty. She is afraid that without a "deal," she'll go to jail ... where she belongs. She needs to be punished severely for her many transgressions. The judge better start acting as if she really is no different than anyone else. Ship her to jail! She'll benefit from the stay in the long run.

There seems to be plenty of reasonable doubt.

Specifically the fact that the jewelry store allowed her to walk out without paying and did not immediately call 911/LAPD.

Such BS on the part of the TMZ high school dropout who wrote this. This is a very unusual example; less than 1 in 100 cases ever goes there, and only if 1) the defendent has no history of problems with the law, and 2) the judge feels the DA is being obsessively vindictive. BLOWhan has an extensive history of recent offenses, rehabs, probation violations and troubles; this won't be available to her.

And if cows flew, everyone would constantly carry umbrellas. Are you serious? There's no way she's going to essentially walk away from this with no accountability (as usual), which is what the TMZ chimpanzee who wrote this article is suggesting; the DA is a hardass & wants her to be accountable. No matter what kind of ridiculous stuff she pulls, she's going to prison for theft and there's nothing she can do about it. Her immediate future is getting beaten down in prison & having her stuff stolen by other inmates. Get used to it, BLOWhan...
