Police Report: How Lindsay Walked Out with Necklace

2/10/2011 2:00 PM PST BY TMZ STAFF

Lindsay Lohan was trying on a slew of jewelry before walking out of the store with the $2,500 necklace ... this according to the police report obtained by TMZ.

Lindsay Lohan Necklace
The report outlines Lindsay's every move -- from the time she walked into the store to the time she left -- and it's all on surveillance video.

According to the report, Lindsay walked in and removed her necklaces and placed them on the counter.  The report says, "Ms. Lohan then proceeds to try on numerous rings and three different necklaces including the missing yellow diamond necklace."

The police report then says Lindsay continued shopping while wearing the yellow necklace.

Then, at 6:12 PM, the owner locked the store but let Lindsay and her friend Patrick continue to shop.  That's when Lindsay tried negotiating a ring she had been eyeing, but she didn't like the $3,600 price tag.  Lindsay took $3,000 cash out of her purse and offered it in exchange for the ring, but the owner said no.  Lindsay then said, "Ok, we'll come back tomorrow."

When Lindsay prepared to leave the store, she put her own necklaces back on her neck, along with the yellow necklace in question ... then walked out of the store.

The owner noticed a short time after Lindsay left that the yellow necklace was missing, but figured she took it by mistake and would bring it back the next day.  Lindsay never returned to the store.

she planned the whole thing, checking out a bunch of jewels to throw the clerk off, negotiating, another trick, that 3 grand prob. was borrowed as part of her plan. It's not a swap meet Lohan who goes into a high end store and negotiates?

This isn't a felony and i can't believe all the resources and time that is being wasted when the item was returned as soon as Lindsay was informed about the situation.
Its a joke

She returned it when it was leaked that a search warrant had been issued and that's clear because she turned it in directly to the police to keep them from searching her home.!

really?

I've worked in retail for many years and this is CLASSIC shoplifting.

1. many shoplifters have the money (even with them) for the items they steal - it is not about the money, it's about the thrill.
2. coming in near closing, distracting clerk/owner by focusing on other items, removing and replacing items - all classic techniques
3. so according to lindsay supporters if the owner was innattentive/fooled by Lindsay, Lindsay is innocent - no theft is theft
4. If the owner didn't walk over to Lindsay's apartment and demand the return of the merchandise, Lindsay is innocent - really? in what world should a retailer have to get their stolen merchandise back themselves at ? You contact the police
5. If the owner gave the police an different story first Lindsay is innocent - again really? she took the necklace out of the store without paying for it. What the owner did, didn't do, said to the police, didn't say to the police is irrelavant. Lindsay stole the necklace, the owner isn't on trial, Lindsay is. Don't blame the victim.
6. It is all a publicity stunt. Really, because it is such good publicity to be known as a store that frames its customers

A.D.A Duhnette has dozens of drive by shooting cases on her desk that she is neglecting to focus her time and resources on Lindsay's case. I really think that Duh Nette's vendetta against Li Lo is racially motivated. Duh Nette won't get more than ten percent of the vote in her election quest to become the first black D.A. in Los Angeles. The city of Los Angeles has multiple drive by shootings everyday. LA has millions of illegal aliens, and an estimated 100,000 gang members that deal in stolen vehicles, firearms and drugs, extortion ect. I don't think it is right for the city to devote so much time and energy on this celebrity case....

Good to see that the LA District Atty has spent so much money on this case. Not.

This case seems hardly inconclusive to me. Could have been an honest mistake. Could have been kleptomania. Could have been a lot of things.

Plenty of reasonable doubt that if I were Lindsay or her attorneys that make this a case I would fight, fight, fight. Especially in LA where it is easy to win.

Lindsay did this to get RICH RICH RICH from publicity for her new jewelry store she is opening with Dina! See Radar Online now.

Dina, Lindsay, and Michael are laughing all the way to the bank, when they are not here posting smears against the REAL jewelry store owner.

Oh wait, they are here, and laughing at us all now!

87- im neither for or against her but i gotta be honest with you. I love our justice system, but the reason someone would plead guilty in a plea deal is because people like you, and so many others on here, are the same people who are serving as jurors. Do you see some of these comments? You are getting all of your information from a gossip website and have found her guilty already! Could you imagine ANYONE sitting as a defendant looking at 3 years in prison and having no chance at all of getting a fair trial because you automatically believe everything you read and hear?

IF LINDS TOOK IT BY ACCIDENT THEN THAT BLOWS THE WHOLE I THOUGHT THEY LET ME BORROW IT STORY DOESN'T IT?
.
.
.
LINDS STOLE IT PLAIN AND SIMPLE....
.

ANY NORMAL PERSON..ESPECIALLY ONE WHO HAS THE MEANS TO PAY IT..ESPCIALLY ONE WHO OFTEN SHOPS AND BUYS AT THIS STORE...WOULD HAVE RETURNED THE NECKLACE AS SOON AS SHE GOT HOME AND REALIZED IT WAS STILL ON HER NECK!!!
.
.
IT WAS ONLY AFTER WORD GOT OUT THAT SHE WAS ABOUT TO BE ARRESTED THAT SHE DECIDED THE NECKLACE NEEDS TO GO BACK.
.
.
.
BITCH HAS GOT TO PAY WITH JAIL TIME ON THIS ONE.

#145 Huh? So, she shouldn't prosecute people charged with felony theft if they're white?

@jill

Re-read the story. Lindsay placed her necklaces back on, so it wasn't the only one she was wearing, in fact they previously said that it was partially hidden by her necklaces when she walked out. Obviously, Lindsay was given special treatment, as they let her in the store while it was closed. They did not notice the necklace was missing until after she walked out.

Why do you not question why Lindsay didn't realize she had the necklace on when she put the others back on??? Or why didn't you question where was the paperwork for the "loan", if that is what Lindsay is claiming today.

@happyday I'm not taking either side in this...only saying that if I were a juror, there are problems on both sides of the story, and one cannot firmly come up with a guilty or not guilty verdict in such case. Especially with no audio on the tape...there are problems with both prosecution and defense, and this thing can go either way. The fact the store clerk let Lindsay leave the store can be further damaging...even as many here say that this is an expert shoplifter tactic. I mean...the store was locked, which means that the clerk had to go unlock to the door to let her out, and should have noticed...actually should have noticed way before that point. Sure, the haggling over the ring and such can be argued as tactics, but without audio on the tapes, it is merely a case of what each side says happened. That makes for a very lose case. If it were truly a loan, of course Lindsay would wear it out in public. If it weren't? I don't know. I'm just saying with what has been presented so far, as a juror, I would have questions.
