Lindsay Jeweler May Have Screwed Prosecutor

The "victim" in the alleged Lindsay Lohan jewelry store heist just cashed in on the surveillance video and in the process may have really messed up the prosecutor's case.

The jewelry store -- Kamofie & Co. -- has been working with a broker for the last few days and the broker has been on the horn with numerous media outlets, salivating at the prospect of cashing in.

The video has been sold -- but it's causing fits for the lawyers in the case, particularly the prosecutor.

Lindsay's defense is that the necklace was a loan ... the jeweler begged to differ. So intent is critical, and if the jeweler is called to the stand and admits this was just a convenient way of scoring some quick cash from the media, Kamofie will have about as much credibility as (insert favorite celebrity who lied in "comment" section).

We know lawyers in the case have been in touch with the people at Kamofie, trying to dissuade them from selling the tape ... to no avail.

No word on how this will affect plea bargain negotiations. TMZ broke the story ... in the next few days, Shawn Holley, Lindsay's lawyer, and prosecutor Danette Meyers will meet in chambers with Judge Keith Schwartz ... sources tell us Holley is trying to get the judge to commit to a short jail sentence if Lindsay cops a plea.

Well, if this video is a piece of evidence why wasn't it impounded as such by the prosecuting office? And, as it seems that it's legal for the store to sell it then I think they just got back their $2,500 and much more.

The store selling the tape put's just enough "reasonalble doubt" in the mix to crash the whole case. That is IF she actually stole the necklace. We've all read right here that supposedly LiLo is seen standing by the door talking to the owner for severa minutes before walking out, all while WEARING the necklace. Sorry, but that doesn't play to the whole "she stole it" theory. But, selling the tape does give her defense room to come in with "this was done for exposure and all you have to do is look at the fact that they sold the tape to the highest bidder."

New York is a very real place, grounded in people who've worked extraordinarily hard to get ahead (you have to work hard to afford to live there), even the rich. New Yorkers would quite literally kick her ass to the curb and spit her back out onto the concrete. If she still wants to the live the My Little Pony Princess Celebrity Moment, she might as well stay in LA. At least some people there still believe in fiction.

And on another topic, be well prepared for an ONSLAUGHT of pro-Lindsay Trollhan posts everywhere, starting Monday. You know that DUIna (and Ali too) will be manning (appropriately enough) the web-bank 24/7 to keep those pro-Lieho Trollhan posts coming.

Heck, if they could get paid for posting, they'd be millionaires a million times over again! Maybe they should consider buying some stock in TMZ or ET online, come Monday, because you know they will be making BUCKETS of money from the hits.

Also remember in the OJ Vegas Hotel Incident one of the STAR Witnesses called to sell his story to the press even before OJ left the area.
I can't remember the details but I think the guy either recorded it while happening or made the call and it was taped.

We heard the tape before OJ was prosecuted.

Remember when Tim Robbins, as Andy - as part of his escape plan - wore a shiny, nice pair of the warden's shoes and walked right out in the open back to his prison cell because he knew no one looks at your feet! There ya go! Lindsay planned it!

JMHO, we'll see, also think she will get a stint in the solitare box.

To top it off, she is now just a punchline and her career is making hay for tabloids.

Maybe we can autotune this theft video in the spirit of the "Backing up song" or "Bedroom intruder" both quite famous on youtube!

It would only make sense that the DA still has a copy as evidence. Wouldn't it be introduced as evidence at an upcoming trial? We know that she only just gave Shawn a copy of it a week or so ago, so it was still in the state's possession at that time. If the state still possesses the tape, then it seems entirely possible that the store COPIED it before handing it over.

I would think much much MUCH more than that. How much more, I can't even begin to guess. And as greedy as it may be to sell the tape, if you were offered $50,000 to sell it, wouldn't you? Obviously they are no fans of Lilo's (or else they wouldn't have sold it,) so if you don't care about the other person, what would keep you from selling it? It'd certainly be tempting to do so.

The part that I would take into serious consideration would be the fact that it's part of a court case. I would want to see justice properly done - but then again, we already know that justice for the wealthy of CA is a huge JOKE, so maybe that argument doesn't hold too much water either. If she only served 18 days in jail as a result of keeping the tape under wraps, I'd find it hard to blame the store owners for selling the tape. WTF is the value of 18 days in jail? There is NO deterrent value in so short of a sentence.

The jewelry store has basically stolen from Lindsay, using her unauthorized image to sell a video.

When you sell a video using a person's likeness, that person is entitled to compensation -- else, you cannot use their likeness (witness blurred images on reality TV or those who refuse to sign the waiver).

In fact, the value of Lindsay's likeness in that video is far greater than the necklace. She should sue the jewelry store.

Jail passes...video does not. Broadcasters can spin this video any way they please and there is not a damn thing the Lohans can do about it.

Seems to me that she was referencing the sale of this tape. I guess our little girl feels pretty strongly that she is going to skate on this charge.

But as I said, even if she does, the career is now officially over. The sale/viewing of the tape is the official "jumping of the shark" of her career.

And, as I also said, she'll be baaaaaaaaaack in front of the court system soon enough, and they will nail here, sooner or later, just like OJ.
