Lindsay Jeweler May Have Screwed Prosecutor

3/6/2011 11:30 AM PST BY TMZ STAFF

The "victim" in the alleged Lindsay Lohan jewelry store heist just cashed in on the surveillance video and in the process may have really messed up the prosecutor's case.

0223_lindsay_leaving_BN_TMZ

The jewelry store -- Kamofie & Co. -- has been working with a broker for the last few days and the broker has been on the horn with numerous media outlets, salivating at the prospect of cashing in.

The video has been sold -- but it's causing fits for the lawyers in the case, particularly the prosecutor.

Lindsay's defense is that the necklace was a loan ... the jeweler begged to differ. So intent is critical, and if the jeweler is called to the stand and admits this was just a convenient way of scoring some quick cash from the media, Kamofie will have about as much credibility as (insert favorite celebrity who lied in "comment" section).

We know lawyers in the case have been in touch with the people at Kamofie, trying to dissuade them from selling the tape ... to no avail.

No word on how this will affect plea bargain negotiations. TMZ broke the story ... in the next few days, Shawn Holley, Lindsay's lawyer, and prosecutor Danette Meyers will meet in chambers with Judge Keith Schwartz ... sources tell us Holley is trying to get the judge to commit to a short jail sentence if Lindsay cops a plea.

Stay tuned ...

I always thought it was a set up. LILO has now become a target for these attention seeking vultures, unfortunately. She has made certainly made some bad choices but the court of public opinion and the courts of law have certainly made her out to be sooooo much worse of a person than she really is.

The jewelry store has basically stolen from Lindsay, using her unauthorized image to sell a video.

When you sell a video using a person's likeness, that person is entitled to compensation -- else, you cannot use their likeness (witness blurred images on reality TV or those who refuse to sign the waiver).

In fact, the value of Lindsay's likeness in that video is far greater than the necklace. She should sue the jewelry store.

Errrr, it's a surveillance tape allegedly showing her committing a crime, NOT A pap photo. But I wouldn't be surprised if the little ho and the Trollhans haven't already thought along those lines.

@lou

The 18 days was speculation on TMZ's part and not fact. She might not of have accepted the plea deal and chanced going on trial with the possibility of going to prison for a maximum of three years. You just don't know what could of happened?...This might change things for the good or for the bad. I definitely think the owners should of waited until after this case was settled.

Seriously looks like Lindsays people got to the jewelry store If she "pays" them for selling the tape, she is off the hook and they get money from her and for selling the tape. Win-win for both parties. She never seems to have to ante' up for her actions.

If her family was behind the purchase of the tape, would they want it to be aired? It's going to either destroy or seriously impact her ability to make money in the future. Of course, they may already have figured out that she's virtually unmarketable, so decided to cut a deal.

But would the store owner sell the tape to Camp Trollhan?

If you put aside even my objections raised above, would the Trollhans want to show the world that Lindsay is a thief? Wouldn't they want to protect her reputation even a little tiny bit?

Yeah, I know, it's the Trollhans we are talking about here. What the heck am I thinking?

Does that mean that every pap that snaps a pic owes the celeb a fee? Every surveillance video shown on the news of a bank robber needs to blur his face?

Your theory does not hold water.....

@Howdy
The 18 days was not speculation as non violent offenders are only serving 20% of their sentence because of overcrowding. She wouldn't even serve 18 days as the sentence automatically gets reduced by 33% to factor in good behavior.

With this latest development Lindsay can avoid becoming a felon as if she takees it to trial she will win.

Bottom line, there was no 'loan' paperwork' as required by the store.

Lindsay is a troubled soul, but I honestly don't think she stole the necklace. She talked to the store owner for an extended period just before leaving, with the necklace on in plain view. It seems like she is guilty of not being the sharpest knife in the drawer, but I don't think she would intentionally commit a crime so close to the end of her probation. I hope this does derail the prosecution's case, because I think the LA legal system is on a witch hunt where Lindsay is concerned. They'll be arresting her for burping next. She should move out of LA - seriously.

Lindsay consistently screws up prior to her probation coming to an end. That's why she's still on probation. It's part of her pathology.

Good for the store owners trying to recoup some of the lost income they've incurred due to the Lohan's dragging their name through the mud!

This is exactly the first thing that came to mind for me, too. We shall see soon. I don't think it'll be that big of a deal breaker.

She walked out with the goods, wouldnt return it, wouldnt answer the stores calls, they called the cops.

LiKlepto, is this the behavior recommended for someone on probation?

Nicole -

IMHO, this necklace case... in the overall scheme of things... is not important. She may or may not be a felon... she may or may not get jail time.... she may or may not be put on some long term or short term probation.

Not important really...

What IS important... and what you fail to understand...

is that Lindsay needs help. She is an alcoholic and drug addict. She is a thief many times over. She is a chronic liar. She takes no responsibility for her actions. She expects her attorney to get her out of everything unscathed.

Unless she takes her sobriety SERIOUSLY because SHE WANTS to be and stay sober......

Unless she gets long term psychiatric counseling for her many issues......

Unless she is willing to take responsibility for her actions and accept the consequences of those actions.....

She WILL be a felon and she will serve a long time in jail and eventually prison.

I just hope that she doesn't hurt an innocent person when she commits her next crime. I think the biggest danger to having Lindsay Lohan walking around free is that she will drive while impaired from either alcohol or drugs (or both) and will kill or seriously injure an innocent person.

If she does, then not only will Lindsay be guilty, but morally so will her family, friends and other enablers and... the justice system in CA for not stopping her earlier.

I have long advocated for mandatory revocation of drivers license and mandatory jail time for a FIRST DUI. And harsher sentences for subsequent offenders.

People who drive while impaired are no different from someone taking a gun to a street corner and firing randomly......

Think about it. I've asked you before and you have never answered.

Would you risk standing in the middle of the street with Lindsay Lohan heading straight for you in an automobile and trust that she was sober enough to stop the car before hitting you???? I sure wouldn't.
