Oksana Will Sue Mel

3/12/2011 11:30 AM PST BY TMZ STAFF

Oksana Grigorieva will file a civil lawsuit against Mel Gibson ... this according to Oksana's lawyer.

0309_oksana_TMZ_EX2

TMZ reported on September 16, 2010 -- just after Oksana hired Daniel Horowitz -- Oksana would file a lawsuit alleging battery, emotional distress and defamation.

We spoke with Daniel Horowitz and asked if Mel's no contest plea in any way changes her plan to sue. Horowitz said, "Our position hasn't changed."

Mel's plea bargain won't help Oksana in a civil lawsuit, because Mel did not admit to guilt.

I disagree with you here. If he can work out a settlement in which she has "something to lose" by going back to ask for more, he can ultimately put a stop to her demands.

Yes, Mel is the master of private behind the scenes viciousness ... we will see whether the courts agree with your theory that he or his team did not make any of his libel or slanderous defamation public.

Just because Mel "owns Malibu" and the Sherrif's deparment does not necessarily mean he can control all others from rightfully defending themselves from him and pursuing justice.

Mel's going to have to throw some money at this woman or she'll be a thorn in his side forever.

If she's desperate for cash and he doesn't come through, she'll sell her story to one of the weeklies. That's the last thing he needs.

The lawyers should hash out the cost of her silence and be done with it.

Yo, you obviously just love to hate so there's no point of trying to debate with you reasonably. Mel has kept his mouth shut and yet you accuse him of slander and libel? WTF is your problem?

Your legal theories are interesting, Midwesterner. Mel is certainly good at the most vicious slander and defamation and then saying it was not meant to be public, very clever. We shall see what is considered defamation.

You just don't understand that slander and defamation are based on destroying public image. That's what she did to him, not the other way around.

Furthermore, you need to look at the DA's official statement about the extortion charges: he didn't say that the charges were without merit or baseless; the official statement was that the DA didn't think he could get a conviction on the available evidence.

You still haven't shown Mel defaming Ox or slandering her. When Do you think this happened?

Shocker, that's just the first thing that popped up on Google. It's not my job to compile evidence for Mel and Oksana's court problems ... I was just showing you guys an example.

Team Mel are the ones who like to compile reams of so-called "data" (like Sam spammed on the other thread for hours) ... they have whole web sites devoted to their anti-Oksana "research" and further defamation.

Good luck with all that.

So the piano player is going to go ahead and sue Mel. Well, of course she is. We knew Mr. Horowitz and her handlers would want her to, since she owes a ton of money and has no way to pay.

With right around $3 Million dollars in billable hours due to her first 40 attorneys right now [not including Mr. Horowitz's ever growing tab, her original attorney's bill for the mediation, and after deducting the small percentage Mel will have to pay] she's going to have a lot to think about.

She has already sold her lies, several different versions, to all the tabloids.

Mel has nothing to lose now !!
I hope he doesn't give her a dime AND now he can tell the REAL story of what happened.

Dimes, it would be cheaper and more effective to put a hit on Ox. She won't be able to trap another rich man, so she'll never let go of Mel.

Mel can't tell any stories and won't. That's why he hasn't. The cohabitation agreement prevents this.
