Sue Me, I'll Sue You!

Mel Gibson will sue Oksana Grigorieva for extortion if she dares sue him ... this according to sources close to Gibson.

As TMZ first reported, Oksana still plans to file a lawsuit against Mel, alleging battery, emotional distress and defamation.

But sources close to Gibson tell us he will wage legal war if Oksana files -- and will NOT settle out of court. In fact, we're told Mel will gladly file his own lawsuit against the woman he says put a $15 million price tag on the tapes in return for keeping them secret.

Looks like this battle has just begun.

Alec Baldwin successfully moved on from his humiliating voicemail. Mel can do likewise, but he'll have to sit on Barbara Walters' couch and bring a tear to his eye talking about the lowest point of his life.

This is really a good article. I am so glad to read this. This woman thinks she can just run roughshod over Mel and I am glad he's letting her and her attorneys know that he will NOT settle out of court. There was also discussion about this yesterday, and I did not think he would settle out of court. Also, in his pleading before the Court, he was clear that he would not be liable to OG for anything. That to me was an early indication right there that he would not be handing any money over to OG freely.

You know I would love to see it come down this way, but it still may be only circling around in anticipation of negotiations.

More than anything else, I want him to sue to expose what she did to him with the tapes and the extortion overall. Obviously, he can't win any money from her, but wouldn't there be a way that if he sued and won, he could take away her incentive to write a book--because the proceeds of the book would only go to "lowers"?

LOL! I hear you, but you can't negotiate with the devil. OG has run roughshod over Mel (and the courts for that matter) for many months now. It's time once again for Mel to face-down this woman. I'm glad he is. He's not starting up the civil lawsuit, but he's saying 'I'll finish it, if you do.'

The confidentialy clauses in both the mediated agreement and the cohabitation agreement are keeping OG from writing a book, going on speaking engagements, etc. Those are keeping her in her place and she's having a fit about it, and that's why she wants those agreements set aside. Mel's lawyers have really looked after him.

Also, he has an option to sue her according to those confidentialy clauses. It doesn't mean he will, be the option is his. How's that for hanging something over OG's head for a change?

Did anyone ever figure out how she planned to sue for "emotional distress"? There is simply no way he "defamed" her. And battery is questionable also.

So maybe he took the deal with a nolo contendere plea just to get on with this?

I can certainly see the advantages of paying her off and going on with life, but I would love it if he made a stand here.

So she can do***ent that she pulls out her own hair. How can you do***ent that Mel was the cause of this? And how much emotional distress can occur in six months, for pity sake, when you are walking along the red carpet with the man.

It's seems to me that all the Ox eggs are in one basket that's held by Garbus.

Middie -- on the confidentiality clauses, they do apply in this case. Absolutely. Those confidentiality clauses are very important, and again, it's is my belief that this is why OG wants those agreements set aside.

Confidentiality clauses were a big part of the McMillan/Palmer case. Horowitz and Garbus were the attorneys for McMillan. They lost that case.

The attorneys for Palmer were successful in having the confidentialy clause set aside and used First Amendment arguments to do that. What is the speciality of Garbus? First Amendment law. That's why he was brought in. Add in the fact that he and Horowitz both represented McMillan and lost, they salivated at the chance to try a similar case and hopefully win this time.
