Jimmy Buffett Sinks Teeth Into 'Tiger Blood'

3/18/2011 1:20 PM PDT BY TMZ STAFF

Jimmy Buffett is trying to capitalize on the Charlie Sheen phenomenon ... the prince of 'parrot heads' just filed papers to create a drink called Tiger Blood.

According to documents filed with the United States Patent and Trademark Office and obtained by TMZ  -- Margaritaville Enterprises LLC, owned by the singer, filed two applications on March 15 to trademark "Tiger Blood" for use in vodka and energy drinks.

As TMZ previously reported -- Tiger Blood is Charlie Sheen's codename for his mangosteen-infused fruit smoothie,  Xango juice.

Interesting ... if Jimmy's application goes through, Charlie won't be able to capitalize on what he made famous -- but then again, there's more to life than vodka and energy drinks.

Exactly what I was saying here at TMZ several days ago....If Charlie was at all as smart as he seems to think he is - and/or had truly competent business people in his Korner - then he would have trademarked his catch phrases right out of the chute. That, people, is (part of) how a brand is built.

Right now, branding himself is Charlie's best bet. He seems to be attempting to do so with his t-shirts, etc. He is just not doing an especially good job of it. While he will generate some revenue he will also let a lot more slip through his fingers. So much for having a rocking "master plan".

And, btw, the trade mark process is FREE unless/until the process is taken through formal registration. Even a free trademark will secure intellectual property rights. Without a trademark or a copyright - whichever is appropriate to the situation - no one stands a chance in a legal battle. In other words, intellectual property "rights" aren't simply inherent - they have to be established - otherwise "losing".

I lost all respect for Jimmy Buffet when he sued those women who opened up a hamburger stand in Hawaii called Cheeseburgers in Paradise when there was NO trademark on the name. He cost them several hundred thousands of dollars in legal fees and they finally had to settle with him. But now it seems it's okay for him to use whatever he wants. Double standard at its best.

Jimmy you are an azz and will be to all your fans for doing this.
Capitolizing off of Charlie, off of Charlies catch phrases, its his thing his notariety, and the way to promote himself for the rest of his life, and always will be, tigerblood and anything tigerjuice, drink, shirts, etc.
If you ever called him a friend that sucks that you would make money off of him, and if he isnt a friend its still sucks to make money off of something else someone else created because you havent.
If you arent creative then pay someone to creat your own name idiot.

Charlie I expect you to fight him on this as there is not one person in the USA who does not see you as TIGERBLOOD, TIGERJUICE, or any kind of TIGER. One Petition from the people of the USA will take care of this small, very small problem of a money grabbing poor man.

**One fan who knows just how SMALL Jimmy is :)

Q: What does a seat at Charlie Sheen's concert have in common with a seat on an L1011?
A: Lots and lots of elbow room!

Sheen will be dead by the end of the year in a drug crazed frenzy...only two questions to ask, will his coffin be torpedo shaped...and will he hear how hard his "fans" are laughing at him in hell?

Vodka in energy drinks? That's stupid. Alcohol is a depressant. So they are mixing uppers with downers, which means it all cancels each other out.

Susie, step away from Charlie's crotch and wake up! MOST of the USA is already sick of this wacko! If he wasn't smart enough to trademark it first, tough on him!

OK ----- some legal info---Doesn't matter who files for Trademark--ownership goes to the first one that used the phrase in commerce. Charlie wins this if he chooses.
also Sheen can contest it when it is posted for objections before Trademark is official
Two swipes at the apple for Charlie.

"trademark rights don't begin at the moment a word, symbol, or phrase is first scribbled on paper. Rather, trademark rights stem from the actual use of a distinctive mark in commerce."

Sorry, Charlie. You're wrong. I just looked this up! Rambling the words "Tiger Blood" over and over again does not make that his. Just saying it is not using it in commerce. If Chuckles had put it on anything he was selling first, yes, he has the rights but............he hasn't. If Jimmy beats him, guess what, the whack job called Sheen.......Losing!!

Buffet might have another reason for the "Tiger Blood"........after all, he learned to play the guitar while attending Auburn University didn't he? Maybe he has Tiger Blood himself, Auburn Tiger Blood that is, and nothing to do with Sheenless.
