Lindsay's Tea Maker -- We Don't Make Booze!!!

Lindsay Lohan's special fermented Kombucha tea does NOT legally qualify as alcohol -- and therefore should not be used against the actress in court ... this according to the tea maker.

TMZ broke the story ... the L.A. County Probation Department believes LiLo violated her probation by drinking the tea, because it contains a very small amount of alcohol ... 0.5%.

But the guy who owns the company -- GT Dave -- tells us it's a "ridiculous" move because "it's like punishing Lindsay for taking a dose of cough syrup or a small amount of vanilla extract."

GT says he personally warned Lindsay about the microscopic alcoholic content of his drink last year -- and Lohan assured him she cleared it with her legal team and probation officer, even referring to the drink as a "non issue."

We'll have to see if the judge agrees.

I guess that's why the probation department just broke it down as "Lindsay is drinking again" because that alcohol in her system came from somewhere and if it wasn't the tea all that means is it came from something else.

Would it surprise anybody to learn that Lindsay lied?

Why can GT Dave get away with having alcohol in his drink without paying alcohol taxes? Even his new "Enlightened" stuff has more than 0.5% alcohol in it. And I don't believe the sugar level. It says 2 grams!!! I am a hobbyist wine maker, and using a refractometer and calculating out the "brix" to find the grams of sugar, some of his Kombuchas are more like 14 grams per serving. I just don't believe it.

Most people don't drink gallons of vanilla extract and cough syrup, HOWVER alcoholics are supposed to avoid cough syrup with alcohol. Lyndsay should know that.

I'm glad this guy with the company cleared it up, being he's in charge of her probation and all.

This story is not really about alcohol, tea, or sending Lindsay to jail. It is about Lindsay Lohan and her continuing efforts to lie, manipulate, cheat, and steal to get what she wants. Do you normally run YOUR brand of tea by your lawyer for his approval? Of course not. There's a million alcohol-free bands out there if you want one. This is another piece of the puzzle of who Lindsay Lohan really is.

Peoples' hate for Lindsay is stronger that their logic, unfortunately. This is such a joke.

This is not a ****tail, it's just a soft beverage.

And by the way, if you're confused by the vanilla extract comment:

"Vanilla extract is a solution containing the flavor compound vanillin. Pure vanilla extract is made by macerating/percolating vanilla beans in a solution of ethyl alcohol and water. In the United States, in order for a vanilla extract to be called pure, the U.S. Food and Drug Administration requires that the solution contain a minimum of 35% alcohol and 13.35 ounces of vanilla bean per gallon. Double and triple strength (till 20 fold) vanilla extracts are available."

If you're going to nitpick the contents of this tea, then you're going to have to nitpick ev-er-y-thing. Sorry, but that's just ridiculous.

And the guy with the poppy seed comment, you are wrong. Mythbusters took that on: a positive reading on a drug test can come from eating a normal amount of poppyseed products.

I agree with other posters. What is so special about this tea that she would fight to keep it in her life? If the probation department says no alcohol period, then thats it, period! There are so many other drinks so why cause a fuss? I can just imagine how she plots and rants that she will do what she wants to do. Pretty soon she will be doing what she wants to do in her cell. Should I go over here, or sit on the floor over here? I predict in jail she will also have a phony medical issue just so she can gain sympathy from the jail and the world that is now unsympathetic to her "me cause", "cause I'm Lindsay Lohan". She has zero respect for anything, especially her own life. Be careful world, Lindsays next chapter is chapter 13.

Dave - while most people have NO problem with a .05% alcohol content, in the judicial system, and while on PROBATION, if it is detectable by a pee test, and or blood test, it can be considered a violation. The RULES for ANY ONE on PROBATION, especially alcohol (DUI) or drug (Possession) is STRICTLY PROHIBITED from CONSUMING ANY BEVERAGE that contains ANY and ALL ALCOHOL CONTENT! So much so to the degree that PROBATION OFFICERS detail that you are not to gargle any MOUTHWASH with alcohol in it.

This one is a tough sell. The RULES for EVERY CRIMINAL ON PROBATION (LOHAN) APPLIES TO EVERYONE! There is no you can and you cannot, RULE! So if the DA decides that LOHAN violated, the matter would first go through her Probation Officer being talked to by the DA and Judge and then they will have to determine if she is in VIOLATION. To be fair, Lohan has a HISTORY of trying to play by her OWN Rules while on PROBATION, she continually plays the CELEB-VICTIM card and these JUDGES (Schwartz/Sautner) are not going to allow her to keep doing that or setting her own rules! So in this case, if she is violated - it will be because she told the truth, but if the RULES SPECIFY that you are not to consume ANY BEVERAGE with ANY ALCOHOL CONTENT, she is in violation. Those are the RULES and she is not doing what the RULES of her PROBATION require! That is a VIOLATION.

the only thing one should be mindful of is if they are in a religion or are part of a AA program which prohibits any form of alcohol... I know a few recovering alcoholics and each one of them have different views so it is a personal thing.. but
from a legal perspective anything under .5% is not considered labeled as alcohol.

Lindsay knows that ANY amount of alcohol in anything, is prohibited. The Courts clearly state that to every probation person, that Nyquil & any other cough syrups, mouth washes, toothpastes containing alcohol is strictly prohibited. Dumb.

I've been drinking this same brand of Kombucha tea for years. You can get it at Famima or Whole Foods in LA. It has about as much alcohol as vinegar. It's actually fermented tea; it has bubbles from the fermentation process, and it is pretty good for your health.

Hey #55, how does it get so much bubbles from fermentation? Wouldn't it have to ferment a ton to have that much Co2? I make beer with my buddys and we cant ever get that much fizz and our stuff has like 5%-9% alcohol.... I thought that stuff had Co2 injected into it like soda

Such bull shot. AA has no such prohibition against this. AA's only requirement is that you have a desire to stop drinking.

People who are recovering alcoholics working a strong program of recovery wouldn't get near that stuff.

Why in the world would they take that risk? Head down to your local AA meeting and ask if anyone would even consider drinking that, But you know the answer already.

There are thousands of sort drink and juice choices to choose from and she picks the one that is confirmed to contain alcohol. She is not ready to quit. She is still trying to drink and get away with it..
