Lindsay Lohan -- Attempted Retail Robbery Victim!

Lindsay Lohan faces grand theft felony charges for a necklace that we found out was marked up 300%!!!

TMZ has learned the necklace designer sold Kamofie & Co. the piece for $850 -- that price tag does not qualify for felony grand theft, which requires a value of $950 or more.

Kamofie was trying to sell the necklace to Lindsay for $2,500 bucks.

As we first reported, we're told Lindsay's lawyer, Shawn Holley, will argue the D.A. should only be allowed to charge her client with a misdemeanor because of the value of the necklace.

But even if Holley loses that argument, Kamofie's owner -- who we're told will be testifying at Lindsay's preliminary hearing -- is going to have a PR problem for the mark-up and for selling the surveillance video and shopping a book deal.

I swear some people are so gullible. You are charged for the retail price, not what the store paid for it. If that were the case, think of all the previous cases that would have to be retried.

And, as far as the markup goes...
As I've stated previously... the designer of the necklace is Pratima Sethi and the line is called Sethi Couture. You can find it at many boutique jewelry stores throughout the nation. Here is a link to a necklace very similar to the one that Lindsay allegedly took, and as you can see, this jeweler in Texas sells it for $2409.00

DUH, when you steal something they don't charge you with the wholesale value. Mark-up is typically 100-200% -- welcome to retail.

You meant the injustice of July 6th I have to assume. When she's sent to do hard time on the parole violation while awaiting trial, what is the name for that day? Better yet, what will be the name of the day she's found guilty on felony grand theft charges? Meyers is not going to go in there without the evidence and witness testamony and lose. She's that good. I don't have the energy right now to go back and get into all of this Lindsay stuff, but she has a lot going against her. Face it Nicole, and every other family member on here, you can read all of Harvey's pro Linds stories and jump right on them and try to spin them, but the fact is Lindsay Lohan is the most dispised person in the country right now. For God's sake, Betty White is even disgusted with her. It's obvious she has issues if Betty White starts to notice. And it's not exclusively to comments made here. I read comments on tons of other sources and nobody likes her. 9 out of 10 just want you to all go away, and that's putting it nicely in G rated form. Eventally this year Lindsay will be dressed in orange washing police cars, mowing lawns, and eating box lunches in Lynwood awaiting trial. Good luck Dina.

There's no way a judge will let the trade value of jewelry be used to draw the distinction between felony grand theft and misdemeanor theft. They'll stick to the retail price. The reason is that a large markup is quite common in upscale shops and jewelers. Rich people are ripped off regularly. Legally. Many of the chain stores are worse than boutique stores.

Setting the precedent that something is a misdemeanor, not a felony, because of its trade value (rather than retail value) would provide an incentive for criminals to steal certain goods because the trade value is below a felony, but their retail (and therefore fence) price is higher. Creating a loophole.

As it happens, I think this whole case is dumb and a waste of time given the item was returned. At most, if a buyer was lined up, they lost a potential sale. From that perspective they have been robbed a potential sale. I don't think prison helps many people and this isn't the crime of the century, just really, really, air-headed and dumb.

She should have scratched the money together to settle with the jewlers before law enforcement got involved. But on this specific point regarding retail vs. trade prices I don't think her lawyer stands a chance because of the potential loophole.

This IS standard practice for most jewelry stores. My mom worked in jewelry stores for years. They will always mark up items 300%, it is how they make their money. If you go to a smaller, lesser known store you can bargain with them to get a cheaper price. Always go at the begining of the month to get a higher discount because they have the rest of the month to make up the difference. This is nothing new or surprising to me, people should never pay retail price for jewelry!! With that said still doesn't make it right to just take something without paying at all.

@ilovegossip what you cited is gossip and gossip mentality.

Lindsay could be recast as another child star that had a series of events that have her floundering---and not a "train wreck". That terminology is gossip speak, not of positive people looking to find insights of what happened to her and having good wishes for her to turn things around.

This is the same mentality that calls Miley Cyrus a "wild child". Miley Cyrus, a young woman that represents so many charities with her time.

Young women empower yourself. There are forces that like to revel in your missteps and judge you. Live your life but seek out those to help you if and whe you self-destruct. Lindsay's problem is she isn't seeking out the help and following the course. Hopefully, she will some day, she's taken some small steps.

You know that if Lindsay is sent to jail she will actually be serving the likely 6 month probation violation sentence right ?

She won't be remanded without bail she will be sentenced to 6 months and do 24 days max and be free until the trial.
Also Lindsay gets put in solitary confinement so she will just be serving the time and won't be on work release or anything.
