Lindsay Lohan Sentenced to JAIL!!!

4/22/2011 8:25 PM PDT BY TMZ STAFF

Judge Stephanie Sautner just threw the book at Lindsay Lohan for her probation violation, sentencing her to 120 days in county jail!!!

Lindsay Lohan Jail

Lindsay has been remanded into custody and taken to the basement of the courthouse for booking.  Lindsay's lawyer has said she'll appeal, which means Lindsay is entitled to post bail.

Lohan was also ordered to complete 480 hours of community service -- 360 of those hours must be performed at the Downtown Women's Center, so Lindsay can see how needy women have to live.  The remaining 120 hours will be served at the L.A. County morgue.

Judge Sautner explained that Lindsay should have called the store and notified the owners about the necklace sooner.  She waited several weeks and returned the necklace after finding out the cops were about to raid her house.

Sautner seemed influenced by the surveillance video, which she saw for the first time in court today.  Sautner agreed with Danette Meyers, who argued Lindsay used her friend Patrick as a decoy to distract the clerk.

Has Lindsay Lohans’ legal right of innocent until proven guilty been violated?

It is patently absurd that Judge Stephanie Sautner sentenced Lindsay Lohan to 120 days in jail for “violating her probation by taking a necklace from a jewelry store” and then set a trial date on the misdemeanor charge of stealing the necklace for June 3 and a pre-trial date for May 11.
Judge Stephanie Sautner has obviously violated Lohans’ legal right of innocent until proven guilty.

Lohan’s being sentenced to 120 days in jail before the trial on May 11 and June 3 was based on the assumption that Lohan’s act of wearing the necklace out of the store was a criminal act that violated her probation. However, the fact is that it has not yet been established in the court of law that her act of wearing the necklace out of the store in plain sight of the store owner was an intentional criminal act of stealing or an innocent act due to tacit agreement that she would return to the store next day to buy a ring and pay for the necklace as store owner Sofia Kaman admitted to be the reason why she did not reported the necklace stolen on that day.

It is wrong for Kaman to falsely accuse Lohan of stealing the necklace when she had tacitly allowed her to leave the store with it based on the promise that she would return to the store to buy a ring. The fact that Lohan failed to return the next day to buy a ring and pay for the unpaid necklace, possibly due to her damaged memory resulting from alcoholism, could not change the fact that Lohan’s leaving the store wearing the unpaid necklace in plain sight without interference or objection from anyone in the store after telling the store owner that she would return the next day to buy a ring was indeed an innocent act under tacit agreement between her and the store owner. Breaking a promise due to defective memory is not a crime.

The store owner should have given a phone reminder to Lohan the next day that her necklace was not yet paid for and that she said she would return to buy a ring instead of reporting to the police falsely accusing Lohan of stealing a necklace from the store.
Lohan did return the necklace to the store when she realized the trouble she was in due to her mistake of not returning to the store the next day.

Judge Stephanie Sautner has already assumed Lohan to be guilty by sentencing her to 120 days in jail related to her being accused of stealing the necklace even before her trial related to the same act. This not how justice should work. The judge’s wrongful act is a blatant violation of Lohan’s legal right.

It is deplorable that our justice system is being undermined by an insidious movement of bashing white celebrities and indulging black celebrities. That’s why we saw black celebrities get away with rape and murder by buying a way out with the so-called out-of- court settlement in rape case and playing the race card by claiming racial discrimination against black to escape from justice in murder case when the victims were white while a white celebrity like Lindsay Lohan who refuses to admit having committed a crime she did not commit is being persecuted to the full extent allowed by fouling of the law.

Putting someone on trial for an alleged crime while the person has already been convicted by a judge for anther offence based on the assumption that the same person is guilty of that same alleged crime is not only a travesty of justice but also a mutual contempt of the two courts.

Lindsay Lohan’s legal right of innocent until proven guilty must be upheld.
The sentencing of Lohan to 120 days in jail by Judge Stephanie Sautner for “violating her probation by taking a necklace from a jewelry store” must be overturned before Lohan is put on trial for the alleged crime related to the same act.

The court simply cannot give Lindsay Lohan a fair trial while she has already been convicted of probation violation by judge Stephanie Sautner based on the assumption that she is guilty of stealing the necklace.

Does judge Stephanie Sautner understand what Double Jeopardy means?

Working at the morgue should give her a first-hand feel for a place she'll be ending up in soon at the rate she's allowing her life to fall apart.

I am getting so outrageously fed up and tired of hearing and reading about all the woes of this no-talent, washed up "actress". The media should just let it go already. She is just a nobody nowadays and a complete sell-out. TMZ, when will you realize that hardly anybody gives a **** anymore?

What would the normal person get for a crime like this! Especially when they are probation from an early releaase and not to mention all of her priors. We the people are not apart of this in your face aristocracy!

Sad fact is she is just the small potatoes compared to the Billionaire who have robbed the Americans blind of their pensions, 401k's and hard earned tax dollars subsidizing the Multi-Nationals and Wall Street - While we oodle of this millionaire white trash junky

This young lady needs to do her community service IN PUBLIC and not sheltered away in the depths of the morgue. Seriously, picking up trash alongside the highways, painting fire hydrants, removing graffiti and weed-whacking the grass along the city's sidewalks are what she should be doing. A lot of humility and shame is what this gal needs. Let her hear the cat-calls, the derision, the whistles and such so that it creates a lasting impression in her drug-addled mind. Enough with the kid gloves!

REALLY, REALLY, HOW MANY HOURS WILL SHE SERVE THIS TIME? ANY BETS, I SAY 12 HOURS OR LESS BECAUSE OF OVERCROWDING, HOWEVER SINCE SHE IS A THIEF NOW, THEY MIGHT GIVE HER 23.5 HOURS. I BET THE OTHERS IN THAT OVERCROWDED JAIL WHO ARE SIMILAR TO LINDSEY IN THEIR SIGNIFICANT CRIMES SERVE AT LEAST HALF OF THEIR SENTENCES, BUT CELEB STATUS AND WEALTH OVER RULE THE POOR, EVEN IN THE CRIMINAL JUSTICE SYSTEM. I WONDER WHEN THEY WERE MAKING THE RULES GOVERNING THE CRIMINAL JUSTICE SYSTEM, DID THEY MAKE AN EXCEPTION FOR THE RICH?

Lohan on probation, commits a felony, and only gets four months and now she is trying to fight it. The spoiled brat should've gotten a year, picking up trash along the highway-like Cool Hand Luke.

So boring already...she's demonstrating antisocial behavior and is unlikely to stop since there are veritably no consequences. She says she is ashamed of her father but acts like him. Mother enables. Blah, blah, blah...
