Judge Rules Lindsay Lohan Violated Probation

Lindsay Lohan violated her probation by allegedly stealing a necklace, Judge Stephanie Sautner just ruled.

The judge ordered Lindsay to stand trial for theft, but reduced the charge from a felony to a misdemeanor.

Although Judge Sautner found Lindsay in violation of probation, she will not go to jail now.  The penalty will be determined after the verdict in the trial.

Per TMZ Live Updates:

"Judge Sautner says she agrees with Danette ... it seems there was intent behind Lindsay's alleged crime.

If it was a misunderstanding, Lindsay could have called Sofia to settle the matter ... but she never did."

I must be confused, because I don't know how to read the above statement from the judge as anything but informally 'ruling' that Lindsay's intent was to take the necklace.

Which is (in my world) called stealing/theft...

The judge seems to be saying, "yep, I believe she's guilty". Either that would be bad news for the outcome of the upcoming trial - OR - could Shawn Holley use this as "bias" and use it to her advantage.

Justice served or not, it sure doesn't make much sense (and doesn't appear to have been just imv).

Time to stop the madness. Hollywood stars need to serve full time in jail for breaking the law. This thief could have been filmed robbing a bank and they would never put her in jail. Regular people would go to jail for running a red light. Time to overhaul the legal system

facts:

the store people were distracted and didn't realize that the necklace was missing right away. only in lalaland

sofia tried to sell the tapes and being not good selling stuff didn't get da money. A jewlery sore owner not good selling? only in lalaland

Lindsay should come to NYC, sooner is better. Jewlery stores here are managed by real managers here.

punished. she is violated. she will go to jail for a while and be put back on probation and she still has to face a trial for theft.

This is confusing. The judge as much as agreed there was criminal intent, not sure what the opportunity is being offered here...

Sounds like there will be jail time ordered (be it a day, a week..)

Wonder if probation gets extended if found guilty on this. Anyone have a guess?

Well done Harvey for being right about the outcome. So it's a 'wobbler' felony. It sounds like very good news for Lindsay Lohan because the distraction theft with an accomplice thing seems like a red-herring, and not the best prosecution case. I would have thought there's plenty of reasonable doubt for a jury. I am not a lawyer though and could be talking out of my bottom.

I wonder if the outcome of the trial will have an effect on jail time Lindsay receives for violating probation? If she is found not guilty,is it a possibility that she'll get away with the probation violation?
