4/22/2011 6:30 PM PDT BY TMZ STAFF

Lindsay Lohan violated her probation by allegedly stealing a necklace, Judge Stephanie Sautner just ruled.

The judge ordered Lindsay to stand trial for theft, but reduced the charge from a felony to a misdemeanor.

Although Judge Sautner found Lindsay in violation of probation, she will not go to jail now.  The penalty will be determined after the verdict in the trial.

Hot Farts

marknyc 3 minutes ago Lindsay Lohan is a talented movie star: she should get out of LA as soon as possible and come to NYC , away from those clowns in lalaland . Look at this nonsense story here. Only in lalaland.

facts:

the store people were distracted and didn't realize that the necklace was missing right away. only in lalaland

sofia tried to sell the tapes and being not good selling stuff didn't get da money. A jewlery sore owner not good selling? only in lalaland

Lindsay should come to NYC, sooner is better. Jewlery stores here are managed by real managers here.

She's a Loser

This is crap. We, the average, hard working americans, who have afforded the celebrities to have their elaborate, spoiled lifestyle and attitude, do not get a break. Only the wealthy and the wealthy celebrities get away with everything. Obviously the law only applies to the working class not celebrities or they wouldn't get off just because they can afford the high priced attornies who are in bed with the judges. Our butts would have been sitting in jail. Yeah, the original charge may be 4 years old, but she has SNUBBED her nose at all the rules and broken every requirement and STILL runs free - she will never go to jail. Wonder who they're blowing. If these are the laws that are to be followed/enforced why do only the wealthy get away with breaking them. Only the wealthy will be free in this new/changing world we have created for them. STAND STRONG AND PUT THEM IN THEIR PLACE.

Well I guess we know why somebody like O.J. Simpson thought he could get away with murder: Because they can. Having status as a "celebrity" comes with a free pass to commit crimes.

So, this thing will be stretched out, and continued, and continued, then she'll be convicted and her sentencing will be continued, and continued, then they'll give her 6 months in jail, which will be continued and continued, and by the time Lindsay ends up actually going to jail, she'll serve something like 65 minutes and that will be the end of it.

I'm with Shawn Holly, if you know you're going to let her go, cut the crap and just dismiss the case, no need to make it a long dragged out joke on the public.

Anywhere else and anyone else... lifting a necklace like that would be a felony. So you can go into a store, steal something worth more than a month's wages for most folks in my state (if they're fully employed), and it's a misdemeanor? Who knew?

But maybe the judge knows what she's doing - she sure doesn't seem to be convinced that Lindsay is Linnocent. Maybe it will be easier to get some real jail time or tough probation or whatever options they have to get LL's attention for a misdemeanor, especially considering the high-priced lawyer on the case. And maybe juries are more likely to convict on misdemeanors. Felonies like this can turn into misdemeanors eventually if the person keeps their nose clean for a certain amount of time, so it's not as though she was going to be a felon for life over this one anyway. We can only hope that all this fuss at least has convinced her to keep her sticky fingers to herself, although shoplifters are tough to convince. At least it's out in the open - which means people will be cautious around her, and also therapists will want to deal with her habit (especially if the court has any say in the matter). And if she does get caught again - she'll have a record and the next time won't be easy.

Maybe the misdemeanor will make Lindsay more willing to do a plea deal. My guess is that if this goes to trial, real people on the jury are going to take a good look at the whole surveillance tape etc., listen to the store witnesses (who will be quite effective, they're probably too ticked with LL's nonsense by now to be timid), and know that she's not only "Guilty! Guilty! Guilty!" but that she knew what she was doing and was playing the clerk and the owner like a couple of fiddles. There's also bound to be people with some experience with shoplifters on a jury, knowing how they operate and how often they do it without getting caught. Unless the Lohans actually buy off a juror - her teflon suit won't help her much with a jury.

I don't think Lindsay is anywhere near out of the woods yet, so she shouldn't celebrate prematurely. It will be interesting to see what happens at the next probation violation hearing, since she's racked up quite a list so far. With her history, the judge is not very likely to give her a bunch of chances on the probation violation. Anywhere else, anyone else - she'd be sitting in jail waiting for her hearing right now.
