Lindsay to Plead No Contest to Theft

Lindsay Lohan will plead no contest to the misdemeanor theft charge she faces over that pesky necklace ... sources connected with the case tell TMZ.

We're told Lindsay is committed to what she told Jay Leno this week -- that she wants to accept responsibility and move on with her life.

So Lindsay and her lawyer, Shawn Holley, will go back to Judge Stephanie Sautner as early as next week to enter the plea. 

Lindsay has already been sentenced to 120 days in jail for the probation violation, along with 480 hours of community service. Sources tell us Lindsay and her lawyer are banking on Judge Sautner not adding additional time on the theft charge. In other words, when Lindsay serves her 120-day sentence, that would be the end of it.  And sources familiar with the case say that would be a routine disposition.

L.A. County Sheriff's spokesperson Steve Whitmore tells TMZ his rough calculation is that Lindsay would serve three weeks, although there are variables to that.

We're also told the L.A. County District Attorney is inclined to give the case to the L.A. City Attorney, since the D.A. typically prosecutes felonies and the case is now a misdemeanor.  But now that Lindsay will plead no contest, it doesn't make a lot of sense for the D.A. to kick the case to the City Attorney.

Holley could not be reached for comment.

Maybe the judge has other ideas? Like throw the book at her? Lindsay is a PITA and deserves no special treatment... Surely the judge has seen enough?

What makes you so *absolutely* sure that Judge Sauntner won't apply "no early release" on this sentence? She has the authority to, yes? So then, what's your basis for your statement.
I guess she finally realized that she WASN'T going to win at trial, so she finally found a plea deal ok to do?! Of course it will be, "....even though I did NOT steal that necklace, I decided to talk the plea deal so I could get on with my life.". Eh......pfffft!
No contest- I have charges against me and I'm not going to challenge them. (course if I was *really* innocent, I would fight it tooth and nail to the bitter end!)

Remember Judge Fox threatened Lindsay that IF she violated probation again most likely by relapsing she would get " 6 months with no early release" well that's all it was a threat
The plea deal that Judge Schwartz offered 3 months was 100% factoring in overcrowding as realistically with the budget crisis and overcrwoding problem no Judge can dictate when the Sheriff releases someone.
That is also why the D.A was so pissed that Lindsay only got 120 days as she wanted 180 days because it was her 3rd violation and she knew she would serve less than a month.
Also the Judge sentenced her on Friday 22nd and set the pretrial date for May 11th(before she was sentenced to 120 days
) along with the 12 weeks of community service which she has a year to do. The Judge probably knew she would be free in less than 3 weeks more likely 2. Also she set the progress hearing (community service enrolment and progress) for July 21st when she just sentenced LL to 3 months most likely knowig she would be free in May(if she hadn't bailed out).

No matter how you cut it, she will be a convicted THIEF! A THIEF that will steal from companies, strangers, friends, and basically anyone she feels like stealing from. Thieves are among the lowest forms of scuz around! Now add all the other stuff she's arrogantly done and she is even lower than a common thief! Enjoy jail, ho!

She did more than INTENTIONALLY steal the necklace.

She PRE-PLANNED with an ACCOMPLICE and set-up to steal the necklace.

She should get supervised probation at the very least, if there is any justice, or if anyone cares about her rehabbing and her career.

You enablers DO NOT CARE about Lindsay, only USING her, ESPECIALLY NICOLE, you HATER NICOLE!

The ONLY people who care about Lindsay want the ENABLING Crimehands family crap to stop, and Linsday to be forced to deal with reality and get real help. This means both accepting responsibility and dealing with cleaning herself up, or she will die like Charlie Sheen will.

If you gave a rat's ass about Lindsay you would want her to have to deal with reality, face consequences, and actually get clean so she won't end up like Charlie Sheen.

@Nicole. the vop will be one set of punishment. and her pleading no contest is another. that gives the judge the right to add more jail time and more probation. I think patrick was going to turn evidence so he would not be arrested for being helping her steal that necklace. meyers only put a few people on the stand. in trial she would have put alot of people lindsay as ripped off in the past the jury would have wanted her head. Lindsay is going to jail real soon, so she wants to serve both crimes at the same time that might not happen the judge hates her. just woke up i might have a brain cramp

@nicole. you said she has been punished for the VOP. when she waited to the last minute to send Holly down there to register her. she has not been to jail yet. in my eyes lindsays words are puffs of air. read d listed, on the 25 she was high and drunk in a mens bathroom looking for her dealer Andrew, She opened up stalls on men and would not leave. linocent as jeff dahmer

This is a good example why the criminal justice system needs to be overhauled. Putting a woman in jail for such a petty little crime is a joke. California is already bankrupt and the tax payers have to pay for all these joke trials and joke incarcerations. I don't care if people hate Lindsay. That's their problem with her. It's a joke to want to put her in jail for this.

It's not like she broke into the store and robbed them or held a gun to their head and say "give me that ugly necklace, pronto!"

She didn't beat anyone up. She didn't kill anybody. She didn't have sex with kids, which is clearly now required of priest. She didn't sell bad heroin to a bunch of kids who overdosed and died. She didn't make any bomb threats or make any explosives... See where I'm going?

Can't seem to muster up any respect for her, try as I might. All she's done is manipulated the system (that's what lawyers are for, I guess) and admitted that she's a thief. I don't see how this equals a person worthy of admiration. As far as her "ready to take responsibility" statement, that has nothing to do with a court order.

Former Olympic champion Audley Harrison claims he had an encounter with Lindsay Lohan over the weekend at Chateau Marmont ... while he was "in the toilet."

Harrison tweeted the above on his Twitter account. A source inside Chateau tells X17online exclusively:

"Lindsay was acting so crazy. She was drinking vodka and Red Bull and kept going in and out of the men's bathroom every ten minutes. We were all totally creeped out. She ... kept banging on the men's cubicle door calling for some guy named Andrew. It happened to be the pro boxer Audley Harrison. He came out of the bathroom and was telling everyone about it and laughing at her."

This past Friday, Judge Stephanie Sautner sentenced the starlet to 120 days in jail for violating her probation. However, she only served 5 hours after posting $75,000 bail.
