Lindsay to Plead No Contest to Theft

Lindsay Lohan will plead no contest to the misdemeanor theft charge she faces over that pesky necklace ... sources connected with the case tell TMZ.

We're told Lindsay is committed to what she told Jay Leno this week -- that she wants to accept responsibility and move on with her life.

So Lindsay and her lawyer, Shawn Holley, will go back to Judge Stephanie Sautner as early as next week to enter the plea. 

Lindsay has already been sentenced to 120 days in jail for the probation violation, along with 480 hours of community service. Sources tell us Lindsay and her lawyer are banking on Judge Sautner not adding additional time on the theft charge. In other words, when Lindsay serves her 120-day sentence, that would be the end of it.  And sources familiar with the case say that would be a routine disposition.

L.A. County Sheriff's spokesperson Steve Whitmore tells TMZ his rough calculation is that Lindsay would serve three weeks, although there are variables to that.

We're also told the L.A. County District Attorney is inclined to give the case to the L.A. City Attorney, since the D.A. typically prosecutes felonies and the case is now a misdemeanor.  But now that Lindsay will plead no contest, it doesn't make a lot of sense for the D.A. to kick the case to the City Attorney.

Holley could not be reached for comment.

We'll find out next week what's really happening - but it's possible Lindsay decided to plea without knowing in advance what the sentence would be for several reasons. My first thought was that she wants to do it while it's still a misdemeanor - appeals challenging reduction from felony to misdemeanor tend to be granted quickly. But the last hearing was sort of a dry run for a trial, since witnesses were called and evidence was presented. The frenetic tag team display by Lindsay and Patrick in the tape would not sit well with a jury (they were running that clerk ragged) and the later pictures of her with the necklace were clearly damning evidence of intent. But my guess is that possibly even more importantly, the people from the store were very effective witnesses. A defense attorney has a good chance of discrediting liars or anybody a little wobbly about what they saw and experienced, or at least raising doubts about their testimony. But these people were the worst kind of witnesses from a defense standpoint: They told the truth. The whole truth. Nothing but the truth. And they were sure of what they saw and experienced. Viewing the surveillance tapes at high resolution solidified their true memory of events (and no, they didn't "lie" originally when they thought she had pocketed it, they just had the usual problems witnesses have correctly remembering details of unexpected events). Their testimony would be extremely credible to a jury, and the defense attorney couldn't shake them.

That would be consistent with the way the store people have behaved throughout this thing, which has been a nightmare for them thanks to the Lohans, who have taken every public opportunity to trash the store and try to destroy their reputation. Lindsay's father even did that after a much earlier hearing, outside the courthouse, in front of media (taking a little time from his own self-promotion), and we've seen the relentless campaign they've waged against the store in the tabloids - even infiltrating comments sections (which becomes quite obvious when you read comments in places the Lohans haven't been paying much attention to). And yet nobody from the store has trashed Lindsay back. When asked, they simply say she did not have permission to take the necklace from the store. That's all. They don't call her names or anything. Once they actually said they were sad about the situation - which I'm sure they were, it is indeed sad when a young woman like her does such a thing. They simply have not shown any signs of being the lying sleazeballs that the Lohans & Company have tried to paint them as. Despite attempts to imply otherwise - their markup on jewelry has even been shown to be quite standard for the industry (and quite realistic, considering extra costs involved in retail jewelry).

The store's statement about releasing the surveillance video was in the same dignified tone - not a single nasty word against Lindsay, they just said that they were receiving many requests from media for it (quite believable, we know that stores routinely do sell such video to media right away). There were public comments made by people who had already seen it (actually the Lohans & Company, although the store didn't say that), and they decided to just let people see for themselves and draw their own conclusions. That was a very reasonable response to a situation where the store was repeatedly accused in public by the Lohans & Company of making a false accusation, doing it as a publicity stunt, etc. and the Lohans were even threatening to sue them. (!) It was obvious that they weren't going to make any real money off the sale (and they certainly hadn't rushed to sell it - the Lohans really created that need by their own attacks), but it got it off their hands and the media out of their hair. A little thought would make it clear that a small jewelry store, with slow turnover, would indeed suffer financially from the kind of media attention that Lindsay brought to them - loss of customers for such items due to just reluctance to appear on some pap's camera would be quite serious, especially since they would be losing "transient" customers who were just in the community briefly. They don't have the rapid turnover of other types of stores or the mobs of local customers who could come back another day. I hope they do make some money someday telling their story in whatever way they can, it's been such a David (the store) vs. Goliath (the Lohans & Company) thing. But they have been quite restrained while the legal proceedings have been pending.

So once again, the Lohans have been shooting themselves in their own feet by trashing the store instead of dealing with the situation in a dignified, respectful way. All their smear campaign accomplished was 1) release of the video to the public and 2) removing any reluctance the store owners and personnel may have had about testifying and 3) making that testimony solid and firm, no wobbliness at all that could be exploited by the defense. Beware the ticked truthteller...

Maybe the judge did reduce the charge to a misdemeanor figuring that the DA's office would quickly move to reinstate the felony (so the judge could say she at least gave Lindsay a chance) and the Lohans & Company would just as quickly decide to forget about the trial and take a plea while it was still a misdemeanor. The solid testimony given by the store people, though, may have really and finally convinced Holley that it was completely pointless to go to trial.

She needs to hook a wealthy man (or woman, I guess) to keep her in money and under control, a sugar daddy (or mommy?). That way she can social shop and mingle with the upper crust and have her photo taken for no reason other than her looks. Isn't that all she wants really; to see herself on the big screen and photos in magazines?

When she says something like, "I want people to see that I love to act", she's missing the whole point. People don't care if she loves to act, they just want to be entertained. So far her most entertaining role has been on the courtroom runway, making a joke of the judicial system.

kinda like E-trade sometimes it is just an financial decision.It is referred to as *go away money* usually less than $20k and the suit goes away or the alternative , spending 10x that much fighting the allegations and the bad press (the lohans would make sure of that)

Their corrupt crew counts on it being "easier" to pay them off than fight...

There is no plea deal. She plans to plead no contest and the DA has no obligation to deal. She already got her deal DUH! The case goes forward without a plea and she maybe does another 2 weeks and some probation on top of what is already sentenced...shiz!

The only poor choices I'm aware of are:

1. Allowing themselves to be distracted and not noticing Lindsay
was wearing the necklace as she was leaving.

2. Allowing Lindsay in the store at closing time after she had
previously attempted to walk out with a diamond earring.

However, I can see why they gave her the benefit of the doubt until she failed to return the next day like she said she was going to do.

Not as much as Lindsay's suit against E*Trade was because of her ridiculous claim that anyone using the name "Lindsay" MUST be doing so in reference to her even though the baby didn't look or sound anything like her. Yes, Lindsay, you're the one with that name who drinks...milk.

However, I guess she "won" that one because she was paid a nuissance fee of a few grand. It was just cheaper to pay her off than challenge in court.
