Lindsay to Plead No Contest to Theft

4/30/2011 6:30 AM PDT BY TMZ STAFF

Lindsay Lohan will plead no contest to the misdemeanor theft charge she faces over that pesky necklace ... sources connected with the case tell TMZ.

0429_lindsay_lohan_no_contest_tmz_ex
We're told Lindsay is committed to what she told Jay Leno this week -- that she wants to accept responsibility and move on with her life.

So Lindsay and her lawyer, Shawn Holley, will go back to Judge Stephanie Sautner as early as next week to enter the plea.

Lindsay has already been sentenced to 120 days in jail for the probation violation, along with 480 hours of community service. Sources tell us Lindsay and her lawyer are banking on Judge Sautner not adding additional time on the theft charge. In other words, when Lindsay serves her 120-day sentence, that would be the end of it.  And sources familiar with the case say that would be a routine disposition.

L.A. County Sheriff's spokesperson Steve Whitmore tells TMZ his rough calculation is that Lindsay would serve three weeks, although there are variables to that.

We're also told the L.A. County District Attorney is inclined to give the case to the L.A. City Attorney, since the D.A. typically prosecutes felonies and the case is now a misdemeanor.  But now that Lindsay will plead no contest, it doesn't make a lot of sense for the D.A. to kick the case to the City Attorney.

Holley could not be reached for comment.

Obviously there must be some arrangement in place. She has Shawn Holley representing her not a public defender(whose goal is to close the case).
I'm thinking it will be unsupervised probation for this as she already has to do 3 months of community service---------------------------------------------------------------where in the hell did you see three months at. I saw 480 hours. she cant make court appearances, she misses a 20 probation meeting many times. she is always late. hell she missed days on the sets. she has a year to complete this. Not enough time for her. unless they give out vodka and coke.you are wacked i never read three months any ware in this

she has not made a step on her own yet. something bad is going to happen i think the judge baited her. knowing she cant do community service where you actually have to work. she cant stop partying. and she might show up a few times but it will not last she is looking for more time behind bars. she is no way no how in the clear. she cant even show up for a 2o min probation meeting.

Lohan doesn't really have much of a choice. No contest is still guilty. She will always have a record be known as a thief and has a rotten working reputation.

She caught another break, maybe this time she won't screw it up. Way to early to tell.

Not so flipping Linnocent I guess anymore?

Will her enablers EVER grow up and get a clue?

I was kinda hoping she would keep fighting it so she could get a REAL prison sentence!

ummm my fuzzy math thinks 480 hours is 12 40 hour work weeks, or rather three months of full no interruption work days.

I figure she will be able to break it up however as we all know this will be a struggle because she will actually have to show up.

No way she gets out of this with unsupervised probation even if she pleads no contest. Even if she does she'll never be able to complete her community service and will never stay out of trouble long enough to get through any further probation supervised or not.

Good thing for Nicole though. If Lindsay straightens up Nicole will be out of a job and we wouldn't want that.

@bunny. I don't want her thrown in jail for stealing a necklace.

I want her thrown in jail for DUIs, drugs, violating probation on several occasions, assault, several counts of theft, contributing to the delinquency of a minor and for any number of things I've forgotten to mention.

I imagine it dawned on them all that they should move fast while it was still a misdemeanor. If the DA's office appealed to reinstate it as a felony ( which they apparently intended to do), the chances were virtually 100% that the appeal would succeed since all such appeals in 2010 were granted. Then she would be back to dealing with a felony charge.

It also might have penetrated their well-shielded brains that they had very little chance with a jury trial. The evidence is really too compelling, all this "reasonable doubt" stuff the Lohans keep peddling is delusional thinking. Any "reasonable doubt" vanished the next day when the necklace was not returned, and the clincher was when she wore it on the street a few days later and then turned it around on her neck to disguise it when she spotted a photographer. I find it hard to believe that anybody on a jury (unless paid off or threatened) would go along with the idea that somehow Lindsay was still Linnocent after viewing the frenetic act she and her friend put on in the store plus the damning pictures later, and hearing that it still took her a week to return the necklace - only after she heard about the impending search warrant. All this is simply not Linnocent behavior.

I find it hard to believe that more jail time won't be added, though. The judge found the evidence quite convincing that Lindsay did indeed deliberately steal the necklace. It wasn't a 50 cent trinket from the dime store, after all, and she was on probation at the time. with a long string of probation violations behind her. She is not a "first offender". And the only reason her previous antics hadn't been categorized as felonies was that her lawyers were able to plead them down - they did indeed qualify as felonies. She wasn't just stopped at a checkpoint for her last DUI - she was driving recklessly in hot pursuit of a terrified citizen, in a car she hijacked (still including unwilling passengers). The only way she got of serious consequences on that one was by paying high-priced lawyers. Anyone poor enough for just a public defender (or for a lower-priced lawyer) would have been in jail or prison for quite a while on that one.

I hope the new judge follows up on the suggestions of the last one to include mandatory therapy to deal with her deep-seated issues, including her shoplifting habit- her compulsion to steal is going to get her into more and more trouble with the law. As long as she doesn't drive, she can get wasted as much as she wants on whatever drugs or alcoholic drinks she wants. She can probably get away with stealing from friends, they soon learn to lock up their stuff. But stealing from merchants is simply not tolerated anywhere. She's been lucky in previous incidents that it didn't get far enough to be out of the merchant's hands (as happened in this case) and so money could be tossed at the merchant (or other non-friend) to soothe them. That luck is likely to be much diminished as time goes on, especially since it's on record now.

chaps no interruption is the word. she has never really had to work. so 40 hours a week and she want last 3 weeks with out screwing up. Work will get in the way of her social life. she might start off good the first 3 days. but after that she is going to hate her life more then ever

Lohan. Community service is a big deal. It's court ordered. A friend of mine is doing it and they don't want to hear any crap from him. He signs in and his hours are reported weekly. He has to be in full complience.

I really think Lindsay was afraid of going to trial. She would have had to come up with real answers. Not like how she runs rings around issues as she does in interviews....with no real answer. She would also be caught in lies. The DA would tear her to pieces & she knows it.

(from another thread)

You can bet ali Lohan will get busted for drinking or drugging anyday now if she keeps partying with her coke head sister Lindsay

Isn't Lindsay friends with Demi? Her people claim they are old buddies from the 70's show set sitting around on couches maybe..

Dina pretends her peers are A-list actors parents and always drops names trying to associate them together in peoples minds..it makes her feel important like being a 'Rockette'

I can see lindsay at the morgue right now drinking embalming fluid, stealing the corpses hair, removing gold teeth with pliars, stealing their jewelery clothes and belongings, and to top it off have sex with them to remember the days with sam ronson.
