'Desperate Housewives' Star Popped for DUI

Ricardo Chavira -- who plays Eva Longoria's husband on "Desperate Housewives" -- was arrested for DUI early this morning in Los Angeles ... law enforcement sources tell TMZ.

The 39-year-old actor was pulled over for a routine traffic stop at around 2 AM -- when cops allegedly smelled alcohol on his breath.

We're told Chavira was given field sobriety tests at the scene -- but they didn't go so well -- so cops arrested him on suspicion of DUI. Sources say Chavira refused to take a blood or breath test.

Chavira was taken to a nearby jail -- where he was booked. He's currently being held on $25,000 bail.

I think they need to make the drinking and driving penalties much stiffer. Obviously what they're doing now isn't much of a deterent. There's way too many still hopping in their cars and driving drunk!! Look how many TMZ report a month!!

The law in California on DUI is stupid. Drivers pulled over on suspicion of DUI should not be allowed to refuse a breathalyzer or blood test to check for alcohol or drugs. The law should be changed to state that any driver who refuses a request to provide a breath sample when he/she is suspected of DUI is automatically found guilty of the offense of driving or being in control of a motor vehicle while being incapacitated. We shouldn't allow celebrities and multi-millionaires with top-notch defense lawyers to get off the hook for their offenses because they do not provide breath samples when they drive while apparently under the influence.

They should NOT be drinking and getting behind a wheel to begin with. But isn't it kinda weird that all these people have been getting popped lately. Is CA that broke to have cops stake out eateries and they have other cops posted on these peoples routes going home to pop them for DUI. Don't tell me it's not plausible.

It's so easy to get a cab in LA. Just call, not like some parts of the country where there is no cab service readily available. Especially at 2:00 AM. Crazy.

Hopefully, this is his first offence. Nothing worse than a multiple offender. Those people really don't get it. One DUI is a dreadful mistake with potential serious consequences, twice is a serious problem because the person clearly doesn't believe they did anything wrong the first time.

Hopefully this guy will thank his lucky stars he didn't hurt anyone and make a serious change to his ways.

Whenever this happens it should immediately affect the person's job. If you are a truck driver etc, you lose your license when you get popped for DUI. He should be suspended until it goes to trial and if convicted should be written off the show. These people are in the public eye and they do set an example, I have no sympathy for him and people like him don't deserve to keep their job.

Dam right cops stake out places that might be generate a drunk driver, how else they going to catch the SOBS? Just doing their job and good for them. Keep the tickets coming, keeps the rest of us safe.

You people are ridiculous and misinformed. Just because someone was stopped and the cop smells alcohol doesn't mean the person is guilty of driving drunk. As for the invasive tests, why would someone voluntarily give evidence against themselves? That's just plain dumb - and it doesn't make them "go easier on you".
