'Desperate Housewives' Star Popped for DUI

The 39-year-old actor was pulled over for a routine traffic stop at around 2 AM -- when cops allegedly smelled alcohol on his breath.

We're told Chavira was given field sobriety tests at the scene -- but they didn't go so well -- so cops arrested him on suspicion of DUI. Sources say Chavira refused to take a blood or breath test.

Chavira was taken to a nearby jail -- where he was booked. He's currently being held on $25,000 bail.

bail? You dont have to pay bail when you get a DUI.... $25,000? Really? Another example of going HARDER on celebrities.

Like many of the sentiments expressed by everyone, I believe that drinking and driving is a selfish choice to make. I think Mr. Chavira is lucky enough to have been arrested before he got into an accident or hit someone because he was too impaired to drive. Also, refusing to take breath and blood tests is a bad move, in California, drivers who refuse these blood or breath tests are subject to longer license suspensions and revocations. No wonder his bail is set so high!

I drink and drive all the time, and never got caught yet. But if I had these guys money, I would definitely take a cab, no doubt about it. I just cant afford it, so I take the risk.
