LA Restaurant Defends Itself in Pink Donkey Fiasco

5/7/2011 6:00 AM PDT BY TMZ STAFF

A famous Los Angeles restaurant is fighting back against claims it abused a donkey as part of a Cinco de Mayo stunt ... claiming the animal was perfectly cared for at all times.

Pink Taco took a lot of flack from locals -- and even on Twitter by a few celebs, like Pink and Lo Bosworth -- for dying a donkey pink and using it to promote the restaurant.

But a rep for Pink Taco tells TMZ, "We obtained a permit from the city to have the animal on site and the pink coloring used on the donkey was a safe, water-based and commonly used on animals in the entertainment industry. Additionally, the donkey’s trainer escorted him the entire appearance, he was on a leash, not a chain as reported in the media, and we provided plenty of water and care to him throughout."

The rep tells TMZ they have spoken with PETA about the incident and have decided it was in their best interest to not do anymore animal-related promotions in the future.

Hopefully, the dye was vegetable based and harmless, but it was tasteless and inappropriate. But, then again, what do you expect from a restaurant named Pink Taco?

They used to paint donkeys in Tijuana for photos, but I don't think it should be legal in this country to use an animal this way. Not cool.

People dye their hair all the time with stuff that is way more caustic than what they put on the burrow. Not saying I would eat there. But I recall alot of dye in PINKS hair.Wouldn't mind eating there. ;)

There are water based paints and dyes that people use in horse shows all the time, no one makes a stink then. Also, to the person that says animals lick themselves and ingest the dyes- that may be true, but I dare you to find a horse/donkey/mule that can lick itself. It may be in poor taste but it probably didn't harm the animal.

What a disgusting idea. The poor donkey! Pink Taco should be investigated for this. I have never and will never eat at this restaurant because of this, and no one who cares for animals should!!

The donkey looks like it's shaved so it has no protection from the heat whatsoever. The black "dye" looks more like a black marker pen.

It's not about the dye, that's used all the time on show biz animals. It was incredibly hot that day and that poor animal was in the direct sun, next to a loud, busy street. That's what bothers me. And the jerk who owns Pink Tacos PROMISED in 2008 not to do this very thing.
Let's paint him pink and put him in the sun all day.

BTW, I think PETA's way overboard and should just shut up about most things.

Man up Pink Taco. Tell PETA to get bent. So tired of loser hippies with no life thinking they are in charge of everyone else.

F U C K PETA! That bunch of animal killing liars has no right to speak on any animal's behalf. I love animals of all species and breed with all my heart but I know PETA can suck a big fat ball sack when it comes to actually giving a real **** about an animal's feelings. I'm sure those thousands of pets PETA kills instead of adopting to willing families would say the same thing as well.

Donkey FACTS

Insider information from a source at Pink Taco:
1. donkey is named EEK
2. When she was born she made an "Eek" sound and it just stuck
3. She is 10 years old and was born on Phils ranch and is cared for by their vet team and staff 7 days a week.
4. She was featured on Scorpion King as her biggest roll
5. Phils Animal Rentals are the trainers and keepers and are highly rated and used for most movie sets and promotion because if they are the best and they have been in business for over 30 years.
6. The pink coloring is a human skin coloring make-up as used on most movie sets (so you could say it was tested on humans) it has been approved for animal coats and actually goes on moist to both keep the animal cool and protect her from the sun. It is water based and commonly used on animals in the industry.
7. The pink make-up washes off easily and so Eek got to enjoy two full body baths yesterday.
8. Phil had full booties on Eek to make sure she was very comfortable with non-slip soles.
9. Eek was led and hand kept throughout our 45 min event by her trainer Scott and his worn soft rope just as she does at her home on the ranch for our Cinco de Mayo event.
10. We cleared our air conditioned freight elevator for Eek's trip to the second level of the mall.
11. Phil's biggest concern is that Eek is a little overweight so the more work she gets the more exercise she gets during the travel.
