Lindsay Necklace Case -- No Contest Plea Tomorrow

Lindsay Lohan will officially plead no contest to misdemeanor theft tomorrow -- TMZ has learned -- but Lindsay won't be showing up in court.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey.  And we're told 120 days translates into 14 DAYS.   So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

The one person in California who has the absolute right to be pissed off is Paris Hilton!

Paris did half of her 45 day sentence in th jail and it was her first offense probation violation. She is the only person in state history not allowed the break of over crowding when sentenced to jail time.

Lindsay has multiple probation violations and a misdemeanor theft conviction and will in the end do less than half the time Paris was made to do for probation violation and no time for theft.

Didn't you just say she would be done with probation? Now it looks like she might get another year. She doesn't do well with probation, does she? I hope it includes drug/alcohol testing!

Actually I appreciate you are responding to the rhetoric here...that is constantly here...but many repeat offenders and violaters do 1/2. I dont think Paris qualified, but so many do that time. The Sherriffs early realease is a lottery and often starts with telling an inmate who qualifys that they are released and when they are 5 or 6 hours into the process of release they are offered only work release or house arrest which creates revenue and helps to keep work done at sherriffs facilities. and the jail is also cleaned up by work release inmates.

I believe that with LL's arrest history combined with the many violations she will be on work release only after doing some days and then will do more than 25% of her sentence. Look - they do not go through the process of outfitting someone for home arrest for a less than 20% revenue. No profit in that

That truly was the Judge. Paris even had Shawn as her lawyer in 07. Shawn also defended Nicole Richie who did 82 minutes of a 4 day sentence and Michelle Rodriguez that done 18 days out of 180.

No i pretty much knew after the 480 hours of CS she was getting another year of probation.

This is a plea deal and she is getting house arrest. She has Shawn Holley representing her and she wouldn't allow Lindsay to plea without negoitating the best possible sentence.
