Big Blow to Defense In MJ Manslaughter Trial

The judge in the Michael Jackson manslaughter trial just undercut a big part of the defense, by ruling 16 hours of rehearsal footage for the "This Is It" tour doesn't show MJ to be in poor health.

Dr. Conrad Murray's lawyers wanted the outtakes to prove Jackson was very ill in the days before his death.  The argument goes -- he was already dying, so Dr. Murray can't be held responsible for his death.

But Judge Michael Pastor ruled ... the outtakes were valuable to Sony Pictures -- which objected to turning over the footage -- and the video did not show MJ in poor health.

If the hours of video show a healthy Michael, it undercuts a major line of defense for Murray.

The Judge is not a Doctor and this footage should have been allowed. Having been around druggies in my early 20's, MJ had clear signs of usage and he was quite frail. I"m sure a Doctor with experience in drug addiction would likely think otherwise ((if they had the balls and opportunity to testify)).

Murray was an unfortunate assistant to the death of MJ. Like Winehouse, MJ's death would have happened eventually due to his drug use

Seems to me that Michael didn’t go to the rehearsals when he wasn’t feeling well. I would imagine when he was at rehearsals he wasn’t conspicuously unwell – he would have been back in his element; shining and in control. Creating, dancing, singing, mentoring – it’s likely he wouldn’t have compromised his reputation. He was slim, he forgot to eat at times due to the excitement of the upcoming show, he wasn’t sleeping properly obviously, he likely was stressed and he had a few ailments that were already diagnosed as well as age-related aches and pains. But was he at death’s door? Not likely, at least that’s not what the autopsy results revealed.

Facts. Conrad Murray was given a job; he performed poorly and had questionable procedures. I don’t know about the conspiracy theories, scapegoat stuff but, bottom line, Conrad Murray was there, he failed his patient due to his own negligence, and the patient died.

RIP Michael Jackson. We are quieter now, but we’re still awaiting justice.

Am guessing the Judge had to have seen the unrelease footage or else how does he know MJ was healthy? I need something to be cleared up, is it true that the only drugs found in MJ's system was the propofol that Dr Murray allegedly administer to him? And was a toxicology exam perform? Since that would show what other drugs were in his system. If only the portafol was there than this is going to be tough case for Dr Murray's team of lawyers to defend.

The clips from the videos I have seen - does NOT show him in good health. He looks abnormally frail and skinny.

Once again - I have no idea whether Murray is the one who gave the fatal dose, which I believe is the crux of the case.. who gave the deadly dose...

But to say that he looked in good health is just absurd. The clips from "This Is It" - show a man who was gaunt and sickly looking. I guess if you're from Ethopia - that might look like "good health".

sigh... i hate ppl who assume things from clips. watch the MOVIE this is it and you will see he wasnt unhealthy. no 50 year old man can sing and dance like he did in that movie if they were "frail and unhealthy" like you said. the man was healthy by all reports and i saw it with my own eyes. you do know he was that skinny when he did the thriller album right? you just remember him at his biggest in the 90s before all the trials. please do your research before blabbing on about "clips" that you probably youtubed.

oh and mind you mj would take it slow in rehersals......so this was probably him giving 50% effort hahaha. imagine him at 100% during the real concert. what a genius!

Of course they'll find that dr. guilty. It's Micheal Jackson we're talking about. We can't get any justice for these poor children who get murdered by their own parents and lets not forget Micheal was a child molester but boy they'll lock that dr. up quick and throw away the key. If he did kill MJ, Cudos to him one less pervert in the world.

I still don't get what Michael's health prior to his death really have to do w/ the fact that Murragy OD'd him. I mean, the cause of death is acute propofol intoxication.... right? So what does any day or moment before the fatal dose have to do with anything? Had Michael been stabbed to death, you couldn't say "He was already dying as of the day prior... so really I didn't do anything."... that's such a bogus argument. Just accept that YOU FXCKED UP either by accident or deliberately...

Also, don't compare This Is It rehearsals to Michael's previous tours, compare them to the REHEARSALS for Michael's previous tours.

Michael never gave it his all in rehearsals, he saved his voice and his energy for the real performance.

Just because Michael was frail and skinny looking does not mean that he was about to die anyway. He was always skinny and said on previous tours that he tents to loose a lot of weight during them because of the many rehearsals and concerts.
I agree he looks too thin but that does not mean he was sick.
He died because he was given anaesthetics by a doctor who wasn't trained to admister them and clearly put the patient and his life at risk for not providing monitoring and first aid equipment...
let alone not knowing how to do CPR.

Still boggles the mind that the Defense wanted to show Michael in ill health at all as that would just show how truly incompetent the Doc was by not noticing his patient in failing health (which he was not) and what a liar he was for telling the insurance co. that Michael was in great health.

Again, Murray admitted that he was giving Michael Propofol, although the timeline of how long this was going on is still foggy because Murray can't seem to keep his stories straight. He also admitted that this was done in a home setting and without the proper medical equipment to monitor the patient. Apparently he was the monitor and failed at that big-time!

These facts alone and openly admitted by Murray are evidence enough that he was reckless and negligent in his care of a patient. These facts alone show sub-standard medical care was given to a patient. And there is a lot more evdience that will come out in the trial. Murray is going to be charged with Manslaughter and the Defense knows they have a losing case.
