DUI SENTENCE

"OUTRAGEOUS"

Jalen Rose's lawyer is LASHING OUT at the Michigan judge who just sentenced the former NBA star to serve 20 days in jail for his March DUI ... claiming the sentence is an "abuse of discretion."

Attorney Keith Davidson tells TMZ, "The 20-day jail sentence issued today by this Michigan judge is outrageous."

He adds, "Today we saw a horrendous example of judicial temperament and discretion."


Davidson insists Jalen is a "model citizen who has personally donated millions to charity, established inner city charter schools and a medical center in the Congo" and most importantly ... "has NO PRIOR criminal record."

Davidson adds, "[Jalen] was the victim of abuse of discretion; lack of proportionality in sentencing; legislating from the bench & instituting illegal minimum mandatory sentences for DUIs in violation of law. "

"Mr. Rose is examining all of his legal options based on today's events."

Relevant Fun Fact: In Michigan, there's NO minimum jail requirement for first time DUI offenders.

I understand why most of you agree with the judge's ruling. But what you don't know is that the daughter of this judge was arrested for being a minor in possession (MIP) of alcohol. The judge is known for being harsh on all alcohol related crimes and has jailed each minor for the same offense her daughter committed. But guess what happened to her daughter? You got it, nothing. And when questioned about it, she claims to not remember what her daughter was sentenced with.

A 20 day stay in jail harsh??? I was a 20 year old man, now 26, and had to stay in a facility for over 5 months. Im sorry that I cant give millions to a charity or millions to what ever would make me seem like a better man, but giving money out doesnt make you any less or more of a man when it comes to breaking a law. Alot of people in the spotlight tend to forget that there are alot of people that have actually went through the same law problems as them. So to complain or grip about a 20 day stay in jail is the funniest thing I have ever seen on TMZ! I am the happiest man in the world knowing that people with money or fame get the same treatment as every US citizen. It didnt used to be like that, but welcome to future and recession, there is no holding back :)
