Accused of Ripping Off 'Judas'

's hit song "Judas" is a total rip-off of a 1999 song called "Juda" ... so says a singer named Rebecca Francescatti ... who just filed a lawsuit against Gaga in federal court.

Rebecca claims the similarities between the two songs are NOT a coincidence ... because her former bass player -- Brian Gaynor -- is now employed by a music company that wrote 17 songs on Gaga's recent "Born This Way" album.

Rebecca's lawyer, Chris Niro, tells TMZ, "Though the songs are different styles, the composition is the same and the chorus is the same melody ... [Rebecca] is seeking recognition for what she created."

Francescatti, who sings under the name Rebecca F., is suing for unspecified damages. 

We called Lady Gaga's camp for comment ... no word back so far.

What is ridiculous is that EVERY single she releases lately has someone trying to drag out something they once did that is supposedly similar to claim they are due something. It really is mostly the case of unsuccessful people trying to cash in. To me, these songs are not nearly similar other than in the names. Pretty much ANYTHING that can be done in rock music has been done similarly somewhere else... Born This Way and Express Yourself was the closest matchup in regard to Gaga song comparisons, but even there I find the songs to be plenty different. If every musician had to scour the world for similarities to other things done before they would give up and not release new music. Also, there are tons of bands who have a formula and make new songs that are HIGHLY similar to things they themselves have done before (Rammstein and Disturbed fit this very well because they have unique sounds and the repeat similar things regularly)... it is just how it is.

They are both factory pop products with zero personality (the songs) and for one to claim they have made an original product is a joke. When you are doing songwriting this lazy and unoriginal you should be embarrassed to call any other song a rip-off. They both fail as songs but one is not a rip-off of the other. That's like one mineral water company claiming another one of stealing the taste!

1) Gaga writes her own music with help from some producers. No companies write for her.
2) That song sounds nothing like Judas.
3) If anything, Judas is a rip-off of her previous songs Bad Romance and Poker Face.
