She Should NOT Be On Probation

Casey Anthony's legal team tells TMZ they will fight the judge who just rejected their claim that Casey served her probation for check fraud while she sat in jail during her murder trial ... and if they lose Casey will have to return to Florida in 11 days.

Anthony was sentenced to 1 year's probation for her 2010 check fraud conviction.  The judge who sentenced her said in court the time Casey spent in jail would not count toward completing probation, but the order the judge signed mistakenly allowed Casey's probation to run concurrently with her time in the pokey.

A judge ruled on Friday that the judge who sentenced Casey clearly made an innocent mistake, and it wouldn't make sense to allow Casey to get credit for the time she was in jail.  After all, the point of probation is to test how a person behaves when they are in the real world, not while they're locked up with few opportunities to misbehave.

But now her lawyers tell TMZ they will appeal Friday's ruling.  If they win, it would mean Casey would get a huge break -- her probation would already be completed -- because of a technical error. 

Casey's lawyers say if they lose their appeal ... they want her to serve her probation in a state other than Florida.

I strongly urge Harvey, the TMZ staff, public, Florida and U.S. officials to read in full Judge Perry's Order this past Friday...with particular attention to sections of transcript cited from the January 2010, Order. What is clear, the original judge was confused and he was going to think about this situation. The prosecutor advised they believed Ms. Anthony could serve her probation while in jail awaiting trial. Note, too, the origianl probation order attached to Judge Perry's Order. Not only did Ms. Anthony not sign it, it gave latitide to the parole officer to decide where the intake meeting was to occur...and shockingly, if Ms. Anthony was in custody at the time of her probation intake meeting she was to be immediately released from custody and her bondsman released from liability. There is something very, very strange going on...and deserving of further attention and public scrutiny. Judge Perry actually prepared an that appears to provide the facts for a successful appeal. The next few days should be interesting.

Charming Casey Anthony served her probation time in jail, as per the written order from incompetent, show-boating Judge Stan Strickland. Now, pompous, spiteful Judge Belvin Perry wants her to be punished again. His ridiculous "order" will be overturned by an Appeals Court which follows the Constitution rather than TV trends.

When the verdict was read, it was the "slap in the face " heard round the world. The least she could do is probation for all the devastation she has caused to many. The judge wasnt unfair, the clerk read the order wrong. She needs to at the very very LEAST do probation to protect US, the people, and to make sure she doesnt feel free to continue her reign of destruction. To appeal the LYING charges, to appeal Probation,, COME ON! Probation is a gift, the death penalty was what should have been given. Count your blessings CA, and do the classy thing for ONCE and own up to your debt to society.

Judge Strickland's January, 2010, order of probation permits the probation officer to select a location for the initial meeting, allows Ms. Anthony to live in another locatin with permission of probation, and the "monthly meeting" requires only providing a full and truthful report to the probation officer by the 5th of each month on a form to be provided to her. There is some other restrictions, cannot drink alcohol to impairment, cannot use illegal drugs, cannot have a firearm without prior approval, be subjected to searches, drug testing, and visits and home or work, support her family in a lawful manner, but it basically is an administrative probation from the start. The idea Ms. Anthony has to report in person to her probation each month is false. The order is actually worth reading.

LOL TMZ are you that desperate for news that you keep writing about Casey Anthony? She's not a celebrity and this is hardly celebrity news.. Of course her lawyers will fight it - they're immoral, vile s****bags - it was a given. So why even bother to write about it on this site? It is non-news... and she's not a celebrity anyway, so it really has no place here.

I am thinking of boycotting this site.


I am so done with this website.. there is barely any stores on here anyway - too much clowning around in the "news room" for you guys to get some decent stories. 90% of the stories on here are stupid with major spelling and grammatical errors.. and sometimes just REALLY bad mistakes -- like mis-identifying Dwight Yoakum and other MAJOR mistakes... Get a grip people, this isn't about the Caylee case, she was acquitted on that. This is about a check writing deal. Do you really want to go through the circus we had the last time? Why don't you go after the real criminals in this case like Nancy Grace and Jane Velez Mitchel who made a ton of money off the blood of Caylee by inciting people to violent talk and ignorant threats? We have to move on now.

They need to get over it because the first judge was clear about intent, and awaiting a trial for a second crime is not the same thing as serving time for a previous conviction

They know that and are just trying to make sure that evil child murderer gets it all her way
