She Should NOT Be On Probation

Casey Anthony's legal team tells TMZ they will fight the judge who just rejected their claim that Casey served her probation for check fraud while she sat in jail during her murder trial ... and if they lose Casey will have to return to Florida in 11 days.

Anthony was sentenced to 1 year's probation for her 2010 check fraud conviction.  The judge who sentenced her said in court the time Casey spent in jail would not count toward completing probation, but the order the judge signed mistakenly allowed Casey's probation to run concurrently with her time in the pokey.

A judge ruled on Friday that the judge who sentenced Casey clearly made an innocent mistake, and it wouldn't make sense to allow Casey to get credit for the time she was in jail.  After all, the point of probation is to test how a person behaves when they are in the real world, not while they're locked up with few opportunities to misbehave.

But now her lawyers tell TMZ they will appeal Friday's ruling.  If they win, it would mean Casey would get a huge break -- her probation would already be completed -- because of a technical error. 

Casey's lawyers say if they lose their appeal ... they want her to serve her probation in a state other than Florida.

Let it rest. I think the dad did it and most people believe her story. It's not uncommon to come from a dysfunctional family and have the parents behave as they have. I do think she suffers from dissociation which would explain her actions. Yet she lives in Florida, home of the see no evil, hear no evil, tell no evil. Most of the people hating her are worse parents than she. I believe her, move on.

Florida should not vote for Perry or Strickland again. These 2 judges are looking for fame not justice. Both judges knew there was not a shred of evidence of anything other than neglect............child likely drowned in pool when not being watched ......she should have been tried for accidental death due to negligence and she might have been convicted and would have served more than the inflated 4 years for lying to police. Florida overcharged and the psychological damge to the defendant caused by sitting on trial for DP was certainly cruel and unusual punishment...........she did not kill her daughter. Even child services said there was no suffication by anything and no bruised bones. Drowning in pool is the only logical conclusion. These prodecutors and Judge Perry (and Strickland) have cost Florida 1 million dollars while trying to put to death a girl they all knew did not kill her daughter by the means suggested in prosecutors case and in fact were looking for votes! Dis-barr prosectors for putting false computer searches for chloroform into testimony and making claims of a body in the trunk which they also had no human decomp evidence of and knew it.......they would have tested and found Caylee's DNA in the maggots if the body was there.......they did not test those magots for DNA because they knew she was not in the trunk. Florida needs to find honest judges to vote in!

For some reason you thought we all cared what you had to say...sorry honey we don't want to see your lying face. You could drop off the face of the earth and nobody would even notice. 99% of America are praising Judge Perry because he is not letting that slut get off free.

Any moron knows you don't serve probation in jail. probation is for when you're released from prison and are re-introduced into society so they can keep an eye on you for a certain amount of time. So, how can you serve probation in jail?

The Judge did not make an was a scrivener's error (clerical error). Casey's attorney's were well aware of the error & decided NOT to notify the court. Judge Perry asked the defense if they were aware of the error & admitted that they did. However they felt that it wasn't the defense's burden to notify the court about it. Judge Perry took up that issue in his order, stating that attorneys have "a duty of candor." Judge Perry's words were: "While ignorance of the contents of a court order is one thing, the failure to abide by that order and the failure to notify the court of a known scrivener's error in the order may be a violation of an attorney's duty of candor," Perry wrote. "To additionally seek to use a scrivener's error to achieve an end that was against the court's intent, especially where both parties had argued the issue of when probation should commence, strikes at the very foundation of our justice system. No attorney should conduct himself or herself in a way that impedes an order of the court. Our system of justice should never be in the position of rewarding someone who willfully hides the ball." Judge Perry is a fair man & his ruling should stand. Casey needs to go back to FL & do probation!!!
