Judge Dismisses Sex Case

Says Dateline Entrapped Sailor

A sailor caught in the web of Dateline's "To Catch a Predator" was just acquitted of all charges, after the judge ruled NBC engaged in entrapment.

Joseph Roisman was prosecuted for lewd and lascivious conduct with a minor, after allegedly arranging a meeting with someone he thought was a 13-year-old girl.

Judge Arthur Wick in Sonoma County, California, threw the case out after the prosecution presented its case, ruling prosecutors failed to prove Roisman had an intent to have sex with the decoy.

Roisman's lawyer, L. Stephen Turer, lashed out at the tactics of the people responsible for "To Catch a Predator," saying "They took everything away from this kid just to make a TV show."

Turer added, "This case is the poster child for the abuse in this program."

There were 29 arrests as a result of the Dateline sting.  28 of the defendants pled guilty without going to trial.  This is the only case of the 29 that went to trial, and Dateline's tactics were squarely repudiated.

NBC could not be reached for comment.

I don't care how they catch them. I just want them caught. They were going to meet up with kids. Anyone who thinks that's ok is a psycho liberal or a pedophile (or both)

bottom line...... agreed he had some wrong intentions no 2 ways about it, However .. it is not dateline's job to profit off of it. So I do agree he beat them... way to go... I dont condone his actions but no one should profit off of misdeeds of somones else

The law of entrapment is there to protect you and me from renegade police and anyone else who is trying to prove thier point in some way by setting someone up to take a fall. The guy might be a pig or not I wasn't there. TV has the power to edit and make the story look just like they want to capture viewers. The Judge absolutely made the right choice. That's why we have a constitution.

I agree with Barb.. As disgusting as I find the whole thing, I felt that Dateline was way out of line with these shows. It was entrapment. NBC was using these shows as some sort of perverse exploitation for ratings and not as much as a deterrent to these crimes or bettering society for it. Chris Hanson and his creepy persona made it all seem a show for entertainment.

The tactics used by Perverse Justice were questionable too. I agree that no man should get involved with children and it is immorally reprehensible, but the tactics used were over the top. They would bait these men into situations by contacting them over and over (again, I am not saying it as an excuse).
The scary thing is this whole issue of pedophilia itself. It knows no bounds or stereotypes. Men ( and women) of all walks of life, all ages, all work backgrounds, all races, all sexualities seem to be represented. How do you rectify something like this when there is no common thread. It is frightening. Parents need to step in and monitor their children and keep them safe.

It helps to understand what entrapment is under the law,
If the police induce someone to commit a crime they had no intention of committing that is entrapment but if the police offer someone who is willing and able an opportunity to commit a crime and they act upon it that is not.
The police aren't forcing these guys to have these graphic conversations and they sure aren't forcing anyone to drive over to the house where they expect to find a 13 year old girl.
How can you be a lawyer much less a judge and not know the difference?

I can see ruling entrapment when someone is enticed to do something illegal that they wouldn't do normally. But really, a pedophile si still a pedophile and doesn't need to be enticed or entrapped.

No. He drove 5 hours to meet a person he thought was a 13 year old girl. Talked about having shaved his pubes so he wouldn't get hair in her mouth and was undressing when they stopped him. Maybe legally it was entrapment, but he ruined his own life. I don't feel sorry for him. Also, 28 of the 29 people caught in the sting plead guilty, so that's not a bad record.

man...All those stupid fake TV shows are just about money! "To catch a predator" and "Operation Repo" are just bunches of fakes! NBC have fail so many times these days and needs to give it up and shut down business now. Chris Hanson is the dude who was behind all this crap and he is a real pedaphile who have been spying in underage teen chats and he should be caught and send to jail!
