Battling In-Laws Over

Russell's FINAL Resting Place

0817-taylor-russell-armstrong2-EXRussell Armstrong's parents and his estranged wife, Taylor Armstrong, are thousands of miles apart in a heated battle over where Russell's remains will end up.

Multiple sources close to Taylor tell us the "Real Housewives of Beverly Hills" star is not only planning a memorial for Russell -- she also wants him to be buried at a Los Angeles area cemetery.

But Russell's attorney Ron Richards says his former client's parents want their son's body returned to Texas -- where they live -- for cremation.

As TMZ first reported, Taylor and Russell had been back in touch recently -- despite the fact she filed for divorce last month.

Richards says he believes Russell's final wishes were to be cremated. If true, Taylor might have a tough time winning this battle.

Let's stick with the facts. At the time of his death he was still legally married to Taylor, THEREFORE, she has the legal rights to his body. Lastly, had they have been divorced HIS KIDS would have the legal rights to his body NOT his parents. In my opinion, the body of a parent should be located somewhere (whether cremated or buried) where that persons children can visit them. If he has three kids that live in the LA area (I don't know where two of his three kids live) then he should remain in the LA area so his children have the opportunity to visit their dad.

@ Sloane, you are incorrect. My mother passed away 2 1/2 years ago and she was not married so her 4 children, myself included, had to decide on her funeral arraignments. Also, once one child contests a cremation the deceased person must be buried unless you go through legal route and fight for what you want. Bottom line is, his parents have no legal right to his body whether they are divorced or not. I believe they can act on behalf of his children but since he has three by three different women that's going to be a difficult accomplishment.

If they were still legally married, the decision should be solely hers. Just like with the Teri Shivo mess a while back. That was his wife and his decision to make. I don't care how they were getting along or if they were living together. If two people are married, the spouse has the legal say. Where do these parents get off? Period. End of story.

Whatever he stated in his will is what should be abided by. Technically, his parents have no say anyhow. Taylor is STILL married to him even though she had filed for divorce. They weren't divorced yet. I feel for his children. He had no money left and now everyone in the family has something to say because they think they can cash in. He had no money people. He was broke beyond belief. My question is who is now responsible for paying off his debt? Taylor or will his family do it since they are now coming foward?
