West Memphis 3

Men CANNOT Sue Over Incarceration

8/19/2011 10:10 AM PDT BY TMZ STAFF

0819_memphis_three_BN_05
The lead prosecutor in the West Memphis 3 case claims the deal he struck with Damien Echols, Jessie Misskelley and Jason Baldwin PREVENTS them from ever having a chance at winning a civil lawsuit against the state of Arkansas.

Scott Ellington explained at a news conference today that because all three men pled guilty, the State is insulated from any lawsuits the men might file ... seeking damages for being locked up for crimes they previously insisted they did not commit.

Damages in such a suit could easily rise into the tens of millions of dollars.

The deal doesn't prevent the WM3 from FILING a lawsuit -- however, the prosecutor believes any judge would simply throw such a case out before it went anywhere.

What a bunch of CRAP! They should be able to get some compensation for their WRONGFUL imprisonment! These guys are INNOCENT yet they have to plead Guilty?! WTF! I'm just so happy they are out of jail at this point but still, I'm angry for what has been done to them & why the hell is the Ex-Stepfather, Terry Hobbs, still walking the streets, he's as Guilty as Sin!!!

That's ridiculous!!! So if they didn't commit the crime, they served 18 years of their life for nothing and the state is making sure they can't sue??? Bull****!!!!!! I would OWN that state and everyone in it!!!

**** the state of Arkansas. Susan Lawson only received 10 years and served only 5 for shooting my ex-husband in his own front yard, in front of our children and his children by his present wife. Who does only 5 years for second-degree murder? Apparently Arkansas has no problem with that!!

Of course they can't sue; at least not in arkansas. That whole state has been so influenced by the bigoted judge and moronic prosecutor that there is no way they would ever get a fair trail. Wait a minute... that happened before!

The state of Arkansas knew it was only a matter of time before the lid would be blown off of this kangaroo court hearing. The ginger headed bigot of a judge would have been my first lawsuit followed by those keystone cop detectives then the prosecutor. They saw it coming, released the men and used the Alford Plea to protect themselves from civil suit.
