JANET JACKSON WON'T ATTEND TRIBUTE

By Anthony McCartney, AP Entertainment Writer – 3 hours ago

LOS ANGELES (AP) — Janet Jackson said Monday she won't attend a planned tribute concert for her older brother Michael in Wales because the show coincides with the trial of a doctor charged in the King of Pop's death.

The singer's one-sentence statement to The Associated Press does not criticize the show, as her brothers Jermaine and Randy have done, but cites the court case as her reason for not attending.

"Because of the trial, the timing of this tribute to our brother would be too difficult for me," her statement reads.

Her statement was released on what would have been her brother's 53rd birthday.

Organizers of "Michael Forever — The Tribute Concert" have struggled to line up top-name acts and have been criticized by fans and the late singer's estate for multiple reasons, including its costly tickets, timing and remote location.

The show is scheduled for Oct. 8 in Cardiff, Wales, and the singer's mother, Katherine, and some of her children are scheduled to attend.

Christina Aguilera, Smokey Robinson, and Cee Lo Green are the top-names listed as performers so far. Organizers had to rescind an offer to the band Kiss after fans and Michael Jackson's estate noted that singer-bassist Gene Simmons had harshly criticized the pop singer over the years.

Opening statements in the involuntary manslaughter trial of Dr. Conrad Murray are scheduled to begin on Sept. 27. Murray, who has pleaded not guilty, could face up to four years in prison if convicted.

Authorities allege he gave Michael Jackson a lethal dose of the anesthetic propofol and other sedatives in the bedroom of his rented mansion on June 25, 2009.

Dr. Conrad Murray Dealt Crushing Blow In Upcoming Michael Jackson Trial

-
Dr. Conrad Murray's criminal defense team has been dealt a crushing blow when the judge presiding over his involuntary manslaughter trial, ruled that Michael Jackson's dermatologist and long time friend, Dr. Arnold Klein won't be allowed to testify.

Dr. Murray wasn't in court for the pre-trial hearing on Monday in Los Angeles.

Judge Michael Pastor agreed with the Los Angeles County District Attorney's Office -- which opposed the defense's attempt to call Dr. Klein as a witness in the trial.

Judge Pastor stated that Dr. Klein's testimony isn't relevant to the case, and that it could confuse the jury.

“Dr. Murray's lawyers were planning on asking Dr. Klein about Demerol that he allegedly prescribed to Michael Jackson in the days before he died. The defense was going to contend that Dr. Murray didn't know that Dr. Klein was giving Michael Jackson Demerol, at the same time he was giving him Propofol, to sleep," a source close to the case tells RadarOnline.com.

Judge Pastor also ruled that no testimony would be allowed regarding past allegations of child abuse and molestation involving Michael Jackson.

However, two doctors that gave Michael Jackson Propofol in medical settings will be allowed to testify at the trial. The singer’s former nurse Cherylin Lee will also testify and in do***ents filed by the defense they claim she will discuss Michael asking her for Propofol on April 19, 2009, just two months before he died.

DR. CONMAN MURRAY'S DEFENSE STRATEGY CONFIRMED:

The Los Angeles Times reported that the defense team for former Jackson doctor Conrad Murray filed papers in Los Angeles Superior Court Monday indicating that they plan to paint Jackson as a hopelessly hooked addict who was constantly "on the hunt" for the anesthetic propofol.

The papers indicate that Murray's defense team will enlist the testimony of numerous Jackson associates -- including friends, members of his medical team, and even Grace Rwaramba, the nanny to Jackson's children, in order to make the case that the singer was hooked on propofol and other drugs.

The judge in the upcoming trial of Michael Jackson’s doctor has ruled that witnesses will not be allowed to testify about the pop star’s child molestation trial.

Los Angeles Superior Court Judge Michael Pastor said Monday such testimony would be distracting and misleading for the jury in Dr. Conrad Murray’s involuntary manslaughter trial and is irrelevant.

IRRELEVANT - Absolutely
